Is there a gag order on this case? If so, what exactly is the media not allowed to report on? Is it just that the prosecution and defense can't talk to the media?

Prosecutors and defense attorneys won't comment on whether Sigg will plead guilty to all or some of the charges because a judge has issued a gag order in the case.


One resident contacted authorities Oct. 19 to alert them about Sigg because he had a fascination with death, Westminster detective Luis Lopez testified. Sigg was interested in a mortuary science program at a local community college, police said. Two FBI agents responded and took a DNA sample from Sigg on Oct. 19.

Mindy Sigg told investigator Michael Lynch that her son appeared sick and confessed four days after the FBI visit. He opened the conversation by saying he was a "monster," she said.

Mindy Sigg then called 911 to say her son wanted to turn himself in and had confessed to killing the girl. When the dispatcher asked what her son had said, Mindy Sigg replied, "That he did it, and he gave me details, and her remains are in my house."

Umm... Motion to suppress his statements? No probable cause to arrest or detain him? Correct me if I'm wrong but did he not confess to his mother and a police dispatcher when she called the police? Did he not lead police to the crawl space where the rest of Jessica's dismembered body was located? I love America and our constitution but I seriously get annoyed with all these monsters who try to use it to get off for these heinous crimes they are accused of. I really hope the judge denies these motions.

I just read that the judge in the James Holmes trial has ruled that the jury will not be sequestered. I think it might be beneficial to look at what happens in that trial to get some idea of what might happen in this one since they are both taking place in the same metropolitan area.

And here's some info on change of venues in Colorado:

Attorneys have a few months before they would need to make the request of the court.
The change is not granted often, but it has happened in several other high profile cases in Colorado.
Back in 1993, Nathan Dunlap walked into an Aurora Chuck E Cheese restaurant and opened fire killing four people.
The Arapahoe county case was moved to El Paso County.
In a more recent example, Alex Midyette, a Boulder County man was accused in the death of his infant son.
His case got tons of publicity in Boulder and was moved to Denver.

The defense argues that there should be a change of venue because when you google Austin Sigg, you can 900,000 results. However, I just googled Austin Sigg and got 58,000 results. I put his name in quotes to limit the unrelated results. If the numbers are changing that drastically in the span of a month, I don't think they should be used as some criteria. I felt like the defense was telling me the case got a lot of media coverage, but they weren't showing me that it did. I expected their change of venue motion to be more detailed, but the only numbers they provided on media coverage was that the Denver Post had written 61 articles in one month. But how many of those articles were written before the arrest of Sigg?

Motion in the first link is totally norm. Matter of course, it simply asks that the prosecution follow the rules and supply defense with all they have in regards to the case which might be used against their client. This is a non issue IMO and normal process.

I believe the argument is that no adult, parent or advocate, was present during interrogation and during AS statements and therefore his Miranda rights were not fully upheld during interview.

The third linked doc argues that IF the statement is disallowed then all evidence gained from that statement (all evidence in the house for instance and all evidence gleaned after and due to the statement) is fruit of the poisoned tree and therefore inadmissible.

I do not find any of the motions shocking, if I were a defense attorney I would be filing the same.

Interested to see how the court rules on the statement.

Even if no adult were present to advocate for AS, the call which placed him into custody in the first place came from his mother, which implies her consent to them questioning him, present during or no. In addition, the Prosecution can argue that they already had his DNA and so, would have found their way to him eventually. Once arriving at him as a suspect, the house would have been searched, plenty of probable cause IMO through the DNA match.

It's on topic in a way. When Jessica went missing, many WS members were absolutely certain the culprit was someone who lived nearby who was on the RSO list. As we now know, poor Jessica was the victim of a young man who wasn't a registered sex offender.

Crimes are solved by following the evidence with an open mind.

Jefferson County District Court Judge Stephen Munsinger granted the motion on the grounds that the expert speak generally about adolescent brain development — including the effects of trauma — but does not opine directly about Sigg's mental state.

What trauma, though? I haven't heard about Sigg suffering some major head injury in the past. I am confused about what the defense is. Sigg did it...but he suffered prior trauma that altered his mental state? The defense hasn't been able to get an insanity ruling though.

While looking up information on change of venues, a lot of articles say that the judge will try to seat a jury first before granting one. If they have trouble finding an impartial jury, then they will consider moving the trial.

I also am having a hard time finding a trial in Jefferson County that was granted a change of venue. Sequestering the jury is also rare in JeffCo. I only found one trial where that occurred, and it was only during the penalty phase. It was the trial of Albert Petrosky Jr in 1996.

Of course, Jessica's case was probably more publicized than most cases in that county, but it doesn't seem like changes of venues or sequestering the jury is easily granted in JeffCo.

JEFFERSON COUNTY, Colo. - The accused killer of 10-year-old Jessica Ridgeway told his brother, "I need to get punished," a Westminster police detective testified at a Thursday hearing.

Detective Mike Lynch said on the Oct. 23 night that Austin Sigg was arrested, his mother told police she had overheard Sigg talking to his brother.

"Don't let Dad get an attorney for me. I need to get punished," Sigg told his brother, according to the boys' mother.

It sounds like the above is being brought up because Sigg's lawyers are trying to get his confession thrown out. :(

This new info is so hard to look at. What he put her through and what sick things are in his mind. Scary that his defense team is working so hard to get him less time. This monster could return to do it again.

Why did no one check this computer? After all, they knew he was treated for 🤬🤬🤬🤬 addiction. I guess in the parents mind, 🤬🤬🤬🤬=pleasure but in the monsters mind, 🤬🤬🤬🤬=unspeakable horror. He looked at things that should never be seen.

This case is hard to archive. Actually they all are.
