Austin Sigg sentencing cont. today. No audio of Def witnesses per judge's order. If Sigg speaks we will hear him.

We are monitoring live feed of #AustinSigg sentencing. Defense witnesses don't want to seen/heard so silence now.

So it is the witnesses are the ones who don't want to be on camera? Maybe worried about retaliation?

So is the media allowed to print "Joe Smith said X" at Sigg's hearing? Can they release the witness's name?

I wonder if there is a gag order on what they say? If not we may hear a synopsis after the fact?

I'm going to assume it's Sigg's relatives, maybe even his brother. (And yeah, for retaliation reasons.)

In 40 yrs. no one is going to want him living anyplace on the outside. Society has no space to harbor such a creature. He is an evil thing forever more!

15 minute recess

I think she meant he is 18 as of today. I think his b day is Jan 17 1995 according to her power point display.

The outcome of this hearing is almost certain. AS will be sentence to life with the possibility of parole after 40 years. Since AS was 17 at the time the crime was committed, that sentence is the maximum allowed by law.

40 years from now, this case will come before a parole board. They will be absolutely horrified by the facts of the case and keep AS in jail.

sigh. I know they have to do this, I get it, but I grow tired of hearing about his early childhood.

Tuesday morning's testimony involved an expert on adolescent brain development, Dr. Marie Banich of the University of Colorado. Banich spoke about brain development in general; she has never interviewed Sigg.

Her testimony centered on the fact that parts of the brain that control planning and that understand risk and reward don't fully develop until people are in their mid 20s.

She spoke of a study of 900 people ages 10-30 that she completed with the McArthur Foundation that found only 25 percent of them had reached complete brain functioning.

On cross examination, Chief Deputy District Attorney Hal Sargent tried to ask how many people in the study took pleasure in the pain of others. The defense objected.

The prosecution said the study did not have direct application to Sigg, but Banich disagreed, saying the study pointed out general development patterns in adolescents.

"It's not a yes or no answer, but a matter of degree," Banich said. "It's one of many pieces of evidence in scientific literature."

Prosecution:

"He's broken."

"There is no fix for him."

"There was a monster in her path."

"She asked if she would see her mother again."

"He knew she was dead the moment he pulled her into the car."

"He is someone who derives pleasure from pain. He derives pleasure from dismemberment."

"He then made her dress in a uniform of sorts... He then cut her hair... He had her in his room for an hour and a half to two hours."

Details her wounds...

Then strangled her. "She continued to twitch, convulse."

Poured scalding hot water in the bath tub because she continued to show signs of life. Put her face down into the bathtub, into the scalding hot water.

Dismembered her. Further detail I can't type.

Please excuse me for saying, "Here's how NC did it," but:

A particular defendant in NC who was 17 when he and one other committed several crimes in one incident, was convicted of 1st Degree Murder, 1st Degree Kidnapping, and Robbery with a Dangerous Weapon. He received a Life Without Parole sentence. Then, the US Supreme Court ruled that those under 18 could not be given a life sentence automatically. The prisoner was up for re-sentencing. The NC Court system (or whatever body) presented the case and the prisoner was given a LWOP re-sentence. So he is in for life.

This was the Eve Carson case -- the college senior, a Morehead Scholar, and the Pres. of the Univ. of North Carolina.

So, it can happen to Sigg as well.
