I noticed on his FB page it listed
School: Greeley West 2010
I checked the GWHS website and there is no list of graduates.
Also, he only had a few (less than a dozen?) "friends" on FB and MS - could be for many reasons (only a few friends in RL, too? Only recently joined the networking sites? little access to internet, etc?) but worth noting.
Also saw at one of the sites (oops... I forgot which one?) two older brothers. Rudy and ??? I will try to go back and look.


It is strange, IMO, that we have heard nothing about RM; whether he lived with a parent or parents, has siblings, etc...no one even seems sure about his schooling or employment. I would think that if he had family members behind him, his attorney would want that known. Does anyone know if the arrest warrant shows a home address? Did he live in the apartment complex?

Hi Noway- how the heck do they know if Montoya has a prior criminal record? He turned 18 in January and his records would be sealed as a juvi. Did I miss something? TYI

I guess they meant between January 2010 and May 2010.

How can I seal a juvenile record?
A person with a juvenile record must wait three years after completely serving his or her sentence for the crime before applying to seal the record. In addition, the person cannot have been found guilty of any crime, except for minor traffic offenses, anywhere in the United States within the three years before making the application.

I think he would have had to have filed a petition to seal his juvenile records (if he had any), otherwise, they are not sealed.

In Colorado, even if a juvenile case is closed or dismissed, the court records remain open and accessible to certain individuals. As such, these juvenile records often cause people serious educational, employment, and social consequences in their juvenile and adult lives.

Fortunately, Colorado law permits a "Petitioner" to file a civil action in District Court to request an expungement of their juvenile records. Because a juvenile delinquency adjudication is a special statutory proceeding that is non-criminal in nature, a person who wishes to seal his/her juvenile records must proceed under the juvenile expungement statute, not the criminal record sealing provisions for adult criminal records.

Remembering Kayleah

Some knew her well. Others simply came to show support for her family. But everyone in the standing-room-only crowd at the Plaza Hotel and Conference Center was thinking of 12-year-old Kayleah Wilson at her memorial service Tuesday. These were some of their comments:

She was an amazing girl, and she will be missed and loved.”

Kayleah was a loving little girl. She loved her mother and she loved her brothers. She loved talking to her father on the phone.”

Pastor Arron Chambers,

who presided over the service

She was a happy-go-lucky child; very vibrant, very out-going. What happened to her should never have happened.”

Whoever did this, we need to catch them and make an example of them. I'm a lot more watchful of my own daughter now.”

I grew up in Greeley so I helped with the search. It just makes you want to go home and hug your kids.”

"That person, one day, will stand before God. And he will avenge her death," said Pastor Arron Chambers of Journey Christian Church.

Chambers presided over a memorial service that drew about 450 mourners to the Plaza Hotel and Conference Center Ballroom in downtown Greeley.

Kayleah, who loved Ireland and snowball fights, cherished above all peace and forgiveness.

"This just doesn't make sense," Chambers said. "She should be outside laughing with her friends and enjoying this beautiful day.

"She should have made it to that birthday party."

Kayleah's brother, Mackenzie, said he took a lot of long walks with his sister in attempt to iron out their problems. "She was the kindest little sister."

Kayleah was entranced by Irelandand wanted to travel there with her mother, Chambers said. She also wanted to be a veterinarian and wore a pink hat decorated with a button that said: "No Place For Hate."

She also was a regular churchgoer, Chambers said, and attended services the day she disappeared. No one can explain why she was taken from her family and friends, he said, adding that her new journey is just beginning.

The video tribute is beautiful, yet inaccurate.

She did not disappear on her way home from a friend's birthday party. She never made it to the party.

The former boyfriend of a 12-year-old girl whose body was found in a Greeley drainage ditch last week told friends he thought the girl he is accused of sexually assaulting may be pregnant, according to an arrest affidavit.

Kayleah Wilson's body was found last week after she went missing on March 28 as she walked to a friend's birthday party. Police say her death was not accidental.
That same day, Greeley Police arrested 18-year-old Robert Montoya on charges of sexual assault on a child. In his arrest affidavit, he admits to having sex with an underage girl and told friends she was possibly pregnant.
The arrest affidavit makes it clear why he is charged with sexual assault. In the affidavit, names are blacked out.
The affidavit says Montoya moved in with his girlfriend and her mother in October 2009. Montoya and his sister had to move out of their home because Montoya's mother wanted to begin a relationship with a registered sex offender, Jonas Garcia, and Garcia was not allowed to be around children, according to the affidavit.
The mother of the alleged victim told police she assumed Montoya and her daughter were good friends at first, but that she began to see signs of a physical relationship between the two of them in December.
According to court records, one of the dates of sexual contact between Montoya and Kayleah was in December.
Police say Montoya also claimed that during sex, the alleged victim wanted him to physically abuse her, but he did not.
The mother of the alleged victim told police she confronted Montoya and he admitted he and her daughter had been having sex and they considered themselves boyfriend and girlfriend, according to the affidavit.
When the mother of the alleged victim confronted Montoya, she told him to leave their house.
The affidavit says the alleged victim was very angry initially, but then stopped talking about the relationship.
According to the affidavit, Montoya admitted he tried to see the alleged victim without her mother knowing several times.
The affidavit says she caught them at an abandoned car dealership in February.
Later, the affidavit says he would even hide in the bushes outside her home went to her school.
When the alleged victim caught him doing that, she called him a "stalker freak" and told him to leave her alone, according to the affidavit.
Montoya faces felony charges including sexual assault for allegedly having sex with Kayleah. He is in jail, being held on $10,000 bail.
9NEWS spoke with Montoya's family, but they had no comment.

If all that is true...that he had become the "stalker freak" Kayleah referred to...how could he not have been a suspect from the very beginning? Unless Kayleah's mother did not tell LE all this until her body was found? But why would she have withheld all of this info? This is truly bizarre...I am gathering from this report that the girlfirend he moved in with was Kayleah when he had to leave his own home?

Yes. He moved in Kayleah and her family.

I am sure he was a POI from the very beginning. Just not one mentioned by LE. They kept it close to the vest to the body was found.

They must have suspected she was dead all along if they felt he was a suspect from the beginning...IMO

Yes, somebody had posted wondering what all Kayleah had done the day she disappeared, such as attending church. IIRC, it was in regards to figuring out if there was an opportunity prior to her leaving for the birthday party in which RM might have sexually assaulted her, due to the date on his charges.
