The mother of the alleged victim told police she confronted Montoya and he admitted he and her daughter had been having sex and they considered themselves boyfriend and girlfriend, according to the affidavit. When the mother of the alleged victim confronted Montoya, she told him to leave their house. The affidavit says the alleged victim was very angry initially, but then stopped talking about the relationship. According to the affidavit, Montoya admitted he tried to see the alleged victim without her mother knowing several times. The affidavit says she caught them at an abandoned car dealership in February.

And she didn't have him arrested for having sex with her 12 year old daugher?

This story is becoming more disturbing to me...I hope that April Wilson told all of this to LE when Kayleah first vanished and if she had, I can't imagine it would have taken much for LE to break this guy way back then...he obviously has spilled his guts now. I wonder if she (Kayleah's mother) only little by little told LE about the relationship and how it had gone bad? I am very surprised this has never come out before as others had to know he was living there. If Le had this info about the sex and stalking and peering in school windows back in late March I find it hard to imagine they could not have arrested him on the sex charges, at minimum, at that time...I am confused and don't mean to place blame on anyone but just wonder when LE got this info...

:furious:RIGHT. I think this is Montoya telling bits and pieces of contorted truths to align with what (IMO) HE KNOWS Kayleah was found like.

IF this is true - was Kayleah trying to have her attention distracted from the sex? Why would a 12yo ask to be physically abused during sex? Oh, and how great of him not to physically abuse Kayleah during sex, he just stuck to the rape! Anybody believe this! moo

Does anyone know or can anyone think of reasons why it would be better to have this arrest warrant issued before Kayleah's body was officially identified? I think at the time of it being written her body was found (and probably was known by investigators it was probably her).

The last sentence in the arrest affidavit states "As of 051910 efforts to locate XXXXXXX have been unsuccessful"

I am assuming the blacked out part refers to Kayleah...

Seems like the timing must have some sort of reasoning behind it. Just curious as to what it might be. ?

I don't for a second believe that Kayleah asked to be physically abused. What I see is a story similar to that guy who strangled the girl in the park - I believe it was in New York. Years ago. He insisted it was a consensual part of the sex they were having.

I this as "I didn't *want* to beat her up/strangle her/choke her/whatever - she *asked* me to - and next thing I knew, officer, my gosh, she was dead!"

Maybe the name blocked out was someone else? There was mention of other people who supposedly had heard about the alleged pregnancy...

This is just so disturbing to me, all of it...sorry, but Mom knew this was one scary guy for a while, at least since February, and not sure if she did anything at all. By that time, he was 18, so he was legally an adult, even if she had been uncertain about laws before then, giving her benefit of the doubt. And did I read that the school knew he was stalking her? What on earth happened, did everyone let this girl down?

The arrest affidavit makes it clear that she told Det. Morgan right in the early days. It says on the next day (the 29th) the FBI was called in, and the next paragraph says April (blacked out) "had" (past tense) told him all about RM.

Not only did the school know he was stalking her there but the police were called on Feb. 19th, I think. Why didn't they arrest him them for rape. Surely the mother had to tell them why he was stalking her.

The affidavit says:

"______ told _____ she was going to get a ride to ______a's residence from ______'s residence to the birthday party and would be home around 1900 hours."

Did we know she had someone else's house to stop at on the way to the party? I wonder who this is? And I wonder who's name ends in "a" and whose residence she was supposed to be at for a ride.

One thing that did cross my mind was that they were playing "the choking game" and Montoya got carried away and accidentally killed her.

The affidavit says Montoya moved in with his girlfriend and her mother in October 2009. Montoya and his sister had to move out of their home because Montoya's mother wanted to begin a relationship with a registered sex offender, Jonas Garcia, and Garcia was not allowed to be around children, according to the affidavit.​
