Maybe the name blocked out was someone else? There was mention of other people who supposedly had heard about the alleged pregnancy...

This is just so disturbing to me, all of it...sorry, but Mom knew this was one scary guy for a while, at least since February, and not sure if she did anything at all. By that time, he was 18, so he was legally an adult, even if she had been uncertain about laws before then, giving her benefit of the doubt. And did I read that the school knew he was stalking her? What on earth happened, did everyone let this girl down?

Yeah I guess it could have been someone else's name and not Kayleah's.

Yes, I think everyone let 12 YEAR OLD Kayleah down. :(

Holy crap! He was at her school looking in the windows at her and LE was called because of it!!

I don't know how much more of this affidavit I can read :(

This is my point...if LE knew this, and Mom knew about the sex...why was he not taken into custody prior to her having to be murdered, if he killed her? She might still be alive...

Also I read on the Greely Trib site that Kayleah told her mom that she was getting a ride to the party from a friend's house...is this the house that has been on all the maps or it that where the party was? That walking to the party was the story put out from the beginning....but now it seems it was not true...

I don't know what is worse, that the boys mother tossed him out for a sex offender or that the girls mother allowed him to move in with a 12 year old girl in the house.

OMG...I been in the hospital and I have alot of catching up to do. Im speechless.

Has this been mentioned? I keep up, but don't read every single post.

The affidavit says:

"______ told _____ she was going to get a ride to ______a's residence from ______'s residence to the birthday party and would be home around 1900 hours."

Did we know she had someone else's house to stop at on the way to the party? I wonder who this is? And I wonder who's name ends in "a" and whose residence she was supposed to be at for a ride.

IIRC I think I remember her going to meet someone first and then they were supposed to travel to the party together. I didn't remember hearing about getting a ride from anyone though. That is new to me.

Montoya was caught in the bushes out front of her home and peering in the windows at Kayleah's middle school - police were called. Kayleah called him a 'freaken stalker' and just who, may I ask, helped this child? School, police, brother, mom, anyone? My sweet Kayleah, life must have been a nightmare for you...so sorry!

Yes everyone did let her down. I'm still waiting to hear about even one responsible adult in her life.

I thought I was speechless...but I can't seem to stop typing...this is just beyond belief. How many warning signals are needed when a 12-yr old is involved? An 18-yr old known to have had sex with her is stalking her and police are called to the middle school and yet no arrests are made, apparently, until she is missing? Do I have this right?

As a mother who is responsible for a 19 year old going to jail for being with my 15 year old daughter I am appalled.

Why did mom not have him arrested for sexually assaulting Kaylah back when she kicked him to the curb? The moment she found out there was something more than friendship going on, she should have called the cops. I am sorry.

One thing that did cross my mind was that they were playing "the choking game" and Montoya got carried away and accidentally killed her.

My thoughts exactly! Very popular among the pre-teen and early teen age group. They are still too young to realize what a danger it is!

I think the cops were called to the school because someone was peeping in the windows, hiding in the bushes. We don't know via the affidavit, what was told to the police by him or if police connected his "peeping" to Kayleah at the time of that incident. I'd like to see the report on that school incident.

If it turns out RM killed her...I feel like lot of people let Kayleah down in order for this to happen, including LE if they knew about his activites before 3/28 and did not arrest him as well as any adults who knew about sexual activities and stalking behavior and did not report it...I am not feeling very charitable about this after reading all of this...Kayleah was in danger from the time RM showed anger at being told to "stop" and/or to "leave" and I am not seeing what was done to protect her. If I am wrong and he was reported and LE dropped the ball, then they share blame...IMO

If she would have called the cops, they would have arrested or charged him back then. Even at 17 and her 12 it was illegal.

Although this information came out once Kayleah was missing, I think the reason they didn't charge him immediately is they were hoping he'd get loose lips and talk to a friend or so they could keep an eye on him, perhaps he'd return to the "scene of the crime".

Once they found Kayleah, they arrested him right away, so he wouldn't flee while they wrapped on the homicide investigation.

If she did call the cops on him when she kicked him to the curb, the report of it would have been in the arrest affidavit. jmo

so WTF is wrong with the DA in your county? He/she can't enforce laws that are on the books to protect 12-YEAR OLD CHILDREN? An ADULT male was caught stalking and looking through the windows of a MIDDLE SCHOOL?! Were any parents notified? Sounds like you need to clean house and replace your sheriff, DA, school principal and superintendent.

I agree that the children in that area definitely need a better safety net.
