I'm not a lawyer but found this info interesting (it's from a Colorado law firm):

Colorado’s "Criminal Solicitation" Laws (18-2-301 C.R.S.)

"Soliciting a felony in Colorado
Under Section 18-2-301 of the Colorado Revised Statutes (C.R.S.) you commit criminal solicitation when:

  • You attempt to persuade another person to commit a felony, or
  • You offer your services or the services of a third party as either a principal or accomplice to commit a felony;
AND

  • You intend to promote or facilitate the commission of that crime, under circumstances strongly corroborative of that intent."

I feel horrible for Kelsey's family. The holidays will never be what they used to be. Sadly it reminds me of Heather Elvis going missing on December 18th, just prior to Christmas.

So very sad. But I am happy little baby K will hopefully be to them in time for Christmas. Someone said she will heal them - I think it will definitely help... I have a 2 year old and I am so excited for him to wake up on Christmas morning to open the gifts I know he'll love. I hope the Berreth family does have a Christmas celebration and I hope K's innocent joy of it all will bring them some love, joy and peace. (tearing up at this thought....precious baby girl)

Just thinking here. Solicitation in Colorado isn’t necessarily solicitation to commit murder. It’s solicitation to commit a crime.

Possibilities that I’m thinking:
  1. PF asked someone to kill KB and they did it.
  2. PF asked someone to kill KB but he ended up killing her himself.
  3. PF asked someone to do something short of killing KB. But in the course of doing it, death occurred.
  4. PF killed KB himself but then solicited someone after the fact to assist in some aspect of disposal and/or cover-up.
Any other thoughts?

MOO I believe based on what DA said that only number 1 and 2 would lead to a solicitation of murder charge. And since he was charged with first degree murder I believe #2 is the actual scenario.

Am doubtful about Kelsey being in Idaho if she was killed in her home. Seems too risky to drive that far...jmo

While I know many of us, myself included, were very frustrated by the lack of information, seemingly slow response by all involved .… It seems they did their homework, did a slow thorough investigation for which I am thankful.

Just thinking out loud here. They don't have a body and they don't have a phone, yet they know the phone is in Idaho and they're working to retrieve it. I wonder what the hold up is on getting her phone back? Could it mean the phone continued to ping til the battery went dead? Could her phone be with her and they just haven't been able to pinpoint the exact location?
Could it have been dumped in a waste bin in Idaho, that was subsequently hauled off to a landfill? Or was it smashed? Buried?

So many possibilities. I understand why it could be hard to find it at this time.

Crying when I saw Kelsey’s thread change to “deceased/not found”

RIP Kelsey, know that your little girl will be well taken care of by your loving family and that so many people are fighting for justice for you. Another senseless crime.

Yes! LE working to recover the phone in Idaho.
There's been talk about this for the last week or so here Idaho. I'd like the media to start asking around LE in Idaho about their collaboration with the FBI to find the phone and why it's here. There's enough talk around that needs to be dug into by media.

I hope they are distracted in a good way with all the preparations needed to take care of baby ... lots of shopping and tasks to do for the little one ... I hope that is a source of comfort. Jmo

Baby K is in protective custody and will be reunited with Kelsey's family!
And that’s the part where tears started rolling down my face...

Did you guys see that someone else was arrested with long blonde or gray hair??

Exactly. The solicitation charge against PF does not necessarily mean that the solicitee agreed to do anything.

It will be interesting if more charges on any others come about in this case.

One other charge I have been really interested in is if anyone will be charged with obstruction of justice or accessory after the fact.

From what the DA said at the end of the press conference I’m going with #2.

Could be the 'solicitee' took the body and phone to Idaho and called in from there to assist LE but is hiding out and negotiating
now for his own benefit. MOO
