Yesterday afternoon, as the information about the temporary custody decision was discussed, there were comments that the hearing was booked a month ago and Kelsey's name was or was not included. That is where my questions and confusion comes from.
The only way I can see that that would be possible is if in CO, child support and/or parentage "paternity" cases are confidential, (parentage cases are confidential in CA but not if filed as a child support case, inexplicably), so we can't see what was filed in the docket, but somehow, a hearing was allowed to be shown on the docket. It doesn't make much sense to me though.
However, in CA, juvenile dependency cases (where a child is taken into protective custody by the state due to abuse, neglect or parental incapacity), are totally confidential, with not even hearings shown on a public docket. So it's odd.
The fact that Kelsey is named as a party to the case does not mean it was a case she filed or responded to. The parents would be listed in a dependency or guardianship cases even if deceased.
The fact that it is filed as JV case (which is what juvenile dependency cases are filed as) is telling. Child support and parentage cases can be filed as JV cases as well, though. But I'm not sure if it is less common than filing them as DR (domestic relations) cases, which is what divorce, parentage and support cases are filed under. I think child guardianships in CO as well.
But most telling is the timing. The hearing on temporary placement was held three court days after the child was taken by the state. The child was taken into protective services on 12-21-18, when he was arrested. The next two days were weekend days. Then came the 24th. The 25th was a holiday. The hearing was on the 27th. Which was the third court day after the child was taken into protective custody and thus in keeping with the dependency court timeline in which children taken into protective custody by the state must have a hearing as to temporary custody within 72 BUSINESS hours (which should not include holidays or weekends):
