Light snow is falling in downtown Cripple Creek, CO this morning. We are standing by outside the Teller Co. Courthouse for the 8:30 hearing. https://denver.cbslocal.com/2018/12/27/patrick-frazee-custody-hearing-kelsey-berreth-death/amp/#PatrickFrazee … #kelseyberreth – at Teller County Courthouse

Sometimes I wonder if (as a secondary reason) some of these guys go to trial to entertain themselves. To watch others go through more pain, to get to see the crime scene photos again. To ease the boredom of their life. The ones that fess up, I have to at least give them credit for that.

Some defendants go to trial because it may be their only chance to get off.

Court-appointed lawyers, in my experience, are paid for by the State, hence the taxpayers. (I usually think of pro bono meaning a lawyer is offering his services for free.) Only indigent defendants qualify for them. If an individual can afford to pay for an attorney, he must hire his own.
This tells me that PF has no assets. His family’s assets would not be considered in this situation.

Defendants cannot choose a particular court-appointed lawyer. In some places, those lawyers are paid by the hour, a lower fee, and in other places (when there are public defender’s offices), they are paid a fixed salary.

Just sayin’

My thoughts exactly. I also think his mom doesn't have the assets to help him out. I haven't seen what her other 2 properties are worth but the 35 acres of the land that was searched by LE, where the house and barn are located, is only valued at $259,000. Even if she could mortgage it to the hilt it wouldn't be enough to pay for a defense attorney in a first degree murder case. MOO.

I agree. I can’t believe one can get a farm there for such low cost. I need to move.

Haven’t researched CO laws pertaining to pro bono/hired lawyer. I would THINK one can choose his own counsel. Is his confidence such he feels no need to “hire” an attorney. Or, does his mom & family not wish to liquidate to cover costs? That has to be a tough decision. Does a parent “fund” a trial even tho it looks like he’s guilty? Should siblings have input into such a decision? Idk

MOO
Yes, he can chose between hiring a private attorney at his own expense or if he doesn't have the money or assets he will offered a court appointed attorney. MOO

The ultimate decision whether to go to trial or not is the defendant’s decision, not his attorneys. Although, the lawyer’s job is to advise and most defendanys respect that; some don’t.
Thanks for your expert opinions, it makes things soooo much easier for us here.

Thanks, hope Otto sees your reply. I know in my state they can switch over, if they choose. The state would be delighted for one to assume his own legal costs.

But was he dumb enough to dispose of evidence? I highly doubt that.
We’ve been discussing surveillance on another thread/case. People don’t realize the red corvette, green VW, beat up Dodge truck can be FBI or any LE. They are not following in marked vehicles. PF knew that. His bro is a cop. Also, one unmarked car might only follow a suspect to a certain intersection & a dif’ car then picks up the suspect so the red ‘vette isn’t in your rear view every where you go.
Can you tell I love my red corvette, lol.

MOO

Man jailed in disappearance, apparent slaying of Kelsey Berreth due in court Monday
Frazee, 32, is expected to be officially charged with the first-degree murder of Kelsey Berreth, 29, of Woodland Park. Although her body hasn’t been found, authorities say they uncovered evidence that Berreth was slain in her townhome.

The judge is also expected to address a motion to limit pretrial publicity filed by attorneys for Frazee, who argue that public interest in the case against him could taint a potential trial.
