She is more of an accessory if she disposed of evidence. If she had the phone, did she also send the texts? She can't be clueless in this matter. jmo
If she had the phone, she almost certainly sent those texts.

It sounds like she may have actually sent them from near her home (judging by that ping location).

I would think they would have to be close. Maybe she is originally from there and they went to school together. Imo
And his mom is a nurse as well. Just a strange coincidence, I guess, to add to this strange case. Maybe he likes nurses if he had "mommy issues." jmo

I hope that is true. The cell phone might be how the charges all happened like BAM!

I doubt she would have kept the phone. PF would have told her to get rid of it or destroy it I would think.

A woman being investigated for possibly disposing of #KelseyBerreth’s cell phone in Idaho is a 32-year old nurse from Twin Falls, multiple sources tell @ABC. For now, ABC News is withholding her name because she has not been publicly identified or charged.

Withholding Patrick Frazee arrest warrant affidavit violates rights, expert says

A district attorney’s efforts to withhold a document that lays out the case against the man they are accusing of killing Woodland Park mother Kelsey Berreth is a rare legal maneuver that may impinge on the suspect’s constitutional right of due process, legal defense experts said.

“To deny the whole (arrest) affidavit is highly unusual,” said Dan Recht, former president of the Colorado Criminal Defense Bar and an expert on constitutional criminal law. “It puts the defendant at a substantial disadvantage. There are constitutional issues to consider.”

Fourth Judicial District Attorney Dan May has asked Judge Linda Margaret Billings Vela to allow him to withhold a copy of the arrest warrant affidavit from 32-year-old Patrick Frazee, who faces five murder charges in Berreth’s death including two counts of first-degree murder and three counts of solicitation to commit murder.


May has declined to explain why he wants to withhold the arrest affidavit, saying the document has been sealed.

But a motion filed by his office Dec. 21 said disclosing the affidavit poses a serious risk of jeopardizing
the ongoing investigation and the safety of potential witnesses.

Prosecutors and defense attorneys are scheduled to argue over the affidavit’s release at a hearing before Vela on Friday at the Teller County District Court in Cripple Creek. Frazee also faces a preliminary hearing Jan. 29.

Preventing Frazee from seeing the affidavit could hurt his defense because he would not be able to help his attorney in preparing his case, Recht said. He compared it to cases in which mentally ill defendants are incompetent and therefore unable to assist in their defense.

“That is very problematic. It’s Frazee who knows the facts of the case. The defense attorney can’t be effective if he can’t talk to his client,” Recht said. “The defense is in the dark, and it’s difficult for them to make good arguments.”

It depends on the circumstances, and how compelling the evidence is that someone is deceased.

Had Kelsey just vanished, and there weren’t strong indications that she was dead, then it could have taken years for her to be declared legally dead.

No one plays that kind of long-game when the motive is financial.

They want that money soon.

But we aren’t dealing with the “brightest crayon in the box” ... this is a guy that solicited murder 3 times and then murdered or convinced someone to murder KB “AFTER” the CW high profile murder case in his state. Not to mention, he sent or had someone send a text message to her employer - which bought him time - but also confirmed that if KB was deceased - it was not at the hands of a stranger. Include his refusal to show at press conference and it boggles the mind that he thought he could get away with it.

Searches for Kelsey or evidence? There are no searches for her that I’m aware of.

I had not seen any publically covered as in searches so it was a question. Thank you. I hope LE knows more but cannot release.

So the nurse lawyered up and LE has probably been negotiating
with her atty. all this time trying to locate the phone.
Guessing they can't release her name until she's charged.

Adding here because I edited last post too late.

I'm thinking there should be searchable communication between this nurse and PF on his phone and hers. As in he told her to text, told her what to say, she let him know when she was in Idaho, etc. He told her to dispose of phone.

I wonder if he directed her to do all this from Idaho, though if that's where she lives...sigh..nothing like calling attention to yourself.

Did she ever question why? Did she know what happened to Kelsey? That he was involved? She must have. imo

Or maybe she and his mom worked together at one time and that's how they met. Or maybe they met at a rodeo! Only time will tell. I do think it has to be someone he has known for awhile or knows very well. Imo
