Question for the Verified Attorneys- In a civil wrongful death lawsuit, is evidence less strict? For example, something that would not be allowed in criminal trial would in civil. Could they also use information that is stated in civil suit as evidence in the criminal case?

Thanks in advance!
Quick answer, the rules of evidence for criminal and civil are the same. Standards of proof are different

Me too. Many think that this was about Kelsey taking K to Idaho or threatening to.. when it may actually be about getting Kelsey out of the way, so Frazee could bring K to Idaho to be with IN.
Except I don’t think he was leaving the ranch, so maybe he wanted KB out of the way so IN could move closer to him. AND he’d have a nurse to help take care of mama that way too. IMO

It seems at this point with her name in MSM and the fact that LE is investigating her, it does make her a POI even if they haven't yet called it that. Seems as fair game as anyone else that goes on MSM news.
I agree, but WS officials need to have the final word and give us the green light.

Can someone explain exactly what goes on in a rodeo? I asked before if it's possible that he worked in one but I have no idea what capacity that would be. All I know about them is what I saw in Brokeback Mountain.

LOL, that deceased me.:D

I could probably answer this somewhat, if no one else can. But for now I'll leave it to someone who knows more than me.

I am roflmbo.
Generally, western horsemanship.
Yes, he prob’ did work them from time to time. I would guess, as a farrier. He may have helped with cattle used in roping or penning events. Maybe even the concession stand. Endless “jobs”. Perhaps he has some affiliation with a large ranch in ID that raises stock for rodeos, representing them at rodeos. He may have hauled stock for rodeos.

We don't know the circumstances surrounding the pregnancy and we don't know if the relationship was unstable at that point. For all we know it was Kelsey who grew tired of PF and was just sticking around for the sake of her child, trying it make it work the best she could. Maybe she just "tolerated" him. Jmo
I’m thinking that theory is more likely IMO

Ok, I don't see the baby mentioned, so going to post it.

Here is the Civil Complaint filed today by Kelsey's parents.

Here are some interesting parts. I do think they tried to keep this all encompassing and general, especially in case charges wind up downgraded, but:

- (Frazee) "acted as either the perpetrator or
accessory to the murder"

-"Upon information and belief, Frazee committed and/or collaborated to commit the
murder of Kelsey Berreth"

-"This matter arises as a result of the death of Kelsey Berreth, who, upon
information and belief, was murdered on or about November 22, 2018, at the direction and/or
hand of Frazee in or about Woodland Park, Teller County, state of Colorado."

-"Upon information and belief, Frazee, by words and/or by conduct, agreed to the
murder and/or coverup of the murder of Kelsey Berreth."

IMO it’s simpler to refer to her as IN indefinitely, regardless if we get the ok to ever mention names.

Since when?

This has been the entire point of keeping the arrest warrant out of the defense and public's hands and LE has stated multiple times the urgency to protect these witnesses or witness. In general other than an act of terrorism, keeping an arrest warrant secret could seriously jeopardize a case. It can happen in cases but should be a rare exception. An educated guess is when we finally get to see the arrest warrant we will understand the solicitation much better. Sad but true. It is unheard of that in a domestic case that is not federal he is just seeing his arrest warrant and we don't know any witnesses and had to figure out the nurse through the grapevine in America. I am not complaining. I am for building the case as long as the case sticks and family is served.

Wow you snooze you loose. I was away for a few hours and all hell broke loose. I see a wrongful death suit has been filed by Kelsey’s parents. What else has happened?

Could the purpose of the wrongful death case be to bring forth information more quickly that could potentially aid in the Barreth's custody case? Does a civil suit progress more quickly through the courts than the criminal trial?

IANAL but I suspect this is designed to add one more roadblock/hurdle that would need to be addressed before the court would want to make a decision on custody. They’re covering all bases. IIRC, the next custody hearing isn’t expected to occur until after the arraignment in mid-February. Even though I wouldn’t expect custody to be reversed, it seems to me this wrongful death suit might just be a safety net. Time is on the B’s side in this regard...

As always, just MOO.

That last paragraph is disturbing.
I wonder what evidence they have, to make such a statement.
This is horrid.
MOO.
What if she had surveillance inside of her home.
Moo

that's about it, other than reporters arguing over confirming sources and the nurse's name and photo being released.

Look up the term Buckle Bunny.
Rodeos have a lot of athletic and skilled competitors. Some Rodeos have some serious money to be earned. Example, a girl I know brings in $250,000+ a year rodeoing (barrel racing), however it’s also an expensive sport. One event might reward $5000 for the fastest steer take down and tie. But a lot of people that rodeo do it like a person plays the lottery, hoping for a big win. Another friend’s ranch hand is a bull rider and spends more time with bruised ribs and stitches during the season and less time actually working, he saves up in the off season for entry fees.
There is a lot of time waiting around between events. Some people visit the beer garden (lots of people enjoy the whole rodeo from this “viewing location”). Competitors and regular folk could meet here. It’s also possible to meet walking around, or at socials after the actual rodeo (aka the bar).

I hope that helps.

I thought the same about a picture. The most recent one released of them was when baby was a baby. Makes me think he was not asked to the photoshoot where we get the beautiful pic of CB, KB, and little KB. (Which based on CB’s comment of last seeing KB in October leads me to think that is when that photo was taken).
I was wondering about that too. Either they don't want to release any pics of him with the family, for obvious reasons, OR maybe he wasn't there. Made some excuse for not being able to be there while KB's mother came for a visit. Was out of town for some "business" with IN or recruiting help to kill her? JMT

I think the filing of a wrongful death suit is very premature and probably a big mistake. What is the purpose? There are potential big traps for KBs parents here and I worry that this is legally not well thought out.

Yes, I understand, I just did not know it was verified that she was in protective custody. I assumed she might be, so that's why I asked. My question was, when was she put in protective custody? I couldn't understand by your answer.
