If the state builds a case, what kind of deal can they offer...death row vs. life without parole? He would still die in prison, imo. He won’t confess. Jmo

I'm never confident about that! I still rue the day Casey Anthony walked out of prison. WORST VIDEO I'VE EVER WATCHED. And that smirk... :| I pray that NEVER happens here.

Yes that’s what I recall too. But it won’t matter. He won’t have that kind of money, and if he’s guilty, he never will unless he did a book deal. I can’t see why he would respond to the lawsuit, unless he’s truly innocent, which I doubt.

Well KK you head North towards home with the phone and I will PF head South and find a good place to ditch my load. That way we can say she left and that's all I know.

In excess could be any amount. With the internet, crime books are not so popular. We follow minute by minute news. There’s little left to put in a book. Moo

If he doesn’t respond, does that effect custody? I ask because I thought custody was one of the reasons speculated to be a reason for the civil trial.

Supposedly it is. I am not sure what the point of the civil case is, to be honest. They almost always come after the criminal case, which will take place who knows when...I don’t even know if the civil case can go first. Or of it can, the state surely is not required to turn over evidence they have not yet used themselves.

I also can’t imagine the Berreths not keeping physical custody. Having is now is a huge point in their favor. Under what circumstances that would change, assuming the murder trial goes forward, is beyond me. I wonder if they simply took the advice of an attorney but in these cases, do they Berreths have to pay the attorney regardless of outcome? Anyone?

A man believed to be PF's father reportedly died in Sept 2018 as cited by the local Woodland Park Underground (re. public probate records). MOO

ETA: referring you to WPU previously approved by Tricia. Not sleuthing family here.

Not all WPU is allowed. It was me who approved the youtube video ONLY by WPU, not everything WPU. The video was approved because it was a presser with the prosecutor and seemed to be spliced in with a clip from ABC's Chris Sandell.

If you can find a post where Tricia approved, please let me know, but I am not aware of it.

There was no MSM, official public document, or obituary provided to indicate that PF's father is deceased. Posts referencing his death have been removed.

Post after post of discussion and thoughtful input by many members who trusted the information to be factual ... all removed because no approved link was provided.

The civil suit states "in excess of $75,000" because that is the jurisdictional minimum for a case to be heard in federal court. The dollar amount has nothing to do with what the case is actually worth or what the family expects/wants to get. The attorney has to list that amount in the Complaint to show the court that jurisdiction is proper. $75K will be listed in pretty much every federal civil complaint.

No new news? Thanks to all who update the media thread. In my state, defendants have 20 days to respond to a civil suit - is it the same in CO?

There would be no reason for Kelsey’s body to hav traveled in a completely opposite direction, all that matters is that she can’t be found. What difference does it make where her body is?

Sorry, but I still feel that the location of her body might have been important to the murderer(s).

They were surely smart enough to know that the cell phone tracking in Idaho would lead to an investigation there — otherwise why bother taking it that far away.

Taking any remains in an entirely different direction would make detection more difficult (or random).

I think they were clueless enough to think that no body equals no case.
