I think a lot of her future consequence will depend upon the details of how she was an accessory. Did she know whose phone it was? Did he hand her the phone and say, don’t ask questions, just drive back toward home and dispose of this along the way? Or did he hide the phone in her belongings and call her when she was already hundreds of miles away and make up some lame story about the phone? Or, did she know all along and did she knowingly compose or at least send the texts?

There’s a lot about her I still need to know before I write KL off for the rest of her life.

She knew. You can’t unknowingly be an accessory.

I'm going to play Devil's Advocate here for a moment because I don't think we have anything saying this didn't happen this way.
Most people her are implying KKL drove 800 miles to get a phone, and drove 800 miles back home. Making it hard to buy that she was afraid of PF. We don't know when KKL got to Colorado. Maybe she showed up, on invitation by PF, while KB was still alive. He invites KKL to visit, and tells her to hang out at his house, or a hotel, or wherever, because he needs to go get his daughter from KB (who he's seemed to tell several people he broke up with, so KKL probably thinks this too). He leaves, and when he returns, with child, he tells KKL he killed KB, and she needs to dispose of this phone (or some evidence). Well now she realizes he really was serious about killing her, and she's in the room with him...and really is afraid. So she agrees to do what he asked.
This seems a lot more plausible, to me, than driving 800 miles to pick up a dead person's phone, or to assist in a murder. If this story holds weight, she should have left with the phone - directly to the police. But, we also don't know she drove to Colorado with the intention of KB dying, and her hiding evidence. She may have gotten caught up in it, after she was already in Colorado.
and...don't forget she will probably say she was in Colorado
visiting family for Thanksgiving, not just PF.

Nurse in missing-mom case of Kelsey Berreth to plead guilty

Krystal Lee, 32, is scheduled to appear in a Colorado courtroom this week to enter a plea deal with prosecutors, according to two of Lee's relatives who spoke anonymously because the deal hasn't been publicly announced. Family members said Lee has been cooperating with investigators, who have been looking into allegations Lee may have disposed of evidence.

It's not yet clear what charge or charges Lee is expected to plead guilty to, or whether she'd face jail time. Attempts to reach Lee's attorney have been unsuccessful.

A spokeswoman for District Attorney Dan May would not confirm or comment on any potential plea, but she did confirm that Lee has a court date set for Friday, Feb. 8, in Teller County.


"This case is under seal," said Lee Richards, a spokeswoman for Colorado's 4th Judicial District Attorney's office.

Patrick Frazee was arrested in December and charged with Berreth's murder and three counts of solicitation to commit murder. He has not entered a plea.
OMG!!! I am quite a few pages behind! This is quite the news! Looking forward to hearing more details on Friday!

Yeah but unless PF held a gun to her head all the way back to Idaho and forced her to do that with the phone, she could have gone straight to LE once she left his presence.

True, but if he had been asking her since September to help him kill somebody, she shouldn't have been meeting up with him at all. JMO

I could see it happening that way, except for that interview the Rs gave to the TV station about KKL's BFF talking to them about the situation and the knowledge beforehand. So, no, I think KKL knew beforehand and drove to CO in spite of her fear. Bless her heart.

Which goes back to what I said previously, PF KNEW KL wouldn't say anything, and would cover for him. KL is completely implicated in this situation. She should have gone to the police months ago...

However, that being said, you are an ex GF, and go to the police, saying your ex BF is planning on killing his current GF...I am pretty sure that your report would go into the round file bin...

We don’t know what the charge is going to be yet, right? It could be a tampering with evidence charge or something else.

I think because we KNOW he wanted her dead so it stings that someone else who seemingly had no real reason to also want her dead knew about it and didn't say anything, even if she really didn't take part in the murder itself.
KKL had no reason (motive) to want KB dead? Yeah, she did - KKL was telling everyone in Idaho that PF is her boyfriend. But I do believe that LE/DA is well aware of all that and have taken her motive into account.

Question: To arrive at a court date for a Guilty plea to something, KKL must have been arrested and charged at some point? I think so.

Question: LE cannot offer plea deals (except LE can lie and can imply such things), only the DA can make plea deals. But the DA is limited to state crimes. Is it possible KKL does or may in the future also face Federal crimes for the multistate part of the case? Like wire, communications, charges?

Question: The media says KKL "is travelling to Teller County" but I am not leaping to the conclusion that it means she is free at home in Idaho. KKL may be in custody anywhere in CO or ID on CO state charges, or in Federal custody on Federal charges.

Question: If KKL had to be arrested and charged with something in order to get to a plea deal, then she is only out of jail if some judge released her on bail or ROR?

I do so hope KKL has been in custody for quite some time and gets some stiff prison time. Phooey on feared for her life. JMO

The description below Frazee’s solicitation charges read, “Between and including September 1, 2018 and November 1, 2018, Patrick Frazee unlawfully and feloniously commanded, induced, entreated, or otherwise attempted to persuade another person to commit murder in the first-degree.”

Reading through all these posts since this morning, I have imagined a scenario where KKL would visit PF to try and win him back, she would borrow his phone send her phone texts about solicitation, knowing he was staying with Kelsey. Did KKL do it on her own in hopes of winning PF back? Did she set it all up? What proof is there other than phone soliciations that PF was involved? would make it really interesting if so. Did she take KB's phone to Idaho and text PF telling him KB was visiting family, wedding prep. If there's no voice you don't know who is sending the message. Just a weird direction my mind went in, because I believe she was behind most of this!

If the deal is for a specific amount of time, the DA will communicate that to the judge, who will order it. Typically there’s some room, if it’s a range and nothing has been set, the DA can recommend a sentence and the judge can enforce it or select a different amount of time. In this case, I suspect they’ve laid out the amount of time she will be serving so it’ll be a matter of custom to enforce it.

If you recall, in the watts case, the deal was for LWOP and CW knew that going into his plea, and that’s what the judge sentenced him to.
Rio- In plea deals are the terms and sentences generally pre-arranged or are the terms that the prosecutor will suggest a lighter sentence to the judge and the judge ultimately decides? If it is an accessory after the fact with a 2-6 year sentence, I am just wondering if the judge can go against prosecutor's suggestion of a 2 year sentence for say 6 years. I hope that makes sense.

Idaho nurse linked to Berreth fiance due in court Friday in Colorado

"(KMVT/KSVT) — A Twin Falls nurse connected to a Colorado man charged with murder, will be in court this week.

A spokesperson for the 4th Judicial District Court confirms Krystal Lee will be in court Friday, in Teller County, Colorado. Lee is scheduled to appear in court at 8:30 a.m.

However, officials would not give any more information, saying the case is sealed.

KMVT was the first to reveal Krystal Lee to the nation, when a local attorney and his wife came forward with information and called the FBI.
Joe and Patty Rockstahl talked with KMVT, and later CBS News, and since that interview, KMVT has learned others have come forward with information for the FBI.

However, one of those contacts won't talk with KMVT, as they have been silenced by the FBI. An Idaho connection to the case first began when Kelsey Berreth's cell phone pinged in Idaho.

Berreth's fiancé, Patrick Frazee, is accused of killing her. According to KMVT’s interview with the Rockstahls, Lee is a friend to Frazee and traveled to his house sometime in November."

IMO KL will be charged and sentenced for a significant amount of time. I believe she provided enough information to prove she was there and involved in the planning, the murder, the cleaning, disposal, and coverup. I believe she told them where to look for evidence at PF and KB homes. I believe that the electronic evidence was far too incriminating to absolve her of a murder charge. IMO the plea deal is to get her the lesser murder charge and to try to “save” what in her mind is her small town reputation. It also avoids exposing her children to details and minimizes their exposure to her crimes.

Just caught the end of a 9news colorado piece announcing a presser at 12:45 in "arapahoe" county; this is the incorrect county, anyone out there have any better info?
