Thanks for helping us with this case.

One thing I found very interesting is it appears that by definition what she did (if she helped dispose of the phone) was nothing short of
"Accessory after the Fact" and so I hope LE has that charge ready if she does not follow through with her committments to testify fully against PF.

The really interesting thing is I found this example for what a penalty would be for "Accessory after the Fact" if the crime was committed against the US and it shows that she could/should get up to 1/2 of the same penalty the original criminal gets. That sounds much more appealing right now. :)

"Except as otherwise expressly provided by any Act of Congress, an accessory after the fact shall be imprisoned not more than one-half the maximum term of imprisonment or (notwithstanding section 3571) fined not more than one-half the maximum fine prescribed for the punishment of the principal, or both"

18 U.S. Code § 3 - Accessory after the fact
But this was not a crime against the United States. This was a crime under Colorado law, so if you’re going to look at punishment guidelines You should look at the Colorado statutes, I would think.

Correct and I understand. It was just an example as I was looking up the definition of what "Accessory after the Fact" was.

I added an ETA to my original post to hopefully not confuse anyone. Thanks.

We know there have been reports that the Waste Management Midway Landfill facility will be searched today. We are here this morning, but a spokesperson for the DA’s office says they don’t know about a search today. So far we haven’t seen anything.

I still think it is very bizarre for the killer(s) to dump KB's remains at the landfill in Fountain, CO. There are billions of other remote places in CO judging from the Google Maps that we all have been looking through.
imo
A young man's body was undiscovered in a cabin chimney for eight years, a mile from KB's condo. Yes.......there are lots of places it could be that are much safer for the criminal than the Waste Management regional refuse system. IMO

Yes there definitely is but LE has a reason that they want to look there and my first thought was KK led them do that because it came so much later in the case.
Whatever the tip was or who it came from LE might not have never looked in the landfill. It is a huge undertaking so it must be something concrete?
But I agree, so many places where she would never be found.

Glad to see KK hauled into court this morning, let the wheels of justice start to turn for KB and her family!

I think PF solicited KK because he felt entirely confident that she or someone she knew in her circle of rodeo friends would commit the act. Mr. Manipulator, didn't want to do the deed himself, he loves himself too much to put his freedom in jeopardy.

I wouldn't be surprised if WE aren't surprised when the actual facts of this case unfold from LE and DA. There very well may be another participant involved with the actual murder and/or disposal of KB's remains and KK may have been the only one to tie that bow together. "For a plot hatched in hell, don’t expect to have angels as witnesses” <assistant district attorney at the trial of John DeLorean in 1984>.

Still disgusted with the entire lot of them, but I have complete confidence that DA May will tell the story and connect the dots beyond any reasonable doubt for the jurors.

Woke-up thinking of the Berreth's this morning. May God's blessings and strength be with them as this first criminal proceeding starts. Amen.

But wasn't KKL solicited 3 times from PF to kill or help kill KB? That has to count for something!

Not if she didn’t accept or agree.

I'll believe the DA gives a sweet, no prison plea deal to KK when I see it but I will continue to criticize him if he does. Back room deals between lawyers in a case that involves premeditated homicide isn't justice for the homicide victim or her family. Why bother with a deal at all? Why not give KK immunity?

You're right, we don't know most of the evidence yet but much of what we do know has come from KK's supporters, not the DA.

JMO

They’re not “back room deals”. Plea negotiations are protected under our federal constitution and through the 14th amendment to the states. They cannot ever be discussed. Period. If KK’s family wants to blab so be it. The DA doesn’t owe the public anything and frankly, I’d be far more concerned if he was talking.

I don’t know about that. What are the chances in Colorado the no one’s going to try to use a chimney in a cabin for eight years?

Landfills are so extremely hard to search. I just watched an interesting documentary about one of the most notorious murder cases in Australia, from back in 1982. A couple of articles of clothing had been dumped in the dumpster and police were Tipped off. They got to the dumpster literally an hour after the waste had been picked up. So they go to the landfill where it has just been dumped. It took them eight solid hours for an entire team of people to locate those articles of clothing.

Now imagine the small remains of a body, which have decomposed, and Have been in a landfill with other waste collecting on top of it for weeks. And that’s if they got the landfill to quarantine that area at the time they arrested PF. Otherwise, they’ve got months of waste to deal with.
