No, you're absolutely correct, in CO, both the DA and the defense team get the same number of peremptory challenges. In non-capital cases, that number is 5. In capital cases, the # is 10.

Which is yet another reason for the DA to go for the death penalty in this case.
He'll get plenty of chances to strike people who strike him as a few fries short of a Happy Meal from the jury without cause.

Yes, I had read that. So does the defense then get 10 too? We need 12 to all agree, they only need 1 to disagree. Not for an acquittal but for a hung jury and mistrial. Do I have that right? A hung jury is generally considered somewhat of a win to the defense/defendant...

Just for the record, he is guilty as well imo, I do not think KK framed him or they both were not part and parcel. Yet to a jury, her motive is easily discernible and she drove long distances to carry that motive out... With PF for all intents and purposes they were getting along, he and KB, bringing meds, offering sweet potato casserole, etc. KK though, while claiming to be afraid of him while calling him the love of her life/first love drove to take out her competition and nearer to the man she was afraid of... What a bunch of psychos.

Yup. There is certainly a motive for her.

But without means and opportunity, it won’t mean much.

And even if somehow they can muddy the waters as to KK’s location, PF still returned to the house after he claimed to have last seen her, and had KK’s phone right next to his, for two days after that.

All while sending texts, and having conversations, with a dead woman.

Unfortunately for PF, fortunately for DA Dan, PF managed to shoot himself in the foot again with regard to this, as he is the one who sent all the texts and built up the narrative that he and KB had ended things, she wanted them to move on w/ their separate lives, "do you even still love me?" fake texts, etc. So he's not going to be able to claim that they were a loving, happy couple at the time of her murder. Because he crafted a really brilliant (!) story around the fact that she took off leaving him and her baby behind, because she didn't want to be with him any more. Pooooooooooor PF.

The justice there was that little clip from the woman in the Dateline interview, that the KK she knew was gone and there was no justifying KK's actions. I'm sure that's a sentiment carried by the majority of the community, a community that used to worship KK like "bigger than Julia Roberts". KK is used to being adored and worshiped, now that's gone. She may not ever be behind bars, but she's made her own prison.

Right? I see only one option: they're going to have to claim that PF missed KB so much after she left that he used both her phone and his to carry out fantasy 2-way conversations with her.

I wish them well with that effort.

Because we all know that PF only engages in fantasy play with his Woody from Toy Story doll.

No doubt. I personally think from what we know so far that is the best evidence they have. Is his phone traveling with KB's. I agree with that.

But by our law, all it takes is reasonable doubt. And we need 12 jurors, they need one to force a retrial. In Teller County.

I am not generally a negative nelly but this case so far has problems.

I also understand that judges are rotated in so throughout this case they will come and rotate in from Colorado Springs. And have to get up to speed on the cases each time and if an election is held, then that changes again possibly. Is that the case?

I have never heard of that before.

Well now that he's been in the pokey for awhile, he may have cleared all the dope and drink from his system and could come off as
a level headed mountain boy who's being railroaded.
Not really, in our minds but his demeanor could be much better than in his past life. I still question if his bad habits (drink and drugs) contributed to his anger
and loss of control. Maybe or maybe not.

If PF was not with RS as he stated in SW Attachment, he could be charged with providing false information to LE. I think PF was likely in truck with RS, and waited in the vehicle when RS was picking up package. MOO

I tend to agree. I wonder if they had to drive by the furniture store’s camera to head towards KB’s home. We know the furniture store camera caught both PF and KB on camera on 11/22 because they handed over a thumb drive with the video captures.

Did you super sleuthers conclude that there's a good chance there is highway camera or other CCT evidence documenting KKL's drive to Colorado and back to Idaho? I remember a lot of discussion about that many threads ago after the info came out about KKL driving her friend's car to clean up "her mess." However, I can't remember the outcome of the discussion. That kind of evidence about the dates of her travel would be indisputable, IMO.

I fully believe there is quite a bit of irrefutable evidence that ties all of statements and actions of both KK and PF together which we'll not be aware of until the trial. WPD/CBI/DA know what they're doing and what it's going to take for a conviction.
Yes, they had to make a deal with the devil, but for the greater good IMO.

I have said it before, PF murdered KB and I believe if not arrested and sent to prison, he would have murdered again in the future. He is a wicked NPD and would have continued to prey un unsuspecting women.

My heart breaks for the Berreth family, but knowing that Baby K is safe with them in a true, honest and loving home makes me feel so grateful. Little KB will grow up to be just as special as her wonderful Mommy.

The how? A bat, it comes from KK via PF allegedly. Not exactly solid proof. But there was blood. Okay but this was missed until KB's family saw it? Did you find a bat or a receipt for one?
The why? Allegedly PF wanted the baby and KB was going to try to take her. Yet just the night before they were together and she was bringing him medicine and then offered to make him a sweet potato pie/casserole. Mm-hmm. Okay.
The when? Well we know it had to be after she talked to her mom. Other than that, no body, etc. No timeline. Yah a tote but the key witness never saw the body in it. Oh, someone says a cadaver dog hit on the hay bale though. Yah, they also hit on KB's car.
The star witness? She had reason of her own and by her own admission ran around with metal rods, bats and coffee and drove ridiculous miles for such attempts. Because she was so afraid of him that she came closer to him at his beck and call. Yet in the same breath she says "he is the love of my life"...

I want him convicted and to rot. I want her to as well, make no mistake about it.

However, just pointing out some of what is very likely to come up. And there is so much more...
This is not anti-LE, it is logic. It is very likely some jurors will do the same. Unless there is much more in the way of some solid evidence.

Let's add where is the body? Well, we first heard it was in a tote. We have no video of that though or of him with any blood on him. Then we heard the tote was burned. But our key witness never saw the body in the tote. Then for some reason we had reason to think it was in a landfill. Then she also said he said he would dump the fire remains in a body of water or the dump.

I mean come on... We find this story so out there and could never imagine such things. And a juror, especially one not knowing of the case if they can find one, would not as well?

I am a full board, convict this monster and get her too but there is much a defense attorney could do here. The way it looks so far anyhow...

I'm confident that there is much more evidence that will come out at trial. I believe this other evidence along with KKL's testimony will be sufficient for conviction of PF. It's important that the DA not allow PF to be tried "in the court of public opinion," which is why the public hasn't seen all the evidence. MOO.

I still want to know why KB's FB was obtained. KK's warrant was not served for FB. PF's bank account had records requested for a few weeks only from 11/21 on. KB's was requested to way back. These two evil creatures were conspiring long before 11/21.

I would speculate the LE was trying to see if anyone (PF) had tried to access it immediately after her death.

There are murder convictions without a body/bodies all the time. It's less than ideal, but if the DA can present a theory based on the facts of the case, it can be done, and is done in courtrooms all across America.

The prosecution doesn't have to prove guilt beyond ANY doubt, but proof beyond a reasonable doubt. This is where they will be working overtime to dot the i's and cross the t's. They know what they're up against and they know how the public feels in regards to deal made with KK. They will be prepared and have evidence we're not aware of to further solidify their theory come court time.
