And way back at the start I wasn't sure w3ho to believe about that---until I saw the 'family' photo, taken at the hospital, by one of those paid photographers. They take that professional photo as the mother is all cleaned up and rested, just before check out. So there was no way she abandoned the baby, the way PF claimed.

Besides, the nurses would have called in CPS social workers if that had happened. Even if the father was there to take the child, there would still follow up on the Mother, in case of drug issues, or postpartum depression/psychosis, etc. Which never happened.

It's worth revisiting and recalling what really DID happen in that hospital delivery room, though:

That was detailed by Berreth's mother Cheryl to detectives and included in a Search Warrant Application that was obtained by DailyMail.com.


'Cheryl shared a story regarding the birth of Kaylee. Kaylee was born three weeks early and required special medical care,' reads the warrant.

'That special medical care prevented Kelsey from having Kaylee in her hospital bed.'

It goes on to explain: 'Patrick was very upset about this because he believed the first few hours of birth needed to be spent with mother and father for bonding purposes.'

'Patrick became so upset and verbally abusive with the nursing staff that Social Services was notified,' Cheryl told investigators.

'Kaylee was removed from the care of Patrick and Kelsey until a safety evaluation could be done to determine if Kelsey was being physically abused by Patrick.'

Cheryl went on to say that Patrick said he should have 'killed' the nurse later, and even joked about the incident at his daughter's first birthday.

Thanks to everyone who gave input on a theoretical "SF did it defense strategy". I didn't want to throw the idea out there before today in case the defense reads here (I'm sure they are too busy tonight preparing for juror questioning and opening statements to suddenly change their strategy). I knew I could count on the many level headed folks here to argue effectively against such a defense. :D:p:cool:

Yes, because it’s probably a win-win.

If she answers, then the jury will be able to gauge if she is being truthful or not. If she “doesn’t remember,” or says anything that doesn’t ring true, it will hurt her son.

If she pleads the Fifth, then that will be incredibly telling. That’ll hurt him too.

She’s already spoken to prosecutors, so they’ll have a good idea how to attack this.

I'm rereading Search Warrant 18-118 Attachment A. In there is that pic of PF standing in the aisle of Walmart. What strikes me odd is the WAY he is standing there.....like he's waiting.....for something to happen. Was he waiting for a sales associate to bring him something? Or, was he waiting for someone else to show up? Was PF seen with someone else on surveillance video that day at Walmart?? What haven't they shown us? Hmmm :cool: I'm not suggesting it's KK, as there's no way on earth she would have gotten that sweetie deal. I'm also not convinced PF disclosed EVERY single detail to KK about that day and he's such a prolific liar, what was to stop him from lying to KK about where Baby K was? Call me crazy too, I can take it! :p

So I want to lock in my prediction for the defense’s opening statement.

They’ll paint KK as a vindictive, jealous love-rival who wanted Kelsey out of the picture. They’ll call her an admitted liar, who has proven that she can’t be trusted.

They’ll say that there’s no evidence that Kelsey was murdered on Thanksgiving, and leave the door open in the jury’s mind that KK could have driven to Colorado and committed the murder on the morning of the 24th.

They’ll say that KK admitted to having Kelsey’s phone, a fact that is also supported by evidence (phone data).

They’ll ignore at this stage:

The fact that everything KK said is supported by evidence.

The fact that the murder almost certainly occurred on the 22nd, when PF returned to Kelsey’s house.

The damning phone data.

A litany of other things.

They better hope that they have a jury that doesn’t care about “evidence,” and “facts,” and lives in fantasyland.

I think he went and planted himself squarely in front of where he knew there was a camera in the store, and stood there vacuously staring around until he was sure it had captured his image, then left.

Mission Accomplished.

Of course, he then returned to KB's townhome, where another surveillance camera captured him re-entering after the last time he said he'd seen her.

Another prediction:

The defense will call very few witnesses, and this trial is over slightly earlier than expected.

With the exception of some of expert witnesses (a phone expert, and maybe a forensics expert in addition to their own investigators), everyone that the defense could potentially call, I want the prosecution to call.

It’s a bad look to call a witness for your side, only to have that witness turn around and score more points for the prosecution than yourself.

Mommy, brother, sister, Clint, etc.

You may be right GK but I'm not convinced there isn't more to it. JMO. I wonder what he bought? Pecans or a black plastic tote with silver handles?

I also predict the defense will mention the fact that it wasn't until LE confronted KK with her lies and their evidence r/t KB's phone pings that she accused PF of having killed KB.

They'll say she's simply blaming him in a desperate attempt to save her own skin.

Hence the “forest for the trees” question on that prospective juror thingamajig.

Prosecution must have put that one in there.

My prediction is that this trial will go long, if anything.

Not on account of the defense at all....I just think there's so much ground to cover, and so much evidence that DA May has to present in this case, I really can't foresee them getting through it all in 3 weeks' time.

And you know that the defense is going to be jumping up and down, yelling, "Objection, Your Honor," after every other question the prosecution asks of a witness, so you have to factor those delays in, too.

I completely agree with you that the defense will go with a "Less is More" strategy as far as putting on their own witnesses.

I think the defense is going to try to score all their points with the jury during their cross of the DA's witnesses, instead.

Steigerwald will try to discredit the prosecution's evidence and witnesses enough to create reasonable doubt in jurors' minds.

Paradoxically, KK is both the prosecution's strength, and its weakness.

That does ring a bell though, but I can’t find anything on the Google.

It honestly just looks to me like the same dumb look that is always on his face.

Probably thinking, "hmm, maybe I should ask her what baby formula to buy before I kill her."
