At this point, I'm convinced that the only reason the National Guard hasn't been brought in is that Judge Sells doesn't actually have the authority to call up the National Guard.

Otherwise, we'd be seeing the National Guard outside the Teller County Courthouse right now.

Possibly with their weapons drawn...you know, in case any reporter reaches for their phone.

JMO.
It may still happen. It’s just taking time to dig through cellars to find the document outlining rules of engagement when National Guard is working w/a Sheriff posse.

There was great concern from the defense about being able to discern betw facts and circumstantial evidence. #patrickfrazee was very interested in each potential juror, especially one who showed concern for him as a father. Trial should take 3 weeks. @ABC @Clayton_Sandell

Wait how is SF in court. Isn't she a witness? Thought she could only be allowed in after she testified?

Wow this is very restrictive. What is the judge trying to achieve here? A fair trial? Won’t the jurors be sequestered?

You make a really good point that its just the jurors that matters here, and if they swore to do their best with an open mind and to avoid any news coverage about the case until the case is over,
then what does it matter if the public got on-the-fly texting from the trial reporters or live video of the trial.

The jurors will still be going home if not sequestered and Im sure some of their family members may have TVs or radios on so its still up to the jurors to abide by the rules of the court. It should have no effect whatsoever on the public being able to see and hear things live.

With this trend in some cases lately, I think we are going to need some kind of law passed to force all trials to be OPEN to the public like they should be.

When trials are done in secret, then shady things can start to happen that nobody knows about. Justice should be wide open with no secrets and the public serves a very important role. The public provides the checks and balances that all sides are doing things the right way. It helps both the prosecution and the defense when things are wide open like they should be.

Thank Goodness I already have one! The green striped suit he's going to be wearing every single day of his life once this trial is over. I don't need any images of him in "normal" clothing, because that monster is NOT normal :eek:

Omg waiting for tweets daily is going to be frustrating .thank goodness it’s Friday It can be wing and wine night for hockey as i look at phone.my heart breaks for the berreths having to sit threw this . I hope they don’t have to let any visitations during this time

Let's get the show on the road. I hope they do recaps on Law & Crime TV. The new smart TV in my office has Law & Crime TV streaming so I was hoping to test it out! Too bad this isn't being streamed live. :rolleyes:

Doing a quick bit of research, but it does not appear they have Marsy's law in Colorado. Perhaps they have something similar? One of our Colorado attorneys @Colorado303 perhaps might know.

With respect, it is open to the public. Anyone can walk right in. The Court is full of reporters who are reporting multiple times a day. Who will write detailed pieces reporting on and explaining what happened during the day. What you want are not public trials but live-streamed trials on television. Many of our Bill of Rights protections stem from the English and early American trend of show trials where defendants were not given fair hearings but rather served as pawns for overzealous attorneys. There is a Constitutional right to a fair trial and some people, quite reasonably, could believe that doesn't mean every nosy nelly at home has a right to watch every second of it.

Especially since the “no live tweet” rule supposedly was created to prevent witnesses from being tainted before testifying.

12 jurors, 4 alternates selected for Kelsey Berreth murder case

Each of the 90 potential jurors who were asked to return to the Teller County Courthouse following individual questioning earlier this week gathered in the Div. 11 courtroom Friday morning for probing by both the prosecution and defense. Fourth Judicial District Attorney Dan May asked multiple jurors whether they could believe a witness if they took a plea bargain.

Adam Stiegerwald, one of Frazee’s public defenders, asked the potential jurors repeatedly if they had seen media coverage of the case, and if that would impact their impartiality.
At this point, all of the information released to the media has come from the prosecution, including the arrest affidavit and multiple search warrants.

“Do you think people who haven’t seen the news would give a fairer trial?” Steigerwald asked the potential jurors.
