We don't know yet if SF has been given immunity right? If not, and she takes the stand and pleads the 5th, what happens to her? What is her incentive to not plead the 5th?
On the other hand, if she has been given immunity, takes the stand and admits prior knowledge and obstruction of justice, (or whatever) she puts the nail in her sons coffin.
What a dilemma!

Apparently he flunked English, too. Evidence, by definition, is something that indicates proof.
He probably never took a technology course, either.
Didn't he only attend college for a year?
He probably got homesick and had to come home.

I think Alathea was responding to my post about CC not being able to "add" up the evidence. PF neither for that matter :)

If the defense calls him, the prosecution would nail PF on cross. They would have CC recount what PF told him, which was nothing but lies.

So I don’t see him being called.

If she hasn’t received immunity, then she will almost certainly plead the Fifth on whatever questions she feels could put her in jeopardy.

My sense is that she’s not in any legal jeopardy as it stands, and the only thing that could change that would be answering certain questions.

The DA probably suspects her of some involvement, but doesn’t have enough to move forward. She won’t help them.

So no immunity, she’ll plead the Fifth. Immunity, then she doesn’t have a choice in the matter.

We should have an answer this week.

I really can't think of anyone.
They have a couple investigators from the public defender’s office on the witness list.

So those two people, and maybe some expert witnesses to refute certain aspects of the prosecution’s case.

SOOOO much to look forward to again this week. I wish it were Tuesday already!! Of particular interest, SF, forensics on the tooth ("the tooth, the whole tooth, and nothing but the tooth!" Man I wish I had coined that), and the CPS employee's interview with the "brainiac", PF. Ho, not to forget the phone call to RS from jail that was recorded and PF knew it. Such a genius! I can't wait for the "plethora" of sarcasm that will lace this thread this coming week. I wish someone would create reverse italics for sarcasm just so no one misunderstands our posts :)

She said so when she got the drugs to the poison coffee. She also admitted to dumping items from the murder at the Hospital. Can't imagine what the liability insurance to cover her as an employee would be,but I doubt it would cheap.

No way will anyone hire KK as a nurse. All a potential employer has to do is google her name along with her last employer and this horrific case will pop up.

iirc, KK did tell LE that the reason PF wanted her to poison KB is because she had access to drugs as a nurse. I don't believe KK drove all the way from Idaho to visit Starbucks but she didn't have the drugs with her. I think she left the drugs with PF, they were given to KB and KK knew it.

Nope. It’s your Constitutional right not to incriminate yourself.

It would be a terrible look for both her and PF though.

Pleading the Fifth would merely be a signal that she likely had some criminal involvement here. If the evidence isn’t there though, there’s nothing that can be done.

Knowing a crime was committed, is different than proving it beyond a reasonable doubt.

Well, if that's the case, all the defence has to do is prove it. Prove that they found Ambien and Valium at the Franchette. OR, they can risk all and put that dummy on the stand. I'd LOVE to see that :)

If pf hadn't involved kk, had done all the dirty work alone, and not told a living soul, looks like he would have gotten away with it.

Even with all that, there's the chance, (however slim) he still might.

Who knows what evil lurks...

For some reason, mr. "No body, no crime, couldn't even figure out that he'd get caught if he "sang like a canary" his own damn self.

The defense can call anyone listed on the DA's initial witness list plus they have said they will call two defense detectives/investigators.

Pleading the 5th in front of the jury will look sooooo bad for PF. It seems like a win win to call her! I would think she would “not recall” much and maybe say fire, etc, was normal on franch. Being combative would also be a bad look for her son I am guessing.

I am surprised she turns up daily since she is not allowed inside - does she get to visit with him on breaks or is this for show so the defense can confirm with her on the stand that she has been there daily for sympathy?

Sounds awfully weak to me....from what I have heard their crosses so far have been less than earth shattering. What an uphill climb with a big monstrously heavy wheel that defense has! MOO

But didn't I read you have to have a legitimate excuse to plead the fifth. And if the judge doesn't think it will incriminate you, he can order you to answer.

Agreed hiring her will be difficult. However, didn't she tell PF that she carried these drugs with her.
Not that she had access as a nurse.

"Kenney said Frazee suggested that she drug Berreth’s favorite coffee drink, a caramel macchiato, and give it to Berreth. She also told police that she carried the drugs that she could use to poison the coffee."
