I know that this will not be a popular opinion here, but, I really do think the judge has overstepped the mark.

In his own words, this is not a trial and if the tweets are quoting the judge accurately, BM has been found guilty by the judge. I'm afraid, I do not call that justice, nor do I call it due process.
I respectfully disagree. The findings are all specified by the judge to be under the applicable standard for probable cause. The judge anticipates a Rule 50 appeal of his decision and is leaving as little room for misrepresentation of his opinion as possible.

I suspect that the defense anticipates a decision denying bail, and sees an opportunity to argue that BM should be eligible for bond because Colorado abolished the death penalty - therefore there are no longer "capital offenses" under the state constitution and all defendants are eligible for bail. This would be the first case to offer an opportunity for the Supreme Court to provide guidance on that issue, and they may well want to take it up.

I believe the presence of distinguished appellate specialist Sean Connelly at this early stage can only mean that BM has committed all his resources in a "balls to the wall" effort to get out of jail early and stay out, and that he will appeal the judge's probable cause determination as well.

How much money do we think BM actually has? Is there anyway that he has access to Suzanne's could be inheritance forthcoming from her father's estate?

Ya’ll, I honestly don’t think BM is a flight risk. He strongly believes in his defense team. He will be a squared away citizen on bail while he waits for his trial. This is wild IMO

I disagree. The judge did not convict BM today. The judge has found that based on information presented to the court that it's reasonable to believe that SM was the victim of a homicide and that BM may be responsible. The judge will not decide on his guilt -- that will be left to a jury after a full trial of evidence and testimony.
And remember the case is not strong right now. If it goes to trial and he is found not guilty it is for all practical purposes over. I was kinda hoping it might get dismissed or refiled at something that would have a higher jury probability. But trial there will be next year sounds like.

But BM has no home in CO. So if he can meet bail, he's going to live where?

maybe his mommy will move there for now and set him up his own bedroom.

Barry is not only not going to run. He, with his daughters and attorneys, will do the circuit of appearances pushing that he's innocent and the real killer is still out there.

So. you think he will have free run of Colorado?

If he does try this PR campaign, I think it will truly and seriously backfire. Judge will like issue a gag order and then sanction them if they continue.

Yah, this makes no sense. I'd say PF met the not a flight risk category (mommy, "ranch", etc).

I'd say about the exact opposite for BM.

On the question of bail, the judge says the prosecution did not meet the standard of evidence greater than that needed for probable cause, which is what would be required to deny bail.

The judge has been playing with our emotions,he has led us to believe he was convinced Barry was guilty so we all relaxed and then said he was giving Barry bond.

He was "renting." He was trading his landscaping services for a place to live. That deal ended. He had his stuff in a moving van.

He owns no property in CO and rents no property in CO. I presume, though, that his daughters do - and have offered him a place to stay. I hope he can keep it together while staying with them, I truly do. Perhaps it'll be just one of them (I predict it will be MM1).

does either MM have access? Will BM ask (demand, whatever) that they help? It’s not below him. Guilt them into things.

The judge does not believe the state proved enough evidence for first-degree murder so there will be a bond set. We are on a little break now. The family was all in tears hugging one another. #BarryMorphew

I’m so confused. Why is he going to trial if not enough evidence for first-degree murder?
