So I'm in the Plunder Court transcripts and I am floored. IE seriously suggested that MM2 was searching for "cute girls in Salida" and looking for naked pictures of women on Barry's phone. Go back and read that sentence again before going forward.

MS. EYTAN: Mr. Lindsey is going to show or talk about some alleged screenshots from Mr. Morphew's phone in January of 2020 where it looks like looking for a woman, naked pictures, and that kind of thing, in the period of a day.
There's no foundation that these are -- that they are actually Mr. Morphew searching -- the phones between MM2 and Mr. Morphew are very intertwined and it's unknown how -- that's one issue is foundation.
I can not with this woman (IE).
Textbook IE. It’s a good move for Barry. If the prosecution is unable to show that Barry-and Barry alone-used that phone, testimony regarding the web searches will never see a courtroom. I assume a battle on this point since MM2 is on the record stating that she never looked at/used Barry’s phone. This particular piece of his phone usage doesn’t bother me if it isn’t part of the case. As long as the phone is tied to him only for other important data points, all good.

And again...in my opinion whether or not he was looking for an affair or a one night stand it is not relevant to the case. LE couldn't find any evidence he did and even if they did it's not relevant in my opinion to the charge of Murder 1. It's just one more additional point that shows the marriage was on the rocks. I just can't see prosecution going down rabbit holes or this and that related to their marriage when it is so easy to establish that divorce was in the air and actively being discussed by Suzanne which is what preceded the events of May 9 and 10.

It is relevant if it puts into dispute the image of a loving , good living ,loyal family man which BM has cultivated ,whilst trying to make out Suzanne was the unfaithful one in their marriage.

I think it would be less relevant if he'd been honest about the state of tue marriage.

Saying it was perfect and there were no problems or whatever his exact words were, I believe tells us that he is a liar. Moreover, I also believe it is suspicious behaviour. Why lie if you have done nothing wrong?

IMO it drew attention to him in the exact opposite way than he wanted.

Yes and a good Christian man who places himself above everyone else morally. Yes it matters.

To people examining Barry's character perhaps, but much of the information about his character will most likely not come into trial because it will be disallowed.

That is interesting. Why do you think evidence about his character will be disallowed ?Do you think evidence showing Suzanne's character in a negative light will also be disallowed?

They say in the video that LE learned of the spy pen 10 days in to the investigation. I think they learned about it talking to Sheila on May 11th, according to the AA? Definitely worth watching I think. And, I like their timing, given the hearing on Monday.

What it does show is more of Barry's lies.

He said the marriage was great, they were not on the rocks (my wording), he never cheated and you won't find any evidence of it.

Detective: So you never searched "cute girls in Salida"

Barry: No, I wouldn't do that.

Lies! Why would he lie about that knowing they have his phone record? He thought he deleted that stuff.. had no idea they could find it and they did and it was another lie he told.

A husband desperate to find his wife, would say, yes I searched for that, we were having a hard time earlier this year.... something anything to clear himself so they would move on and find the person responsible. But, he didn't, and he knew he is the person responsible so the only thing he can do is lie and say it wasn't him that searched that or this other best response, "I don't recall"...

The way I remember it, the spy pen was found in June and LE played the recording of JL conversation for SO and HW to see if they could identify JL by his voice. jmo

I don't think that's true. Barry is literally the guy on trial. His character matters. His history of lying matters. A great many pieces of evidence that Barry is a liar have already been entered into evidence. Several of the witnesses for the prosecution are only there because they are character witnesses that Barry has a history of violence and lies.

The defense has done an incredible job of keeping the bad stuff from making headlines because most people won't read the AA and take their information only from the headlines. Hem and haw and go back, OMG the amount of "I want to go back" IE does, it reads like incompetence, but we know that's not the case. Delay, delay, delay. Delay the flow of information. It was a great strategy for the PH, but that will not fly at trial.

Sheila told detectives about the spy pen during her interview on May 11. The recordings are summarized in section 4 of the AA.. (above). That is on page 30 and it notes that the pen was found on May 20th. :)

Yeah, but they didn't find it until the search on May 20. It was plugged in(?) on the 23rd.

I wondered why Ashley Franco had gone quieter than usual with Barry's appearances last week.

Kinda wrecks the defenses change of venue arguments, now every district will be equally informed.

I think I spotted an actual police photo from the master bedroom, We're gonna be screencapping all week.

"I don't recall," was a response #BarryMorphew told investigators more than 95 times. Questions FBI had asked Barry after an audit of the investigation.

Can't wait! I'm thrilled that Ashley Franco is a correspondent for this; they also used her for the Berreth case.

I imagine that Dateline can't be too far behind with their own episode.
Yes! Dateline was in Salida for Andy’s search and also when BM was arrested.

Don’t forget Carol McKinley was tagging and hash tagging ABC20/20 in her tweets from the Prelim.

Does anyone know who the guy with the grey hair is in that promo? He has a radio voice.

ETA: It's Danny “Dan R” Ridenour, the radio host who did that interview with Suzanne's sister, Melinda.
