Hope you're doing ok, too. I'm doing okay. I moved back to my home state of CT in September. My husband and I were living in SC, but then he passed away so I decided to move where I have family. I so wish I could be in SC now to attend the Murdaugh trial. I can still go I guess.

I'm hoping Suzanne is found and Barry is brought to trial and spends the rest of his life in prison. Seems fitting.
I am not sure where you are in CT, but its such a small state that hopefully you will soon be able to go to the Michelle Troconis and Kent Mawinney trials. There are still a lot of shenanigans happening with her lawyer Schoenberg etc but I have faith the trials are coming. If I business is not busy I am hoping to get down there myself. Enjoy CT it is also my home state.

Agree with you all. Such injustice for Suzanne should not stand. I always wish there was something tangible we could all do - but I come up empty handed. Esp when she has no close relatives/friends out there publicly advocating for her that I know of. I have felt all along that she was failed by many while alive and the same failure continues after death. I know that she was religious so perhaps most in her circle feel it is in God's hands. I am not sure. I am always of the opinion that God needs as much "help" as possible. I do wonder what Jonny Grusing is up to ? JMO

Is anyone actively searching for Suzanne? IMO she was failed by two judges, and an overzealous defense attorney and that's putting it mildly. I still think there will be justice for her, though.

So hopefully he is still involved in justice for Suzanne ? - I will keep my fingers crossed -

Crossing my fingers, toes, limbs and eyes that Barry is brought to trial. Not everything stays secret forever, and am sure Barry has plenty that can be unburied. One of which, I believe, is Suzanne.

@jakat @Lyanna I read your posts, glad you touched base here.
It is strange. After all the time invested in the thread you do feel like you knew her personally, an old friend. I imagine Sheila and Suzanne's siblings and others will never get over their sudden loss. I check this thread daily, probably always will. Would love to see justice for her, I hope it's not considered a cold case.

Agree, does feel like you know her after spending so much time reading and learning about her. Kinda miss the thread and everyone whose posted on it

Check in regularly, always look for updates on Suzanne, updates on Barry and check NAMUS - always with hope that she's been found and then left feeling sad for her friends and family who still have no answers

I believe Suzanne will get Justice one day x

Is it really? I live in Brookfield. I lived here for 39 years, before then Redding. I'll try to make it to both trials if they ever happen!

I'm thinking I want to go to the Murdaugh trial before it's over. My husband and I lived in Summerville, SC which is a hop, skip and jump from the courthouse in Walterboro. I have a few good friends there, one who watches that trial every day.

The weather in CT has been great. I don't remember it being this mild, ever.

Every time that I receive a breaking news alert from WS, I am hopeful that it will be either news that SM’s remains have been located or that BM is being bought to trial.

What did Cahill and IE talk about on the phone the night before his testimony in the PH?

IMO IE introduced the soddi defense to Cahill in the form of partial single DNA marker found in SM glove box. A partial DNA profile non match. Judge Murphy gullibly fell for it. Bail, recused himself, change of venue.

Colorado's statute governing discovery has a clear deadline that was not violated. I disagree that missing discovery dates at months before trial, pursued by the defense and agreed to by the prosecutor, would ever affect a verdict.

The sanctions imposed by Lama in fact terminated the case.

At the entry of the not guilty plea, the court shall set a deadline for such disclosure. In no case shall such disclosure be less than 35 days before trial for a felony trial, or 7 days before trial for a non-felony trial, except for good cause shown.

So, in this case these were court imposed deadlines. If the judge’s rulings were wrong, which I do think is true, shouldn’t LS have appealed?
And why didn’t she, and instead drop the case?

Can't see the petition.

I suppose BM will eventually work on declaring SM deceased. Maybe he has a huge life insurance policy on SM and to be safe, Iris helped him change the beneficiaries to the daughters.

We know BM alluded to having a big payout for himself when he would threaten SM that she and the girls would be fine (when he killed himself).

I think @CGray123 provided a good response to this question in the link below.


Personally, I think the appellate route would have been a waste of time where the conclusion would be the district court essentially dismissed the case (a drastic remedy) by imposing discretionary sanctions that were more restrictive than favored by the courts, and return the case to the lower court for resolution since the appellate does not like to render decisions about another court's use of discretion. Here, I think LS made the right decision to preserve the opportunity to seek justice for SM. MOO

From Rule 16(d). Crim. P. Rule 16(e), (f).

Law on Violations/Sanctions for Discovery Violations


If at any time during the course of the proceedings it is brought to the attention of the court that a party has failed to comply with this rule or with an order issued pursuant to this rule the court may:

Order such party to permit the discovery or inspection of materials not previously disclosed;

Grant a continuance;

Prohibit the party from introducing in evidence the material not disclosed;

or

Enter such other order as it deems just under the circumstances.

The least restrictive sanction is favored by the courts. “Similarly, in serving the purpose of deterrence, we have stated that ‘the court should impose the least severe sanction that will ensure that there is full compliance with the court’s discovery orders.'”

Dismissal is considered a drastic remedy. “In fashioning a sanction to achieve the goal of eliminating the due process violation, a court must strive to restore as nearly as possible the level playing field that existed before the discovery violation. Only when that goal cannot be achieved is dismissal required as a remedy for the violation of due process.”
