But extreme in my view. No trial yet, so we can't assume anything.

Adultery punishable by death is you speaking unless you have a source. And quoting the Old Testament is not a source.

No trial yet.

JMO, YMMV

Not me speaking. The bible ( a book that Barry was reading in some of the photos he gave to the press) is a source. IMO BM thinks he was doing God's work.

I agree with you on this one. The affidavit alluded to it.

During one conversation in January, authorities told Barry that his wife had been involved in an affair for nearly 2 years before she disappeared. In response, Barry allegedly told investigators that "maybe in God's eyes this was his way of resolving something."

"I've had a very hard time understanding why God did this," he continued, according to the affidavit. "But if I would have known this from the beginning, I wouldn't had to suffer for nine months, not knowing why God did what he did. I'm not saying he did it to punish Suzanne because of her affair, but it makes more sense than what I knew before you guys came today."

Yes - IIRC he was one of Barry's "flock" - Barry liked to mentor the wayward we were told I believe by one of his sister's in an interview - Barry would offer them jobs and counsel and talk to them maybe about Jesus. Maybe this Cody has some interesting info he can bargain with ? In my opinion only
Was he the paternal friend for young men? Sounds preposterous to me. I would have been more suspicious than his sister. But that's me.

Naw. He just used people. People with addictions and who are struggling are easy to take advantage of. Pay below living wages under the table, then blame a faulty job on bad help. Also easy to persuade to go sit in a hotel room on mother's day, during covid,in a different city, for a job that doesn't exist to create an alibi.

  • #465
Then maybe hold off on watching.
Charges can be refiled.

This case is not closed until there is Justice for Suzanne!
Too late, I already watched it, lol.
And as a Christian, observing BM's lifestyle over the last few years, I can 100% say I don't believe a word of what his poor sister says. I think she believed it, at the time, but I certainly don't.

This is the classic case of a fraud, using religion to justify his every move, thought, statement, etc. It's infuriating to see, but it's pretty common. Sadly.

Precisely why I was so shocked that Grusing, the CBI, and CCSO went to BM residence to pray and BBQ two months after SM was murdered. Weird strategy. I've never heard of any other cases where a suspect of murder was treated so friendly and frivolously. For example, in the AA it said BM dropped of the possible tranq gun (a .22 caliber) to Grusing on the side of the road through the vehicle windows , then BM went to the gym. Really.... I thought they served multiple search warrants on his property. Who orchestrated this impromptu pick up of this gun? When Grusing, the Cbi, and ccso interacted with bm was it recorded? Was the whole interaction recorded? Was he ever interrogated at a precinct or just "interviewed" in random locations at his discretion? Does Spezzee still have an interest in this case? Why not do a press conference and announce the investigation is ongoing?

Travesty of justice.
Why was JL, Suzanne''s boyfriend, such a big part of the PH? He was investigated, had a legitimate alibi, and lived in another state. The biggest "bombshell" in the PH, was her affair. Character assassination with religious undertones. Like BM said during the prayers and bbq with Grusing, CBI, and CCSO "it's in God's hands".
Great point @MountainDad

Following the Alex Murdaugh trial and something interesting happened today which reminded me of the discovery sanctions in this case.

Today, in the Murdaguh trial, the defense called two handsomely paid expert witnesses-- a pathologist and a forensic expert before resting their case.

The interesting part was neither of the experts produced reports. At one point, the defense attorney attempted to admit a diagram out of a textbook as an Exhibit (an Exhibit which should have been produced by the expert witness), but after referencing SC regulations, quickly withdrew his request. (i.e., most likely copyright violation)!

IMO, the Murdaugh defense intentionally did not request reports from their experts to avoid reciprocal discovery. In the Morphew case, one of the sanctions was over a single revised page from an experts report provided a day late, and if I recall correctly, it was something very benign like an address change but Lama was already on record stating not having the experts complete report would be the equivalent of trial by ambush.

I couldn't help but think after all heck E & N put the prosecution through with the sanctions over the state's experts and their reports, I could see Iris doing the very same here with her own witnesses -- paying them big dollars but not requesting any report so she would have nothing to share with the prosecution before the defense resting. MOO

^ Mea culpa: Bolded for focus and context ^
Again, just a humble, albeit considered, opinion:

No judge worth their salt should countenance trial by ambush... by any "side", @ any time, in any fashion.

Never mind chaff like (1) docket/calendar congestion; (2) sick family/domestic fauna; (3) ..."my dog ate the expert reports, but I must insist we proceed, substituting defense counsel's good faith averments in lieu thereof. Oh... why your honor? uhh...because...aah... justice delayed is justice denied??; (4) participants' personal discomfort sitting; (5) etc.,etc., ad nauseam.
Absent pre-trial restraints on liberty, it's all codswallop. The system has recesses, continuances, motions in limine, contempt proceedings et al. just for such - imo sanction-qualifying - shenanigans.

* * *
"As your concerns, at too long last, are now of record, counsel shall resume her seat.

And frankly, my dear, I don't give a damn how much it may hurt."

Wouldn't it wonderful if Suzanne could receive the same justice Maggie & Paul did in the Murdaugh case? I want a Judge just like Newsome!!

After almost two decades, the 11th Judicial District deputy district attorney’s office will have to pull up stakes from its offices at the county building at 104 Crestone Ave.

Where the office will move to is up in the air.

A letter sent to District Attorney Linda Stanley at the end of December outlined the county’s need for the office space on the first floor of the county building, across the parking lot from the Chaffee County Courts building.

[…]

The letter from Chaffee County Attorney Daniel Tom stated, “To meet the needs of providing services to the public and internal growth pressure, the County needs to expand the Administrative offices at 104 Crestone.”
[…]

Therefore the 11th Judicial District Attorney’s Office is hereby notified that your tenancy of the premises (including storage within the building) is terminated as of Feb. 28, 2023,” the letter stated.

The letter further states that if the DA’s office needed more time to surrender and deliver the premises back to the county, they could contact then County Administrator Bob Christiansen.
[…]
Deputy Director of Administration Beth Helmke said the county did not hear from the DA’s office until it received a letter from Stanley dated Feb. 27.

In the letter, Stanley said her office had researched the issue “extensively” and had found that other district attorney offices in the state had had the same dilemma.

“Fortunately the law clearly sides with the District Attorney,” she stated.
[…]
The deputy district attorney’s office on Wednesday received an eviction notice signed by Tom, on behalf of the Board of County Commissioners as landlords.

Helmke said she could not comment further on the issue as there may be potential litigation involved.

In the meantime, the occupants of the 104 Crestone office space, which includes three deputy district attorneys, two administrative assistants and two victims’ advocates, are in the process of packing up their personal items per the three-day eviction order.

As of Thursday they did not know where their office and equipment might be moving.

I know a guy with a trailer, who could help them move. Word is he does a bang up job loading it too.

Well, unless they'd rather just Barry their old office furniture. I know a guy who could help them with that too.

Geez, a homeless DA. Too bad they couldn't have snapped up that property on Puma Path. Breathe down his neck a little.

Cozy.

I've long wondered if BM hauled that trailer exactly like that from Indiana to Colorado -- piled high with cardboard siding or if it was a covered load with something like a tarp. It sure resembles his garage-- gun safe and all!

And of course my favorite, using religion to manipulate/dictate his wife's every move, thought, statement, etc.
The antithesis of serving.

Now isn't this typical of BM, the smartest guy in the room!

As cited above, BM previously petitioned the court to terminate SM's guardianship for reasons cited in his petition (no public view), and an Order to terminate was granted by the Court on 2/14/23.

But two weeks later, and this time with two different attorneys representing each BM, petitioner, and BM, guardian, notices of appearance were filed on 3/7/23 together with his motion requesting the Court reopen the GUA for the Limited Purpose of Acceptance of Settlement Agreement and Mutual Release.

The Court has not ruled on the Motion as of this post.

A settlement agreement, also called a release, is a binding contract that settles a lawsuit or potential lawsuit between two or more parties and stipulates that no lawsuit can be filed in the future. The courts encourage parties to resolve their dispute through a settlement agreement rather than through the courts.

IMO, either BM initiated a potential lawsuit against a party or a party initiated a claim against BM and SM.

I'd say it was the latter, and most likely why BM quickly took steps for what appears to have been the premature termination of the GUA-- without the advice of counsel, and now BM finds himself begging the Court for relief to enable the acceptance of the settlement agreement. JMO
