It’s not a toughie, IMO.
In my opinion, shooting chipmunks is only normal for teenage boys trying out hunting with their .22's.

Chipmunks are actually danged cute little rodents! For a grown man to run around shooting chipmunks means the shooter is a cruel man who enjoys killing things, IMO.

But that would not resolve all the obstacles created by BM's lawsuit: grand juries - though legally independent - are widely believed to act in accordance with the wishes of the prosecutor. LS's decision to file new charges would be described by BM as retaliation for the civil rights charge - a new civil claim and another lawsuit, seeking to enjoin the new prosecution. All of her less-than-glorious history (and her staff's) in the past proceeding would be defense evidence in the new criminal case. This includes civil deposition testimony and any information contained in the ARC file. And, of course, any disciplinary action that might be taken against any of them by the Commission.

For all kinds of reasons, LS and her office need to be severed - completely - from any decision to prosecute BM for the murder of his wife. If the Sheriff's ongoing investigation produces new evidence before the end of the civil suit, it would be best to persuade LS to ask the Colorado AG or the US Department of Justice to evaluate, make prosecutorial decisions. They're Ds of course, not Rs so politics may be a factor in her decision. That is to say, the civil lawsuit's downstream consequences make a successful prosecution of BM for murder much less likely for the foreseeable future.

The strategic value of the new civil case may be more important than the money, for BM.

Especially in a rural area. It really makes no sense to me.

Can the state come back at them for malingering in a current and ongoing investigation??

Seems pretty premature action.
At this point, it's simply a civil allegation in federal court and there's always the possibility that the court will reject the claim.

I'm recalling another $40M cash grab against a state agency and employees where the Judge stated it lacked a factual basis to prove their allegations against the defendants and dismissed the suit.

Silence on all fronts with local, county, state & federal investigators all looking for Suzanne. imo

So. I just read BM and lawyer Eytan, filed $15 M lawsuit.
It has worked out well for Barry. Killed his wife, made her disappear. Now filing suit for millions and I suppose to go on that long awaited island vacation.

Barry, never fear, it will all catch up to you. Karma is coming.

Right.

I Wonder if this complaint disclosed a real cause of action given the existence of the prelim where virtually all these issues were judicially reviewed or failing that in hearings pre trial.

We are not talking about a case where it came to light later that a confession was coerced or the prosecution planted evidence or something like that.

Nor is it a case where the defendant has been proven innocent by the emergence of new evidence.

Watching Jonny Grusing getting all the credit in the world in the Stauch case right now, from DA Michael Allen. Just wish we had the opportunity to see the same thing here, as this was 10 times more important in regards to the case.

Seems there's a woman in Utah that's as callous as BM. She was arrested on Monday for the March 2022 murder of her husband. Waiting more than a year for her arrest must have been torture for the victim's family.

Thing about trials is both sides get to call witnesses

Our good friend IE makes some wild allegations about Grusings conduct, so I expect we can see him take the stand right quick for the defence.

Yes -- and according to the defense, Grusing's behavior was so egregious that there's not even a law on the books to account for his actions!

Jonny Grusing helped bury Patrick Frazee (baseball bat fiancé killer. Buried Mark Redwine (son killer). Buried Harold Henthorn (double wife killer). Buried Letecia Stauch (stepson killer). He knows his killers, and knows what he is doing.

It’s almost as if he’s one of the greatest FBI agents in Colorado history.

His best work, by far, was Barry Morphew. Some killers get away with murder, as Barry seems likely to pull off, but to attempt to impeach Grusing, is insane beyond belief.

This man is smarter than all of us combined. He knows the law, and knows exactly what he’s doing. He’s brilliant.
