I think IE presumes he will be charged again. And she strikes me as the type of defense lawyer that will leave no stone unturned so her advice to not to take possession of the remains made sense to me. Now whether the coroner can legally "offer" the remains to someone else in Colorado I don't know. There may be a familial "chain" i.e., the spouse, then their children, then the parents if alive etc. etc. IE hasn't filed an injunction that we know of so I assume the "state" still has possession.
