By relaunching her inane $15M flawsuit, can IE cripple prosecution? Hogtie the State, all its key experts entangled in her suit?

Strategic?

Set them so that if there is an arrest, the defense can suggest all these experts are personally biased and therefore their testimony untrustworthy? Is it ploy/threat to prevent the State from moving forward as long as it's a pending case/appeal?

It smells.

Totally agree about Grusing, if he ever had to interrogate me I'd be singing like the proverbial canary. He is one smooth operator IMO.

No doubt, BM is on borrowed time IMO.
Speaking of Grusing:

LITTLETON, Colo — At Saucy’s Pizza in Littleton, a steady stream of customers filled the restaurant Tuesday morning—not for an ordinary slice, but to show support for Golden Police Officer Bethany Grusing.

On Nov. 6, Grusing was struck by a suspected drunk driver on Highway 58 in Golden when investigating a crash. Grusing was critically injured from the crash, but the accident claimed the life of fellow officer, Evan Dunn. He has remained on the community's mind with much of the focus centering on honoring Dunn’s memory.

Golden Police Chief Joe Harvey explained that Grusing had served as Dunn’s field training officer, a role that inherently comes with great responsibility.
“I know that Bethany is carrying some of that guilt with her,” Harvey said, reflecting on a long conversation he said he had earlier that day. “When you’re the one who survives a tragedy like this, there are questions: ‘Why?’ It’s tough. It really is.”

Grusing was released from the hospital a day after the crash but faces a long road to recovery.
“She’s not back to work yet and probably won’t be for a while,” Harvey said. “The hard part is getting over the emotional trauma.”

I’d be singing, too! Every now and then he’s on a True Crime show and I can spot his voice even if I’m in another room.

Isn’t it possible the State has new experts?

Is IE proud of her reputation for getting murderers acquitted? She has done it before.

How is she related to Agent Grusing?
What a sad story. Thanks for posting.

The U.S. Appellate (or State Appellate) is no place for a "do-over" just because you don't like the Court's legal decision.

To be clear, the $15M federal suit by team BM was an untried case where the US District Court Judge dismissed the claim as a matter of law. In other words, there was no legal basis for the lawsuit because authorities clearly had probable cause to arrest BM, and prosecuting him wasn't unlawful.

Here, it's exactly what BM's defense team filed -- an invalid appeal claiming they want a "do-over" essentially because they don't like the federal and/or state laws currently on the books!

For the cost of filing fees, maybe they thought it cheap insurance to buy BM a few more weeks of freedom through another holiday season....

IMO, the only benefit (for the defendants) of filing the appeal would be a decision which results in the lawsuit being dismissed for a second time WITH prejudice (i.e., suit time barred based on 2 year statute of limitations), putting this charade to an end.

"For all its infuriating flaws then, the prosecution of plaintiff was not unlawful," wrote U.S. District Judge Daniel Domenico in a 33-page order. "His Section 1983 claims for malicious prosecution, fabrication of evidence, Franks violations, conspiracy, failure to intervene, and Monell liability must be dismissed on the basis of the existence of probable cause."

I believe she did but she also had made the decision to leave and she was feeling strong, and could stand up to him. Yep, he was very insecure and wanted the money too.
And he was also pretending to be an adult and speak to her about divorce instead of shutting her down with his "It Ain't Gonna Happen" so no discussion. He knew she was ready to stand her ground and he was out of moves. He lulled her into complacency with his more gracious behavior and she was thinking he had finally come around and maybe the divorce could be civil between them after all.
But it was just Barry manipulating her - so she would be easier to victimize. He really wanted to see that look of terror on her face when she knew what was happening and she was definitley never leaving him alive.
Barry loves the hunt, is a stone cold person and killer and is nothing if not cunning. jmo

I like to check in on Barry from time to time. It's going to be so sad when all that wide open space is traded for a tiny prison cell.

J.H.C. Is that Moffat?

(I know, I know, mountains and sagebrush everywhere, he's probably in AZ... but he may as well be standing on her grave with wide-brimmed smile on his smug face. Keeping it real, here's a thirty-second news bite, with LE searching for every bit of Cowboy's wife. Strange juxtaposition to see a Bobcat out there.)

Meanwhile, Suzanne sits on a shelf in paper bags.

That picture is like the ultimate gut punch. Infuriating, sickening and almost taunting.

Boy gets around.

As @MassGuy pointed out, he best savor the wide, open spaces while he still can.

They are waiting too long to charge him. They know he injected BAM into her body.
It’s a mockery of justice to wait so long.

The mockery, I daresay, is a $15M flawsuit and a garish appeal, legal maneuvering that might be complicating an arrest due to hurricane-made conflicts with experts at trial.

IMO IE is buying BM time. With Suzanne's money.

And that, that is repugnant.

Hear hear Megnut. IMO there is no need to rush. Let BM wonder and worry til that day comes. It didn’t help that the former DA had a questionable start either. And the FBI analyst questions arose. And the $15M attempt. Any attempts to rush could preclude a successful investigation, trial, and conviction. Plenty of time. Plenty. And said it a thousands times, and heard it many more from my late father, a structural civil engineer who worked at NASA: “There is never time to do the job right, there’s always time to do it over.” The prosecution doesn’t have that luxury. They only get one bite at the apple, and they almost botched it the first time IMO. MOO

That is so horrible! I feel so bad for all of the Grusings and everyone else involved. Another example of bad things happening to good people.

I agree but if the prosecutor has an airtight case she ought to go for it. Unless she fears IE’s tactics. If that’s so, BM may never be charged.

Pic of BM in Wyoming.

@303gmf nThanks for your post. :)
Agreeing, pic seems to be a classic shot in Teton Range; see other pix below,* imo taken from same place & angle. BM's hat is directly below highest peak, the Grand Teton, 13,775 ft. or 4,198 m.

Is pic (relatively) current, or is Big Hat-No Cattle BM photoshopped in?

Initially thought about BM being stymied there in Teton Nat'l Pk from pursuing four legged prey but he may not be.**

What-ev, Barry, enjoy the great outdoors while you can.
