He does look like he has been day drinking a lot lately. In fact, he looks like he is drinking and then giving himself his own haircuts.

It's often overlooked in these domestic cases that the perp is not a professional killer.

Graduating from low end grifter and liar to killer .... that's something you can't prepare for

IMO 5 years was too harsh even if apples to oranges.
Black lady on supervised release and a white guy (the one in Pennsylvania,) voting for his dead mother as well as himself.
What's race got to do with it? Different states. Different sentences?

Obviously I understand that a defence lawyer may successfully get their client off on a technicality, but defending the voter fraud on the basis that he "made a mistake" when he murdered his wife with his own hand ... that takes some brass neck

Colorado does provide for a "pretrial diversion agreement" a/k/a "deferred prosecution agreement" under Colorado Revised Statutes § 18-1.3-101. It's a much better deal than BM received: there is no public court record, no plea of guilty, no supervised probation, and none of the consequences that can flow from that - including possible sentencing without trial on the original charge, and restrictions on gun ownership and use. If you comply with the terms of the diversion contract, the DA must drop the charge. It's the next best outcome to a DA decision not to prosecute at all.

I am virtually certain the IE asked for a diversion agreement - why would she not? But the DA may have decided BM was not eligible under the state and/or local criteria. Here's what the statute says.

(3) Guidelines for eligibility.  Each district attorney that uses state moneys for a diversion program pursuant to this section shall adopt policies and guidelines delineating eligibility criteria for pretrial diversion and may agree to diversion in any case in which there exists sufficient admissible evidence to support a conviction.  In determining whether an individual is appropriate for diversion, the district attorney shall consider:

(a) The nature of the crime charged and the circumstances surrounding it;
(b) Any special characteristics or circumstances of the defendant;
(c) Whether diversion is consistent with the defendant's rehabilitation and reintegration;  and
(d) Whether the public interest will be best served by diverting the individual from prosecution.
Thanks for posting. He certainly had special circumstances, being charged with murder. I guess this was the best Iris could do, which in the scheme of things was not bad for Barry.

So may I learn what has happened to the guilty plea providence inquiry these days?

The judge just leads an accused through this due process requiremment with leading questions, to which said accused simply needs to grunt in the affirmative? And this is sufficient?

I recall well how, in preparation for entering a guilty plea in Special Courts Martial, 'my guy' was going to have to surmount a battery of directions from the Military Judge to explain/describe, in the accused's own words, how he believes he committed the offense for which he seeks to declare his guilt, and is doing so free of coercion or threats of any nature by anyone or any entity.

But imho...

And never mind she was a fugitive of justice, the defense was already filing notices on her behalf (in federal court) within hours of her plane landing in USA-- during the 4 July weekend!

Barry just wants to hunt! As a Colorado native, I've seen the macho, disrespectful to wildlife, spoiled, out of state hunters come in mass with their inflated self image. Frosted tips and gym memberships are not macho. Sedating animals to steal their antlers would be a chargeable offense for anyone else. It goes against the hunting code. Colorado Dept of Wildlife is usually enforcers of the hunting laws. I do wonder how they missed such a high profile abuse of Wildlife. I was under the impression Barry admitted these violations. All MOO.

Nobody local has divulged anything :-(. I am someone who always thought the DAs claim was more false bravado but I will keep watching.

No worries @HongKongPhooey It’s far from over IMO. The searches for Suzanne have not been called off - LE has been tight lipped on their efforts from the start and I don’t suspect that will change. And so, we wait. As does BM.

I'm under the impression diversion programs do not typically extend to felonies.
RSBM. IDK, but this makes excellent sense if it's true. IMO the pretrial diversion programs should be for young people who have made a minor mistake, who show remorse and reason to believe they will not be back in court.

Since BM was in much bigger trouble at the time, the government may have held off some of the less serious violations that came to light. I wonder if they're following up on some now.

On an earlier thread there was discussion about data suggesting BM had defrauded the government of about. 50 K in pandemic salary benefits. Since BM was in much bigger trouble at the time, the government may have held off. I wonder if they're following up now, as they have with so many other benefit scamsters.

We also had a discussion of BM's, um, questionable efforts to avoid taxation. That may bear watching as well, if you're the government...

The information made public in the AA certainly gives LE of all kinds reason to know his name and believe he's a scofflaw. If they have discretion to charge or not, I'm guessing BM's less likely to get the break in the future, however much he seems the good ol' boy.

Life as a known scofflaw may be less fun than BM anticipated, IMO. Here's hoping, anyway.

The crying is mostly done. It's time for retribution. Murder cases never go off LE's radar, especially if the affected family and community keep pressing for answers and telling what they know.

participating programs reported serving 1,221 adults and children; on that same day, 269 needs were unmet
due to lack of resources.

• Approximately 233,000 Colorado women are stalked during their lifetimes.

I believe Barry pays big dollars to have his hair look that way. He looks like almost every 18 year old on the streets. That’s what he wants to be: young, hot and with those “young, hot Salida girls”everywhere. Don’t you know every grown man with daughters in Salida has heartburn knowing Barry walks the streets?

In his defense, I have to say I have seen women my age (old) trying to look like young hot girls too. Somehow they can’t see how ridiculous they look. Some people just never grow up.

Great post @CGray123. As we witnessed, even in these threads, when discussing domestic violence there is still much work to be done in educating people what domestic violence is. If you click on the state facts for Colorado the first thing you will see is the definition of DV. BBM for emphasis on the non phyiscal assault aspects.
