If the Judge decided to respond to the media consortium request to release the arrest affidavit, would that require a hearing or would his response just be published if he so chose?

Since the Media Consortium's response to the State's Order D-7 is not linked to the Court's public site, I don't expect that the Court's answer will be linked in real time. Typically, an answer is filed within 21 days, and if not already answered, I think it's possible that the Court advised the parties of an extension of time required to respond to the Consortium's request.

I think it's possible the Consortium will want to give an oral arguement to any answer denying access as requested. Attorney Steven Zansberg, who filed the response to the Order D-7, actually wrote the proposal (as CFOIC president) adopted by Colorado Supreme Court known as Rule 55.1 (effective 5/10/21) mandating Courts provide the public with a redacted version of the affidavit.

ETA: Regardless of Rule 55.1 in effect, I don't anticipate the AA unsealed to the public before Sept and/or after the Prelim.

Is there a possibility the Morphew hearing is a result of new important and conclusive evidence found by the prosecutor and needs to be given to the court and defense team before the preliminary?

I confess to being ignorant in how that works. Maybe the defense learned something that the court needs to know before the preliminary?

Or vice versa. I'm sure the defense team has investigators working also. We just don't know and again will have to wait it out I suspect.

Yes that’s what I stated. Could be the defense.

I just don’t know if the court system really works that way or if the information sharing is done in private, without a hearing.

But, we don't "know" what he did with the money. For all we know he could have stashed money somewhere legally tight for his daughters. We just don't know.
Most of the $ is now in the coffers of his attys.

He had collected quite a lot! Much more than I believe his defense will cost, as much as they are probably very expensive.

Not sure if attorneys ask for a whole dollar amount before trial anyway. He could easily ask for new attorneys at some point. I am guessing they did begin with a hefty amount, maybe 250k?
Your point is accurate though. He likely has a huge amount stashed, which half should go to his daughters.

I think Barry needed the money from the Indiana house to pay some sort of balloon on the Puma Path house (just my guess), so he had all his cash in the Puma house. We don't know whether he took back paper on that house (I bet he did) so we don't know how much cash he actually has. He did go and buy another house in Salida, IMO. Maybe he's already sold that too.

Because he's going to need every dime. I wouldn't be surprised if he gave them a $1M retainer. Going hourly rate for a good criminal attorney in CO is $600 an hour - and in August, those two will cost him $1200 an hour for all their work, at the hearings and in between the hearings. He's going to go through it fast.

Maybe they're giving him a discount for notoriety.

Dumb Barry. He could have given that money in trust to his daughters and asked for a court appointed attorney.
So if what he wanted was to be free of Suzanne and have money for his lifestyle he failed miserably. Not saying that’s what happened but it seems so.

BBM Might I ask what other home in Salida did he purchase? Totally in the dark on that one! He was renting the Poncha Springs condo was my understanding, which the daughters moved out of immediately after his arrest. TIA MOO

Should be pretty easy for some sleuther to find out if either of them have drug possession charges. I don't think they will play a major role in this trial other than potentially verifying a time line.

Ha! Avocado toast-eating meth heads, for sure.

Time is passing fairly quickly for me this summer - but I bet it's going verrry slowly for Barry. Can't wait till next week.
