I am used to a strong presence in an attorney. You don’t want a wishy washy lawyer any more than you want a timid surgeon. Iris Eytan speaks with authority and confidence. Jeff Lindsey sounds like he is going to offer you a glass of sweet tea. I want a prosecutor with passion, a person that sounds like they know every detail and are there to guide you through. I want them to lay out why the defendant is guilty beyond a reasonable doubt. I like strength. I’m not feeling it here. But then again, I will not be on the jury and I have no idea how his personality plays to the people that will ultimately decide Barry’s fate.
Not all attorney's have to act like a loud, clanging bulldozer to get noticed or heard....

A sweet tea offering attorney might have hands of velvet but can stick a knife in your back while they are serving the tea. Just saying...

Could someone have told LE that Suzanne had a spy pen so they knew to search for it.

Perhaps Investigators discovered evidence of a spy pen being inside the home. Could locating and tagging the spy pen be a reason for LEO CSI return to the Morphew Home for the 2nd time?
I haven’t been here for awhile (and I’ve really missed you guys!) but I had to check in after the hearing today and see what it was all about and ya’ll do not disappoint! Thank you to everyone who provided play by play during the hearing and all the summaries and discussions afterwards.

I’m absolutely gobsmacked by the “spy pen” bombshell! And the amount of evidence and witnesses! But if there is an actual recording(s) of Suzanne herself speaking with someone who will be an important witness in the trial then that is an incredible turn of events. What in the world was going on in that marriage?! Physical abuse, domestic violence, infidelity, financial control, illegal business dealings, fraud, drug and/or alcohol abuse?? Combo of any or all of these things?? :confused: Something very nefarious if Suzanne resorted to that and thank goodness she did! They don’t have her remains YET but at least there will be a “smoking pen”!! Go Suzanne, smart lady!! I think she was going to divorce Barry and she was planning her escape.

I’m a bit confused as to whether Suzanne used this hidden device to record evidence of Barry doing something wrong or illegal or was she documenting some kind of abuse to someone? A friend, counselor or pastor? Or did Barry get the pen to spy on Suzanne? I am leaning much more towards Suzanne getting the spy pen after reading many of your comments. I agree that if Barry had used the spy pen on Suzanne then he would have gotten rid of it. I mean he’s not the brightest but he still managed to get rid of her body so why not a little spy pen if he knew about it. What if he didn’t even find out about the spy pen recording until now?! Can you imagine his reaction? Oh man I bet he needed to change his underwear! If they even give you underwear in prison? :p

Once the defense hears the enhanced recording and sees all the evidence could they then request a plea deal or is it too late? It’s interesting that his lawyer wanted a sanction reducing the charge to 2nd degree murder. Oh and she also asked for bail! Shoot for the stars I guess, why not? :rolleyes:

It doesn’t sound like there was any mention of the AA today. But this trial is going to be epic! :D Justice has begun Suzanne and you will be speaking from the grave to help convict the man who brutally took your life and LIED to everyone including your daughters, the man who promised to love, honor & protect you. I’m so sorry it turned out this way. :(

What awesome headlines for Suzanne Morphew to have and deserve! Spy pen business will be shutting down online retail sites due to a high influx of visitors. We all need a Spy Pen, right?

This very good day of valuable developments is a huge boost for Suzanne Moorman Morphew and the Prosecution Team. Bam! What tickles me about the Prosecution's handling of the Spy Pen evidence, is that they feigned knowledge of this Spy Pen enhancement. What's up with that?

:cool: Listen. How many murders have we had recently that included a Spy Pen? I'm simply over the Moon for Suzanne with today's entire hearing. Take that, Barry!

Are you thinking of a sting of some sort? SM possibly was conversing with someone that BM was interacting with in dirty business deals? Something along those lines? It’s an interesting perspective. There was poster on here a while ago that intimated that Barry was involved in shady deals back in Indiana .. iirc.

If I am not mistaken...the senior pastor left the Morphew Church in Salida the month following Barry's arrest. There is a video of a prayer he had for the Morphew family....and I cannot find it. maybe others can...but the prayer, if my memory serves me correctly, was to help Barry make sound or wise decisions....words to that effect. I am still looking for that video of the pastor's prayer.

Thank you. I've followed Suzanne's case from the beginning and have not heard of this. Then again, I can't/don't follow in social media so I have no doubt there is much I've missed. Thank you for taking the time to explain.

Absolutely agree. That’s what I am hoping for here. I know that Nancy Grace is a sore subject for most people, but I watched her years ago for the first time on Court TV. She absolutely killed. I thought she was terrible at first, but as the trial went on, I was seriously impressed. As long as the case is strong and the evidence is there, Barry will remain in a cage.

From today’s hearing I learned LE presented 26 items of evidence to BM in a meeting on April 5, defense wants to know what those 26 items were.

There is zero, zilch, notta doubt in my mind BM was getting ready to run, as far away and as fast as he could no matter where it was. That’s why the AA is 130 pages long, DA didn’t have time to properly prepare, BM was loading a trailer to get the hellouttadodge….. I guarantee he would abandon everyone to save his stinking, tanned hide.

I think SM found damning information on BM, she was documenting it, and it was bad. Whatever it was, it was worth killing Suzanne over to shut her up. I’m really in a quandary. BM didn’t need to use the spy pen, he could track and get SM’s messages from her iPhone if he wanted. He could put up secret cams in the home if he wanted to watch her during the day.

I think the spy pen was purchased or was a gift to SM with the express purpose to gather info & evidence about BM, and she was using it to get the info on BM, she would record messages left on her phone to the spy pen, then delete them from her phone to keep BM from finding them.
My mind is really wondering….beginning to ramble, my mind is spinning.

What's a tad disappointing in this Spy Pen Saga is that there seems to be doubt and a lack of confidence that Suzanne could have purchased the Spy Pen on her own accord. I think she was highly qualified to take steps she felt necessary in order to protect herself and her daughters.

I can tell you when I executed my well planned, critical exit, one major error, on my part, was removing the tape from the answering machine. He was out of town, so when he called our home landline number, it went straight to voicemail which alerted his senses a day sooner than I anticipated. Hence, I took the tape of saved messages from the phone's recorder as evidence.

I can so much so see Suzanne wearing a ballcap with a plaid shirt when walking into a Spy Shop only to then settle on the Spy Pen. I'm good with it being a gift for entrapping Barry, too. I'm just saying that I feel Suzanne had enough gumption to handle this task without anyone holding her hand.

Speaking of search warrants - didn't the defense claim LE had a very broad and not defined SW? I don't know if it was actually said, but I assumed of the Morphew home?

Also, I don't think any of us are surprised by the daughters phones or devices being taken into evidence, correct? That seemed normal to me. IMO

I guess I'm the odd one out here. Why would they take the daughters' phones? And how would they even get probable cause to take them? Maybe this is some indication about why the judge is bending over backwards to protect them?

Just horribly written. One paragraph talked about the attorneys having several days to prepare for a hearing that hasn’t been scheduled yet.

Ignoring the fact that the preliminary hearing is scheduled, how can anyone have “several days to prepare” for an event that isn’t even scheduled?

It’s not uncommon to ask people close to a victim to allow for their phones to be downloaded. Many times they don’t even need a warrant because they are turned over freely.

They can obtain text messages, location data, social media communications, and all sorts of other stuff.

It’s not only about getting information from potential suspects, but things related to the victim as well (texts that Suzanne sent her daughters for instance).

They may not have Suzanne’s phone, but this would be a great way to get things she sent.

The daughters are part of the story of Suzanne’s disappearance. Who did they call that day? Did they try to reach their Mom? Did they let Dad know? Did Dad pick up his phone? When they contacted him, where did his phone ping? Chain of evidence. Where exactly were they located, when they were “running late”, as Barry said? When was the last communication of Suzanne’s life, to her children? Not to mention all of the other possibilities. Treasure troves.

Mass Guy, I was just about to ask. when is the preliminary hearing scheduled? I think it is late August but I’ve completely forgotten. So much came up in the hearing today. Still thinking about that spy pen. Still asking myself why the defense asked for murder one to be changed to second degree. Maybe I’m wrong but it appears the defense was telling the world that yes, he is guilty.
What on earth has he told his daughters about all this?

Yes. I feel like there is a lot more going on there. I asked recently if it is possible for more/different charges to be brought. I think there is much more to this. JMO

My NG crush has gone but when she first arrived on my radar, she was prosecuting a rash of burglaries at Pep Boys in Atlanta, GA. These criminals were climbing onto the roof of Pep Boy Store locations after hours.

They'd repel down onto the retail floor and steal piles of high end firearms and merchandise abd escpe leaving little evidence. A long investigation revealed that local Police Officers were the thieves. It was about five of them doing these type robberies.

Nancy Grace had a shining star on the Police Officers' convictions and the one that followed of the rich lawyer who hired to have his wife murdered. Her two children were in the car with her when it happened. High profile attorney was charged but his name escapes me. NG got a conviction on him, too. She was an excellent DA.

I think it was to help with a timeline of events. They are all closely connected and presumably in contact with each other often.

Separate opinion- I do think the AA might contain info that is not complementary towards one or both the daughters. It’s just a feeling I have, but I can’t give any specific examples. IMO

This. And I have a feeling Suzanne was not the only victim either. JMO
