So was it Suzanne recording with a spy pen?
Yes, it appears so.

I thought her “voice from the grave,” would be her text messages to her family and friend(s). It now looks like this has a bit more of a literal meaning.

The defense said (not a direct quote) SM's spy pen recordings played for a significant witness. He was wearing headphones and it was hard to understand. It was SM and someone on the phone together.

In another case I follow, the DA required the defendant's attorneys to supply the blank hard drives.

If the defense provided corrupted or damaged hard drives, it became the defenses' problem.

But realistically both sides will have to work together to solve any problems.
The Prosecutor also provided the defense with xls spreadsheet of the contents of the hard drive delivered to defense (xls as they received by LE -- not authored by the prosecutor) which further indicated that certain files were in fact empty -- i.e., contained no data. Can't open what does not exist.

Judge also suggested to the defense that it's helpful for respective IT to talk to each other's IT. An understatement... MOO

Good eye! Interesting you could hear her whispering in the beginning. (defense attorney) was shaking her head a few times as if she was disgusted. Interestingly they are not disgusted by the evidence of what has happened at the hands of their client but rather, less than acceptable discovery turn over.

Defense said at least five times "no physical evidence". Could that mean they just don't know of it as of yet?

I am dying to hear more details about that. If it is in the basement with a gun, I will flip.

I've seen the pictures a million times, but I'm pretty sure the PP house doesn't have a basement.

That is so interesting. It appears Suzanne was on to something for a while maybe? Wonder what that something is?

Exactly. The prosecution said "bits" but I believe he meant bytes. Bits/bytes semantics...

So, we know about the PPP loan for the fake 9 employees, so I have to wonder what else he was up to, that we haven't heard about yet, that maybe Suzanne did stumble across?

Whatever the heck it was, was a big deal enough to cause Suzanne to purchase a spy pen to record things. I mean, how bad does your home life have to be, to even begin to consider making such a purchase? o_O

Exactly! I think we will learn a lot more that will point to motive in this case. I hope anyway!

IMO, spy pen recording being played for 3rd party (witness) was enhanced by the FBI. However, even the enhanced recording required the witness to listen using headphones. The defense also could not hear because the use of headphones silenced the enhanced audio that was being listened to.

Significant witness-that they identified as male, correct? Who is the significant witness, and who was Suzanne speaking to on the spy pen? Please correct or explain what I was trying to follow here.

It’s pretty remarkable law enforcement even found this pen. I could see something like that being easily overlooked, as I imagine they’d never come across one in a situation like this before.

Just imagine the person’s reaction when they realized what they had?!

I'll clarify and ask that others that were watching correct me if I misunderstood. They said "A very consequential witness". We could not make out what was said without the enhancement. The recording was played for the witness and "he" was wearing headphones. I understood the witness it was played for to be male. It could also mean the person that was recorded was a male. Anyone else??

You had it right the first time I think. This star witness is a male.

I hope it’s GD, as he’s probably the most credible person inside Barry’s circle.

I’m stunned SM was recording information/phone calls/pics? What the heck did she catch BM up to or catch him doing? I don’t think it was recording their arguments, or catching him cheating. It’s got to be something more she was wanting documented. Cheating isn’t worth documentation <modsnip> What could it be? Moo

It seems to parallel Libby German recording "Bridge Guy" with her phone just before he killed Libby and her friend Abby Williams on 2.13.2017 in Delphi, Indiana.......with sadly, no arrest of "BG" yet.

Thank goodness SM's killer has been arrested.

I have the urge to gift BM with a toy spy pen...where lemon juice reveals what is written. (Tell your sweet daughters where you hid their mother.)
