So according to IE, early on in the hearing she stated there’s no evidence Suzanne is even deceased, she later turns around and asked the Judge to have the charges against her client dropped down to M2. In essence, she says Suzanne isn’t deceased and my client did nothing wrong, and oh btw Judge, we would like to request the charges be dropped down to M2, lol. I think his lawyers know darn well BM is guilty as sin and want the charges dropped to M2 for better chance of getting BM bonded out.
As far as plea bargain dropping charges down and/or for lesser sentence, imo the DA is absolutely going to want BM to give up Suzanne’s remains’ location before agreeing to any such bargain. Not sure BM will be willing to give that info up, especially if she’s scattered (sorry). My guess is this is going to trial as I think BM in his extreme arrogance thinks he can beat this, that his hot shot attorneys he’s paying beaucoup bucks for will get him off, using every trick in their playbook book ie, try to get evidence ruled inadmissible, discredit witnesses, discredit all LE involved etc., etc. I still believe/am confident that the DA has a strong case against BM and potential future jury will be smart and see right thru IE smoke and mirrors show, and send BM to his new “cage”- prison for life.


Despite the fact you weren’t physically on video at the hearing yesterday, and despite your attorney’s grandstanding smoke and mirrors,

I think they may have had better cases to cite for bail if the charge had been dropped to M2. If they could have accomplished it through sanction, they would be admitting nothing, and using the law to benefit their client. The attorneys have a strategy to defend Barry. Truth isn’t going to work here.

This last hearing sure opened up a lot of interesting, fresh, unexpected conversation. Besides the routine Defense attorney’s shtick which we were expecting, the one phrase “Spy Pen” started the burn, followed by a fire. “Spy Pen” appeared here post#213, and since has pretty much generated over 500 posts in 24 hours. I am not particularly tech savvy; I had never heard of them until yesterday. I sure know what it is now. Could have been a birthday gift from, I don’t know...like from a BFF?

Putting it all together, I am most fascinated with the attorneys suggesting second degree charges. With that request, they might as well be saying Barry did it IMO. No body, no physical evidence as far as we know…the “no physical evidence” I believe was a comment by the defense attorney, but something resonated with them to admit she’s gone and Barry did it.

Maybe he threatened Suzanne and it recorded and added words to the effect “they will never find you,” something like that.

First of all, this is something we should ALL keep in mind. A nice flashy pen is a completely innocent gift. If we know someone who might need one, it would go very well with a lovely journal. I fancy myself a writer and I always encourage everyone to write. Also,I have a thing for pens and stationery, so if I gifted that to someone, and the pen was very special, no one would think it was weird at all.

Bloody brilliant idea.

Well, I liked the way the judge said very sensibly that why couldn't the defense expert talk to the prosecution expert and find out how to open the files. Which programs are needed to open the files.

Which I was wondering, too. Seems like a big waste of court time. Just talk to the prosecution expert, and ask them how to open the files. The DA gave the name of someone who could help them.
Me too! I really like Judge Murphy so far and glad he was sensible, calm & steady while IE was having a come apart over not being able to open some of the discovery and basically implying the prosecution was stalling and doing things to try and make it more difficult for them. As much as I don’t want to admit it…IMO she had a valid point that they don’t have much time left to process such a voluminous amount of evidence, especially if they still haven’t received some of it and the defense has another whole week to get it to them.

I was afraid the Judge might grant a continuance and postpone the August hearings. I’m so relieved he didn’t but hope this isn’t something the defense can use later on to appeal a guilty verdict. I don’t trust “Superwoman” :D and believe everything she does is very calculated to demonstrate their strategy which looks like it’s going to be CCSO, CBI, FBI, DA & prosecution team, etc. have made mistakes or done things improperly. And guaranteed they are going to try and make Suzanne look bad and put her character on trial. What else can they do with so much evidence that their client is guilty as sin? He is not going to look like a Boy Scout and they know it so they will try and make the victim look bad. We are going to hate them for what they are going to do to Suzanne’s memory before this trial is over! :mad: MOO

This is how I see it as well. So important to both sides and that the defense wants as clear a recording as possible to have it excluded as evidence.
Or it is exculpatory. It will be one or the other.

If Suzanne's character is about to hauled through the mud, I just want to say, she probably put up with egregious controlling, excusaholic, behavior too long; head of family power isn't supposed to be used to demand and destroy.

Absolutely, but they couldn't have watched him 24/7. After their meeting on April 5th, he knew he was caught IMO, and much more likely to flee than before.
Speculation among us has suggested that the AA is so lengthy and unedited because prosecutors learned BM was leaving town and had to rush the preparations. I wonder if the prosecution will present evidence along the lines you suggest, as evidence of a guilty mind.

I found this quote among the notes on the Colorado Rule of Evidence 403 page:

“Evidence of a defendant's flight may be relevant to show consciousness of guilt but only if it can be shown the defendant was aware he or she was being sought. People v. Perry, 68 P.3d 472 (Colo. App. 2002)”

So according to this the Spy Pen audio was Barry recording Suzanne without her knowledge instead of the other way around. That is disturbing to say the least and I think it speaks to his state of mind during that time before her disappearance. I am glad the judge didn't reduce his bond and let him out of jail I feel if he gets out of jail before his trial he will run or attempt it.

I think BM implicated Suzanne in his shenanigans.....being a signatory to transactions...that sort of thing....She figured out that he was basically building a fence around her....that is why I think she was scared....and her objections and questions were met with hostility, intimidation and ultimatums. That is what i think.

It seems to me that Fox21 was probably the only network in Salida for the hearing and MSM using their report as the source -- a report I take exception to on details involving the spy pen! However, I posted all of LS tweets (see media link) which are consistent with my recall of the hearing so it's a mystery. :eek:

Yea.... that’s confusing to me, as well. I didn’t understand that part.
From the quotes people are posting it sounds like the prosecution gave the defense a recording of an interview the FBI did with a witness. During that interview the FBI played an enhanced version of the spy-cam recording for that witness, but they used headphones so it's not audible in the recording.

The defense is now demanding that this enhanced version be turned over to them, because the unenhanced version is almost inaudible. The prosecution is saying they're not even sure an enhanced version exists, but the defense is pointing to the FBI interview with the witness as proof that it does.

Yes, I understand why the defense want all of the evidence. I am wondering if it is evidence that was only beneficial to the defense (as I think a post suggested, unless I misunderstood) why the prosecution would even introduce it.

Which then led me to wondering if the prosecution has to introduce everything, even if it doesn't benefit the prosecution. I wouldn't think so. Though I am sure they have to turn over the list of everything that was taken from the home by investigators.
And then it might be up to the defense to do their own investigation of both items that are and are not included in prosecutorial evidence. (If that makes sense.)
In the US, the prosecution has an obligation to turn over any exculpatory evidence to the defense before the trial. The reasoning is that all of the investigatory powers of LE are on the prosecution's side, so they're the ones most likely to uncover that sort of evidence. And if they can just sit on evidence of innocence, then it can lead to bad results.

Failure to turn over exculpatory evidence in a timely manner is one of the things that can get guilty verdicts overturned.

That said, I very much doubt that this recording is good evidence for Barry. I don't think the FBI would have been playing it for a witness (or Barry himself) if it was good for him.

I think it was pretty clear from yesterday that it was Suzanne recording and it was a unnamed man. LE brought the man in and had him listen to the recordings.

I'm far more concerned with prosecutions comments that alluded to their impression that they received no evidence that Suzanne was deceased by murder. Proving she is in fact deceased is step one for the prosecution I would think. The recording pen is just one interesting aspect that is now public. Who was the guy? What were they talking about? and so on. It really may not have relevance to the trial for all we know since we have no idea how it ties into Barry alleging murdering Suzanne. I have zero doubts that LE went very broadly their investigation, most of which won't be used because it doesn't support the case. But I have to hope that they can get their feet underneath themselves and pull it together or it will come off to a jury that they targeted Barry and then looked high and low for anything to support their theory.

I agree, I think Suzanne was recording things being said and done by Barry to herself. She couldn't record him with her phone, I bet he had access and passwords to everything Suzanne ever touched.

I bought one of those a few years ago when my sister thought her husband was cheating. I had it sent to her PO Box, she was a nervous wreck thinking it would be found. <btw the quality was terrible back then, but still good enough to know if he was alone or with/talking to someone> I agree that was something someone has suggested or she found online out of desperation. It isn't something that would just occur out of the clear blue sky for no reason. :(

I don't think Suzanne's family would begrudge him a pushup bar in exchange for the location of her remains.

He won't concede his guilt, though.
He thinks he can win.
Because as we all know, Barry's a big winner.
He's massively successful in everything he attempts.

Speaking of, what was his batting average in the big leagues again, @MassGuy?
