I hear you.
But a lot of us have the capacity to put the victim, alleged, Suzanne first and we get to now our victims very very well insofar as that is possible.
And that relationship with the victim starts in a void, a woman is missing. The void moves into hope nad excitement and intense searching and we hope nad many of us expect that she will be found and that everything will be okay. But she is not found and the stakes get higher and other searches get planned and each of those brings hope too. And she is still not found and we enter the bargaining stage- perhaps she ran away to start a new and wonderful life in a new country and that in time we will all know her new life is great and we'll wish her bon Voyage. That doesn't pan out for the reasons it doesn't. And we face despair. She may be dead. And not of her own volition. She is dead because somebody took her life. As the reality of that sinks in, the rage starts to emerge.. And that stage can last a very long time because it is without catharsis or justice. Invariably a suspect emerges or several. And they have faces and then names but no catharsis or no justice and the rage becomes outrage.

Eventually a suspect gets arrested and we have a focus, it's confirmed now, the person we thought committed this heinous crime is finally being charged and we our rage steps down a notch in that our need for justice appears to become 'salved'. But with that comes the awful realisation of the depth of the depravity that brought about the death of our friend, the victim.

Then comes the trial and only then does an opportunity to release grief emerge for some among us. We're not a homogeneous group of people and we all process everything via our individual filters and mechanisms, not bias.

That's just my personal experience of sailing these stormy seas, too many times.

It's a process that evolves as a result of a profound and awful action taken by a stranger- a rape of innocence.
A beautiful and gentle soul and spirit had her life ripped out of her by somebody she trusted.

I don't personally have much faith in justice for murder victims. The most I can hope for from myself is a release of a spirit I carry on behalf of the victim.
I doubt if the victim gets anything at all from the entire process, even successful prosecutions.

Suzanne Morphew should be alive today.
And to hell with he who took that from her.
Because the one cannot be separated from the other.

Very well written.

We, generally speaking as spectators....want justice for Suzanne, which by default, extends justice for Barry. The defense wants justice for their client, Barry, which, by default, extends justice to Suzanne.....jmo.

I would love to hear Team Barry try to say Suzanne left of her own volition and their explanation and evidence to show:

Suzanne would just up and leave her beloved daughters without so much as a goodbye and leave them to go through life wondering why, when they were on the cusp of so many milestones in their lives.

Why she would just vanish into the ethers with no $. Her $ was tied up in their home. I am confident their bank statements were quite revealing.

When she would have had time while undergoing cancer treatments and during Covid isolation to develop (or maintain) and conceal a relationship so amazing that it would compel her to walk away from her family and her friends.

If she was willing to just walk away and leave it all to Barry, I'm pretty confident he would have helped her pack. The $ was the sticking point.

IMO, the defense team does have skills, no doubt about it, after all they did manage to put lipstick on that pig KK. IMO saying Suzanne left on her own, would be heading down a rough road, too many potholes and nails to get stuck in your tires.

I anticipate as little definitive statements and specifics from the defense that Suzanne left on her own, as much as I expect the "theory" to be cultivated and navigated by the defense...as much as they can interject without objections being sustained, of course. Developing a possibility that they can reference as much as possible over the course of the trial is a likely strategy, to coincide with attacking evidence directly. They need to plant a seed of doubt into the jury's minds...thats their threshold, imo.

Yesl agree that is the threshold..the defense does not have to prove that Barry is innocent. No alleged criminal has to prove their innocence. So I don't "see" the defense trying to come up with some elaborate story or pointing the finger at someone else which they would have to notify the court of their intent to do so. The burden is on the prosecution to prove that they went after the right guy and have the goods beyond doubt for 12 people. We will know soon. I do know that if there are any holes in the prosecution theory that is what the defense will go after in cross examination and through their potential witnesses. I'm still a little leery that the prosecution has what they need but I've said that before. Barry's story is pretty simple...or at least what statements he has publicly made and unless he strayed from that story that is pretty much what we got so the prosecution will need to plug the holes.

I have been a Websleuths member a long time. I am very interested in true crime and justice for crime victims, yet am not one who has a lot of time for research. I am just in the corner cheering on those who do the work.

I too have been a member here - and ditto on the rest of your post. Every since I watched Perry Mason - oh so long ago - interested in crime mysteries.

I'm not much into researching either. That's why I keep notes on most of the trials I follow here.
Amazing people here - most definitely! :)

I just don't see the defense putting BM on the witness stand to badmouth his wife, or offering a defense based on a story he didn't present in his interviews with investigators. Those strategies would blow up in BM's face.

It seems unlikely that the prosecution would introduce evidence of such a story in their "case in chief", so it seems to me if the defense is based on mercy killing or SM running off with the milkman and going into hiding, the defense would have to introduce credible evidence such events occurred.

I'm not even sure such evidence would be allowed. These stories do not seem to be "affirmative defenses" to the charge of First Degree Murder after Deliberation - at least I can't find any such defenses.

For more on affirmative defenses, check out Colorado Revised Statutes, Section 18-1-407 and Nolo's article, Affirmative Defenses in Criminal Cases.

I believe the defense will be a general denial relying on the presumption of innocence.

MOO, BM will try to: (1) exclude evidence of his bad behavior toward SM; (2) undermine the credibility of prosecution witnesses; and (3) characterize the investigation as insufficient due to the Sheriff's "tunnel vision" - overlooking, for example, visitors to the campgrounds near Puma Path, registered sex offenders living in the area, SM's friends and acquaintances, BM's enemies, and other possibilities I can't begin to imagine.

When is AA due out?
Was it delayed after the defense claimed they didnt have the cleaned up spy pen recording?
Neither side asked for an extension of Judge Murphy's order issued in June, sealing the AA until early September (unless the prelim concludes earlier than scheduled). The media objected, but I haven't seen any indication that they appealed the suppression order.

The media objected, and they were again shot down. I don’t expect any movement until around the time the order expires. I imagine the judge will handle this just after the prelim, and we’ll wind up seeing it a couple weeks later.

It’s going to be a hell of a lot less important to us come next week, but that doesn’t mean we all don’t want to see as much of it as we can.
