The defense is seemingly going to run out the clock today. Not the worst strategy in the world, but it means the prosecution really only got to lay the groundwork today.

It’s an important and necessary step, but I was hoping to get to some of the evidence.
Could their strategy be to prevent the prosecution from completing the prelim in the allotted four days, raise a lot of dust and smoke, then ask again for bail?

I think I know the judge's answer: "I can't award bail until the proof evident/presumption great hearing is complete."

Why was she recording her conversation with him? Maybe the pen came on by itself if it was voice activated. I was thinking about this supposed five hour long conversation…that’s longer than I’ve ever talked to someone or would want to be on the phone. They must have been talking about something very important. Barry finding out? Suzanne leaving Barry? Them making a plan to be together? Was the five hour convo on the same day as the last communication from Suzanne? And then he doesn’t call the police when he finds out she is missing? No words…

He had to have been on speaker phone too. That is the only way to record both sides of the conversation.

Is it just me, or does this sounds like a Hitchcock movie? Secret affair, meeting all over the country, Spy Pen that seems to capture the most interesting things. I mean it's in his truck, where it picks up the bike forensic pod cast, and then apparently captures both sides of phone conversations. And then the pen that has done all of this is found in a closet? There must be a whole lot more to come, because I'm shocked the defense hasn't suggested that she's in hiding and framing BM. This all has been so unexpected and bizarre.

Yeah .. totally movie like .. unexpected turns and twists .. I can see that from all this revelations that Suzanne had mentally checked out of the marriage and was trying to redefine herself. She is trying to be proactive by trying to catch Barry. However all this has helped to have her voice back even in her death.

I strongly suspect that there is evidence that Suzanne is dead else defense could have said she has runaway and prosecution would have not gone for first degree.

Wonder if BM took some of her journals.
Especially if she recorded the accounts of abuse such as the closet/gun incident.

Ok, so she accidentally recorded that phone call apparently. I couldn’t figure out why she would ever do that intentionally.

Let alone a 5-hour phone call! Not brought up yet but seems SM was careless with the voice activation unit if recording herself listening to his vm was also by accident. :confused:

I have mixed feelings about the affair partner. She's missing for months and not coming forward with information tells me a lot about persons character. Poor Suzanne - she deserved a stand up guy, not sure she understood that. Sad on many levels.
How would Suzanne know a stand up guy if she saw one? She started with Barry...this guy is a lightweight in comparison...and certainly not chock full of integrity....but he apparently tickled her ears....very sad for her she never had that right relationship that she obviously wanted.

Phone went dark/invisible/unpingable/everything at 4:30 on the 10th.

She stopped interacting with her phone (no calls, texts, messages) at 2:11pm on the 9th..

Waiting to hear what was going on with her phone for the 14 hours in between...
If I recall correctly somebody was using her phone to friend people or look people up from Indiana on FB that night. Old acquaintances were receiving friend requests from Suzanne.

No but I do think the defense could try to argue that SM had multiple affairs and one of those people could be responsible. More conservative jurors could view SM as more "risky" than maybe any of us would and that opens the door for other people to have access, etc.

If I were the state I would want jurors on the young/liberal side. (JMO and not a value judgment, just thoughts on jury selection)

And if they end up older/conservative, still the ones to remember that “thou shalt not kill” overweights “thou shalt not covet”. ))

He was seen at Poncha Market on Tuesday May 12.

And Andy says they were seen at a sandwich shop on Saturday afternoon (and Poncha Store has a sandwich shop).

On Nov. 26, 2018, there were 7 calls between Suzanne and Jeff Libler that totalled 4 hours. The next day she texted Sheila saying she had a tough talk with Barry Morphew, but she didn't mention the new relationship with Libler.

The Monday after Thanksgiving weekend.

Why oh why did he not go to LE as soon as she went missing??
I would think he was worried about losing both his family...and his own life if he thought Barry might find out....That too must have been on his mind since Barry was not under arrest until May.

I’m just curious how SM was able to meet this guy in multiple states and multiple times. I can’t imagine how she’d get away from BM. I mean, maybe a few girls trips? Do we know yet or no?
Looks like Barry took many long hunting trips

So maybe JL wasn't in a happy marriage after all if his brother and daughter knew about it.

Was he single ? Strange that the daughter told uncle instead of her mother. May be he wanted to protect his children too.
