Not most murder 1 cases.

Yes they are. At least the ones that go to try over who did it.

Ones with direct evidence typically end in pleas or in insanity defenses and/or mitigation cases. Not always but often.

The vast majority of murder cases that go to trial when the identity of the killer is in question, are circumstantial.

I believe they are allowed under the Victim’s Rights Act. In the recent Mark Redwine trial, Dylan’s Mom and brother testified and it was mentioned that the VRA was the reason they were allowed in be in the courtroom before their testimony. JMO

Oh! I didn’t get to watch that trial. That makes a difference.

I thought his phone was in airplane mode at 2:44. So does it still ping? Or is he referencing a different period of time that he was chasing her around the home? I apologize in advance for my confusion if this is obvious. Tons of info coming in.
I don’t have the exact times in front of me, but this would probably be between his arrival home and his phone going into airplane mode. Once airplane mode was activated, I don’t think there would be location data.

Thank you. I recall that even after the Judge dismissed Frazee's mom from her subpoena during the ph (she refused to testify invoking the 5th), he banned her from the courtroom. In fact, since she remained on the witness list for the trial, she showed up every day at trial and sat outside the courtroom. (She was never called to testify at trial).

Yes but @Cindizzi explained about the Victim’s Rights act so I stand corrected! I do recall some talk about that in another case (other than Dylan’s) But I can’t recall.

I am not sure where the hot tub was in relation to her sun bathing location, but it could be possible it was in eye sight at the time and she knew it needed chemicals. A random Oh by the way…

To me, if she did text it, it's a typical way of keeping the Spouse from realizing that you really are almost out the door (by pretending to carry on with typical, couple activities - with implied good times).

It's much more likely that, like most people, Suzanne had her passwords stored in her browser. So Barry probably had access to them. He may have caught her off-guard on her laptop and managed to look really quick while she was doing something else (he'd need the password to her laptop to do that - but those are often easily guessed and many couples share theirs with each other - or use the same one).

Barry did it, obviously. (To me, anyway). To make it look like Suzanne was man-crazy. Oddly, most of the people were from an older group of students than the ones Suzanne went to school with.

The tweet reported that her "code" (I assume that means password) was reset (what you do when you can't remember it, and as long as you have access to the email on the account, voila, you're in). The OP was suggesting not that it was Barry that reset the password, logged into her account and sent friend requests, but that it was Suzanne's lover, JL. I don't buy that for a moment.

I believe it was indeed Barry that did it.

I think @Niner started a timeline for all of this

There's still GPS. Here's a link:

[2021 Update] Does Airplane Mode Stop GPS Tracking?

The question in the middle of the page is "Can my phone still track me while on airplane mode?" And the answer is Yes.

I've experimented. I put my phone on airplane mode and can still see the blue dot moving on google maps (which using GPS). It's not as accurate, but it's still there.

In the podcast To Live and Die in L.A., the guy thought that having his phone off or on airplane mode would work - but he was tracked to very near where he put the body. (Which they were able to find).

I think they have that data and are saving it for a technical expert on GPS tracking to tell.

(Hope springs eternal in my heart).

You can also have a code sent to your phone-but was Suzanne’s phone already dark? Or just no more messages/calls?

Well, to keep the charade going. One week before I announced I was leaving, I went on a Yosemite vacation with my ex (where I did get into some relationship talk - it was awkward, but we were in a public place and I felt more safe). I think he got the drift - so that when 5 days later I moved from the marital bedroom to the guest room, he knew what was up. That's when the ugly stuff started.

"Hottub stuff" is probably Barry's domain anyway. He buys the chemicals. But it truly is suspicious that this comes from Suzanne at this time.
Maybe Suzanne really enjoyed relaxing in the hot tub? It may have helped her with any pain she was suffering from due to chemo?

Just one of many manipulations. I think he used all kinds of tactics in order to get what he wanted which was, ultimately, the money. Any claims that he wanted to work things out or apologize were just manipulations in order to make sure everything was in place for him to get his hands on her money. Unfortunately, when Suzanne put all of her money in the house, it was over for her. She'd comingled everything, and the next step was to get rid of her.

Precisely!

Ok. It’s clear from the language used here that the prosecution theory is that Barry did in fact tranquilize Suzanne.

Grusing testifies he wrote in arrest affidavit that #BarryMorphew was 'most likely chasing Suzanne around while she was conscious' and that's why Barry's phone pinged in different areas in/around house, but defense says his movement impossible given time/distance of cell records.

Well crap. That was certainly one speculation I would have liked to have been wrong about.
I'm so sorry Suzanne. :(

BBM This is what I asked earlier too! Would love to know.
Google says the answer is yes, and Youtube can show you how.

@LaurenScharfTV

Neilsen is going over the truck and cell phone data again on May 9. At 1:55 p.m. door opens at DSI and there is surveillance video as well.

Oh, then just an excuse to keep in town longer, so she would have more free time without him.

I get that too.

Maybe Ds plan is forestall witnesses 6,7 and 8 from testifying?
Delay, deflect, deny.
Maybe this is why E&N wanted to know the order of witnesses.

And now by elimination they do know who and what is yet to come, and they choose stalling.
Stanley maybe caught them off guard starting right off with Suzanne's affair.

Stanley didn't bring up her affair, the defense did.
