BM left the home at 1:38 p.m. SM sends a message to Libler saying "Guess who is alone again?? at 2:03

I'm stumped on this. Any takers on what he was doing??

I wonder if he had anything on her phone that tracked keystrokes.

If BM arrived home and, per the phone data, moved around the exterior of the house (looking for chipmunks to shoot :rolleyes: ) does that suggest he didn't go inside the home until after coming across SM in the backyard sunning herself and sending selfies?

Because that might suggest (maybe) that the gun with the tranquilizer darts was either stashed outside the home (seems unlikely to me) or he had it in his vehicle with him (seems more likely to me). Or else he had to go inside to get it at some point before shooting SM.

Personally the most incriminating data to me, as someone asked yesterday, is the detailed truck data about doors opening, when it's in gear vs park, etc. There is still a lot of that data missing and I hope it will provide good information when it becomes known.

One observation after reading @Niner 's great summary -- his truck arrives home at 2:44pm. At 4:44pm the doors open and close. At 5:33pm the truck's system is rebooted.

So, the truck gets rebooted and yet the data from less than an hour earlier is still visible? How little time was "blanked out" by this reboot then? Or maybe the rebooter thought it would erase some data but it actually didn't?

BM's truck was rebooted at 5:33pm 5/9.

To reboot, I suspect he disconnected and reconnected the truck's battery. I'm assuming this was the "mechanical thingy". Did the truck's data recorder have any time spans with no data? As in, the truck battery might have been used as a power source elsewhere?

Forgive me if this has been covered before, I am SO behind.

I don't know, but it did occur to me that, if my understanding is correct, CO allows lesser included charges. So if the jury hangs up on First Degree - which it could, due to the photos being sent right before her demise - the Judge could issue instructions for Second Degree.

I don't think he'll reduce the charge or give Barry bail, but if it comes down to 1-2 jurors holding out for 2nd degree, I do think it's a possibility that in the end, that could be the conviction. But there would still be the additional charges...including the felony gun possession and the others. And I do not think the judge will give Barry the light side of that sentence - so he's going to the Big House for a good long 12-16 years in addition to time served, IMO. Maybe not LWOP, but still a good long time.

I do hope there's a first hand witness to some of the physical abuse. We shall see. I am not optimistic. I think Barry rarely slapped her and did not beat her. I think he terrorized her and as we have seen, he was in fact capable of murder. I wonder if the affair gave her motivation and courage (but boy do I wish she really had just moved out and run off with the guy - right now I'm thinking the guy really didn't want that, though).
I am thinking JL wishes he could put toothpaste back in the tube, bad enough to get caught in a affair by the FBI, having to fess up to the spouse and kids, and then worst scenario wife boots him out and his love interest is not waiting in the wings because she is dead. Nothing stated about wife booting him out! JMO

It was reported that S.O. told LE about it. She helped Suzanne acquire it. This was in June 2020. They got a search warrant and found it in her closet.
This is how LE found out about J.

Morphew atty Dru NIelsen questioning Agent Grusing says Barry Morphew spoke with investigators 23X from May 10 til the end of 2020. None of those times did he mention that he shot chipmunks. This in reference to why his cellphone showed he was running around the house on the 10th

Grusing said Suzanne was sending sunbathing photos of herself to Libler right when Barry Morphew got home around 2:44 p.m. on May 9. His phone pings appear to show him running around the house, Grusing said, and he told investigators in February of this year he was shooting chipmunks at that time, though his phone went into airplane mode about 3 minutes after his arrival, while Suzanne’s phone was still receiving messages from Libler.

Yes. Of course it could hit an artery (the ones in the neck are the first ones I thought of). And I did wonder if he first just pushed her down, and put the gun right next to her neck. If the tranquilizer got directly into the bloodstream, everything goes faster (but it's not going to cause arterial spurting any more than a needle into an artery would do. IMO).

Not worrisome at all. Scott wasn't in the courtroom. Someone took copious detailed notes for him and he performed his podcast from those notes.

ita BM has already admitted he was running around the house at that time. Why introduce evidence that disputes what their client says?

I don't think those darts would leave any more blood than when we have our blood drawn - or get a shot. Hardly enough for most of us to "leave a trail." I usually have like one dot of blood on the bandaid, everyone I know says the same thing.

Say, @10ofRods . What do you think about the possibility there was a lot of body fluid BM didn't anticipate? Namely, if SM had evacuated her bowels or bladder, or if she had vomited. This could very easily happen from fear, but I'm wondering if it could also happen in the tranquilizer-dart process.
In other words, all the cleanup isn't about blood; it's about everything but.
Perhaps BM also spilled the tranquilizer fluid, or at least worried that he had done so. Maybe he even worried that it could leak out of the dart wound?
If one were paranoid, one would want to do a WHOLE lot of cleaning up in this context, even if there were "no" blood.

So I just had a thought:

According to yesterday’s testimony, Barry brought up the excuse of shooting chipmunks, to explain his phone movements around the time Suzanne is believed to have been murdered.

He waited an astounding 9 months to reveal this to investigators.

Now, we know a tranquilizer cap was found in the dryer, and one dart from a pack of 4 was missing (Carol McKinley tweet I posted earlier).

The FBI agent was interested in what weapon Barry was using to hunt chipmunks, as he knew that a 22 could fire those tranquilizers.

Interestingly, the “short rifle” charge is dated between May 9, and March 4 of the following year.

I think this tranquilizer shooting 22 rifle, may in fact be the “short rifle” in the weapons charge.

It’s interesting that the chipmunk story and weapon charge date is so close in time.

Nothing in MSM about his wife, sadly social media was on her within the first hour. For all we know, this guy could have several other Suzanne's, one in every city, could be why he didn't come forward, it looks like he travels for business. He wouldn't be the first.

Things may get a whole lot worse for JL. The FBI may have cleared him but the Defense may try to pin something on his “angry “ family.

Defense argues FBI hasn't interviewed anyone connected to man Suzanne was having an affair with, Jeff Libler. Defense: Mr. Libler's daughter and brother knew about affair, but have never been interviewed by FBI. Defense appears to be introducing possibility of alternate suspects.

As I understand it, there are 12 hours of missing data on the truck.

I think the whole point of disconnecting it was to erase the data on the car's GPS/control motherboard. So far we know that the thing continued to record such events as doors opening and what gear the car was in (as opposed to recording GPS location). I get the feeling there's way, way more that is known from Barry's truck - but my worry is that since he backed the truck to the end of the driveway, he left room to get the old RR out of the garage.

And he may have left his phone at home during that phase.

When Chris McDonough talked about Barry being a hunter, I get the feeling that he knew about the dart gun and Suzanne being his prey on this particular Saturday.

Using a tranquilizer gun on small chipmunks sounds extremely farfetched to me. However, it wouldn't surprise me if Barry took the opportunity to kill any living creature that annoyed him just for the fun of it.

JMO.
Chipmunks are so small that if you absolutely had to kill one a pellet gun would be more appropriate.
