Exactly! It only takes one juror to discount what the prosecution says is true. The problem right now is there is reasonable doubt on just about everything they have entered as evidence. The prosecution needs all of it to be true, the defense just needs one thing to be untrue.
The State is only giving up what it has to in order to go to trial. I have no doubt there is more evidence, and even feel there is a chance she might be found before a trial starts. JMO.

I think the bigger question is, if she supposedly went "Gone Girl" why would she leave her purse, her ID, her wallet, her health insurance card, her medications and so on behind?

Why would she abandon her daughters with no word? Why would she not wait until after her medical appointment? Why would she not wait until the Indiana sale money came through?

Why would she disappear and not return or make contact when her father was on his deathbed? And if she needed money while gone to fuel her drug/alcohol habit, why did she not at least show up to claim her inheritance?

I'm just trying to play devil's advocate here. I think he's guilty in some way but I don't have enough that I think warrants a trial.

To me 'REAL' evidence is bM's DNA on a weapon or body or places it shouldn't be, video evidence of him disposing a body, A CRIME SCENE, a murder weapon with a direct link to bM, blood or DNA evidence in bM's truck, home, hotel room, video of him purchasing a murder weapon or something to help him in the murder or disposal of a body, an audio recording of him harming SM, DIRECT evidence of a blatant lie, computer forensics of internet searches that indicate anything related to a crime, phone evidence of threatening messages, phone records that prove statements he made are false, WITNESSES!!!, mistresses coming forward, evidence of past violence, CCTV of him doing something illegal or catching him in a lie, an accomplice coming forward, an admission of a crime, a body or parts of a body, a money trail that indicates a crime, paperwork that incriminates him.....I could go on but I think you get the idea.

There is none of that here. After over a year there isn't any hard, real evidence that bM did anything illegal. Fishy, yes. Illegal no. I said this earlier you can't try a guy for being a jerk.

Right now all I see is some evidence of a truck computer being reset, a few time stamps and GPS readings that may or may not be accurate, and a narcissist who thinks the world should revolve around him. I also see a woman who is having an affair, who may have a drug and alcohol problem, who has admitted that she wanted to take off and disappear to Ecuador because of a failed marriage and who used a spy pen to spy on her devoted husband ( ok that made me want to puke and I'm sorry I typed it but that's how the defense is going to spin things) There's more hard evidence of Suzanne being dishonest and shady then there is of bM being dishonest and shady. At least from the stuff that has been presented in court so far.

I hate that I think this way but I'm putting myself in the position of being a juror and so far, I'm not seeing anything that makes me think he killed her 100%.

This is a probable cause hearing. Is there enough evidence to say that BM probably killed his missing wife.

It is the totality of the circumstantial evidence. And, for me, these things include
  • a missing towel that Suzanne was sunbathing on
  • fresh fingernail scratches on BM's left shoulder
  • lots of unusual Sat night/Sun morning documented manouevres by BM
  • BM was the last person to see Suzanne alive
  • their marriage was on the rocks, with Suzanne being done with it
  • BM being very edgy on Saturday morning, couldn't focus, and needed to get home
  • No-one has seen or heard from Suzanne since 2:47 on Saturday afternoon
  • Suzanne hasn't touched her bank accounts, her phone, her ID
  • BM did not report his own wife as missing, he didn't even personally check that Suzanne was missing (had not left a note perhaps) before he had a neighbour very quickly report Suzanne's absence for him

Defense will suggest a person, or persons, unknown. They can even suggest that she wanted out, was afraid, made a plan with some sketchy folks and things went sideways. Just relentlessly return to the fact that you have a chatty suspect, traced with phones, vehicles and security cameras and yet not single piece of incriminating evidence. Basically say "our client isn't exactly The Joker, yet he pulled off the perfect murder???" Just need one persuasive juror to think "this guy is too stupid to have successfully disposed of a body under these circumstances." At that point they aren't going to convict based on a plate.
'The plate' is just one more lie in Barry's enormous compilation.

Barry is a LANDSCAPER. He knows how to dispose of a body. Didn't he say to someone that he could bury someone under a tree? Didn't a friend of his say how BM could get rid of someone and NO ONE would ever find them?
Hopefully the jury (yes, there will be a jury, the judge isn't stupid) has brains enough to realize that all of the evidence makes up the whole, not just a plate, as you say. By the way, he said "steaks" plural. Must've been one big-arsed plate with no side dishes that night. C'mon. Then they had sex. I just snorted liquid out of my nose onto my laptop and I have enough problems with this thing.
Please. There won't be one "persuasive" juror who'll convince the rest that BM is innocent or even cause them to believe there's reasonable doubt. They'll make mincemeat out of that person, if there is one - which I highly doubt.
No hung jury. This will be a slam dunk.

The betrayal Barry felt from Agent Grusing is at least some measure of justice. Suzanne would have felt the same when she realized her life was about to end.

Sorry, pbi, why was BM trusting of Agent Grusing?

I thought that too but didn’t know if I could post it on here. I am old enough to be his mother and I just can’t see how his own mother can believe all the lies coming out of his mouth.

Did she not care for and love Suzanne? She sure doesn’t seem like it.

Rape is an act of violence, it happens. Sometimes it is perpetrated by an intimate partner/spouse.

I think, from birth, BM manipulated his mother. He has manipulated alot of people, still is, and mom would have been easy for him being the only son and such.

I tried to peek in...only got to page 26...not sure if it was even this thread lol.

So he had scratches on his hands and arms?
He maybe burned her journal?
He probably chased her upstairs?
There was a shell casing up stairs and looked like he forced his way into the bedroom?
Her camelback was in her car? Well we knew she never went for a bike ride...

They shared a plate for dinner?? BS
Maybe he ate dinner while the washing machine was running.

BTW...who has a safe in the garage???
Never heard of that before.

What an evil person...he shot her with a dart gun, chased her upstairs and killed her where ...on his daughter's bed? And he can sit in that court room like poor victim bear bear?

And we have yet to hear any testimony about her BFF and what she knew …

I'm thinking that we won't - at this point. The Judge has seen it, but to make the other witnesses' words public (unredacted) at this time isn't prudent.

So far, the only witness quoted was the brave Morgan Gentile, whose words were already publicly known, more or less. The Judge almost undoubtedly seen much more of her words. The Defense didn't seem to want to go into MG or try to impeach her, whatsoever.

I don't think they'll endanger SO by having headlines about her at this point in the proceedings (DM, I'm looking at you).

Obviously the circumstances are different, but in the Frazee trial, they judge announced it would go to trial at the end of the prelim.
Yes, that is more of what I am used to seeing. They don't wait too long because there is so much to do if there is going to be a trial and so much to do if there isn't. A judge isn't going to make both sides wait too long because everyone needs to get on with things--one way or the either.

They’ve set it up to deliver their theory tomorrow, but I think that’s going to wind up being close. Looks like she may have run to the master bedroom and he kicked the door in.

The garage safe is actually pretty common, as I think it was a gun safe.

You shouldn't. Probable cause will get him bound over for trial. Preponderance of the evidence (when it comes) will cook his goose (oops, another one for the zoo/ark).

And isn’t it awfully funny how Barry managed to QUICKLY gain access to ALL of Suzanne’s assets? It’s like he somehow knew she wouldn’t be returning to claim her money :rolleyes:
