Not possible. They moved to CO in the spring of 2018, SM first contacted JL in September of 2018 when she sent him a facebook message saying "howdy stranger".
Correct, @kshultz06082. After a few months living in CO she probably felt isolated, alone, and realized how trapped she was. That may be why she reached out to JL.

it's their turn - they can present the SODDI (some other dude did it)- @Alethea gave a good explanation up thread when I asked the same thing.. it's annoying me to no end though.
jMO

Yes, but they already did that the first day and the detective agreed it was correct.

Defense says the DNA profile matches that from an unsolved sexual assault case was from Tempe, Arizona outside a convenience store. DNA was uncovered to see who the suspect was in that case and to see if it had any relation to the disappearance of #SuzanneMorphew @KKTV11News
my recollection is that these were partial DNA matches....huge departure from complete match in terms of identification.

Ahh - he;s already made his mind up. Judge should stay schtum.

Ha. Had to look up your word “Schtum”. Completely agree!

Judge has made up his mind. Let’s do a poll. Shoot, I don’t know how.

I say Going To Trial!!

He

I am talking about the judge who read the arrest warrant and agreed with the DA & LE that it was enough to warrant an arrest. Murphy's criticism is the AA is odd if he signed it then turned around and said it was basically not convincing (my interpretation only).

You are correct that Murphy sealed it. I really don't think he would have signed off on the arrest based on it. But, we shall see at some point today.

I desperately want justice for Suzanne. I hope I am wrong.

MOO

But Murphy said in his order to seal it that it contained more than enough (too much, things that were not needed to convince a judge).

To me, it sounds like he's also the one who issued the arrest warrant. Since he thought the AA was more than enough.

Since they obviously believe the tranquilizer dart was used in the commission of the crime, wouldn't preparing the dart be deemed as premeditation? And wouldn't incapacitating / sedating a person before murdering them be deemed as a plan and a period of premeditation?
Yes, I posted about that in the last thread. The dart is all I've seen so far re potential first degree. Maybe the judge will think there's enough circumstantial evidence that he used it on SM. JMO.

I 100% agree that he was planning her death .
______
I’ve run from an abuser and locked myself in a room and tried frantically to dial 911, only for the door to be broken in and the phone yanked from my hands. The door frame was broken in a similar fashion. It’s very possible given the fact that BM may not have noticed or realized Suzanne dropped a bullet while trying to load a gun to protect herself from him, as we was busy killing her and getting rid of evidence he knew about. Sloppy sloppy BM.

JMO

Sorry you had to experience that. It must have been terrifying. . . .

I'm wondering if there is info -- text messages with the sister or conversations with neighbors and friends -- that might help the prosecution but that they can't get into evidence (even at a prelim) because of hearsay rules. JMO.

Unfortunately there are no hearsay rules here. The first agents on the first day testified about SM's texts and conversations with SO. I believe this is the best that they have.

Good idea… I will add a poll to the thread.

One of the sexual assaults occurred outside of a convenience store in Tempe. Judge overrules an objection reminding courtroom that the defense is allowed to question further in a proof evident presumption great hearing. Cahill then agrees the assault happened outside a conv store

Yes, it could have been auto mechanic, car washer, or tire changer.

The defense is desperate, it ain't going to work IMO.
No. The defence is pointing out that the DNA does not incriminate their client.

Interesting. What did they say was in those texts?

Yes, but they already did that the first day and the detective agreed it was correct.

I think they are just trying to hammer down anything that they feel they didn't get across properly during cross. On cross they are supposed to be limited to what was brought up on direct. If they are leading with direct now, they can cover "new" materials. Our definition of new and their definition of new may be different though.

Starting a new thread. The defense is questioning Cahill about 3 matches to DNA found on the glove box of Suzanne's vehicle and that those DNA matches were connected to sexual assaults. One was in Tempe, Ariz.

According to a letter submitted as evidence, the other two cases were in Phoenix and Chicago, defense says.

Those 3 DNA matches were considered "unknown" but linked to sex assaults, according to a CODIS report. Barry Morphew's DNA was excluded from the glove box sample, according to defense questions. The defense is pressing Cahill on the sex assault cases.

Interesting. What did they say was in those texts?

You'll have to go back to the first day's thread. The FBI agent read aloud texts where SM described abusive behavior to her friends.

  • #539
Forensic Scientist confirmed to Cahill it was a potential lead, not a perfect match, Cahill explained. Now they are talking about another CODIS match from #SuzanneMorphew glove box that matched in Pheonix from a sperm sample. He wasn't aware of a letter sent in Nov. about it.

I find it a little bit odd that none of Barry's DNA was found in her car and glove box. Surely he has spent time in Suzanne's car, being her husband. And I would also think his DNA would be all over her bike, too, if for no other reason than helping her attach it to the back of her truck, when she wants to drive to a trail to ride. Surely he helped her lift her bike on occasion, since he was such a "devoted husband," and she was coming off her second bout of cancer. Or?
Bingo! Didn’t BM get in SM’s RR when she met him at Tailwinds and they went to Safeway and Moonlight Pizza on Friday night?
