a good reminder - the defense would have all of the discovery and the AA so is the prosecution not trying to give up to much information to us - the public? I really want to see the AA because I don't get the sealing at all. so far.

I think he sealed it because he didn't think it was probative enough. And he didn't want all that extra info - whatever it is - in the court of public opinion. MOO

If the prosecution is done they didn't need 4 days, they could have done it in 2. I really don't understand the thinking here.

Not deflated all here. If you sit down and make a list of all the lies, inconsistencies, and coincidences, the truth emerges.

Just look at the timing alone: girls out of town, SM has concrete plans for leaving the marriage ("not gonna happen" per BM), BM admittedly armed with a gun just as SM goes silent, the hastily put-together alibi, the trash dumps, the conviently-timed file-burning, airplane modes, and deleted texts. And this is just a list of timing issues.

Add domestic abuse to the myriad lies and inconsistencies (which I haven'teven touched on here), and reasonable doubt evaporates.
I'll keep this in mind. Thank you for this reminder. :(

New witness: CBI Agent Joe Cahill, who investigated the case extensively. He acknowledges that Suzanne's Ranger Rover glove box had unknown DNA on it, which did not belong to Barry Morphew.

Defense is asking Cahill whether he would accept results from lab reports that show unknown male DNA in Suzanne's vehicle and on the bike grips? They're phrasing it that way because Cahill doesn't recall for himself.

Cahill says he would accept the lab reports. Those reports also say Barry Morphew's DNA was not found in those samples, according to defense questions.

Suzanne’s voice has only been a whisper throughout all of this so far, IMO. And I think that’s a big part of what the Prosecution is sandbagging for trial. Her own words — to her sister, to her neighbor, to SO, and to JL. All of whom can be called to step up and testify at trial. And that’s where justice for SM will ultimately be found.

The content of the AA was deemed sufficient by the judge to take the accused into custody. The PH will allow the judge to determine if the facts presented are such that a trial by a jury of peers for the accused is warranted. And he is by law bound to view the evidence with a prejudice that favors the prosecution. I believe the prosecution has jumped that hurdle. But even if it’s a close call in the judge’s mind, I believe judges will always err on the side of trial. Because, IMO, a jury of one’s peers is always the best imperfect way to see that justice is served.

How many times have we seen a case as noteworthy as this one fail at the PH stage? Not many, at least for me. My main concern at this point is if they establish a bond for BM, what that bond might be, and what limitations may come with it. I prefer, as I think many here do, that he remain in custody.

Defense says there was also unknown male DNA on the bike grips of #SuzanneMorphew bike. They say #BarryMorphew was excluded. Same goes for apparent unknown male DNA on the rear cushion in Suzanne's car. @KKTV11News

Yes, I don't see the them keeping Barry in jail for another year after what we have learned if it does go to trial.
Plus the judge has done everything possible to protect Barry’s daughters. I think he will lower to M2 in order for BM to be with his daughters. I’m sure they have written letters to the court pleading for leniency to give their Father bond. JMO

We don't know the identity of the judge who signed off on the AA. Based on his statements in sealing it, I highly doubt it was this judge.

But he signed it which means he agreed there was cause for Barry's arrest for the stated charge.

What we expected to happen may not have, but the Judge did sign off on an arrest for Murder 1, no body and without bond. There's more MEAT to come at trial IMO.
Yes I like your thinking…and don’t forget what D.A. Stanley said at the press conference after Barry’s arrest. Not a direct quote but she said it was her job and she would not have filed 1st degree murder charges unless she was confident! This is her first big trial since being elected and not only is she putting her reputation on the line but with those words and also reprimanding those who doubted and criticized CCSO & CBI she seemed to be going all in! :)

Eytan reading from the lab report says the prison DNA data system, CODIS, returned 3 confirmed matches from the glove box to other unsolved sexual assaults. Cahill says it's true if it was in the report.
