I am glad i saw the overwhelming poll results for BM going to trial just now. I am not that confident, but so glad most of you believe it will go to trial. I am not too experienced with all of this, so I will have faith based on the poll.. and @MassGuy feeling positive about this. Sound ok? :)

The Spy Pen catching Barry listening to FF podcasts which included one about a missing bike rider.

When did that come in to the Prelim, if you remember? I'm sure the Judge knows about it, but did we hear about it at the Prelim?

I do think he will be held for M1. I just wish the PH had been handled differently.

Me too. I just keep telling myself that the amount that can be presented at trial could be a real avalanche. Right now, it's just about what led LE and the DA to ask for an arrest and then to bind Barry over for trial.

@MassGuy I just remembered that despite Barry sawing off antlers of defenseless, drugged deer, no sawed off antlers at the house.

And in re the furniture of the house and where it went: most of the furniture we see in the living room came with the house (per earlier Zillow photos). So no need to bring that up and obviously, the storage unit was not mentioned at the Prelim.

There are so many things that would come up at trial (the FBI "plant" at the condo complex, Barry's plans to flee, the bulk of SO's statements and also the friend whose name starts with H, also CC, and whatever SD and her BF knew (her BD inserted himself in the case very early). SD is currently on the jail list of approved visitors for Barry...

Seems like the defense would have called BMs daughter to the stand today to refute the restraining order etc... comments if they weren't true.
I wouldn't trust the younger daughter to tell the truth about saying this or why it was said. She will be in defense mode and cover for her father, IMO.

I am so confused as to why they would want a lesser charge instead of dropped charges? They could have said there was not enough there to charge him with her disappearance, but they haven't that I'm aware of?
Someone please help me with this. The charges reduced*, I understand that bond would be granted, but dropping everything about her disappearance would be better or no?

Nothing to see, there, once that quote was put into the context of him watching a video saying that police trick people saying things that then get twisted to make them look guilty.

I think that Suzanne would have taken a photo of it and sent it to JL or SO with an explanation of how it happened.

Busting in a door would be traumatic. To me, the only reason that Barry would do it would be during an argument or pursuit to get at Suzanne.

Agree! And another reason I am not a fan of JL and do not think he was worthy of Suzanne’s love. Who knows what evidence was erased by him in an attempt to save his own 🤬🤬🤬. And yes there is no other reasonable explanation I can think of that the door would be broken open except if there was some kind of an emergency or someone inside had locked it for a reason (fear) and someone big, strong and in a rage was determined to get in that room!

A lot of homes have a special skeleton key that unlocks inside doors if accidentally locked. We had this in our last home…it was a little pin like device placed above the door frame. But even if they had a master key Barry didn’t have time to get it if Suzanne was running from him and had her phone in her hand. She could have called 911 from the bedroom if he didn’t stop her fast. Ugh it makes me sick to think how her murder might have happened. It might not have been a dart and she might have suffered. Suzanne may have literally had to run and fight for her life and it must have been loud, horrific & brutal if it happened like that with a chase & take down.

And if it happened in the master bedroom and that spy pen was in the closet??? If it was voice activated and picked up anything that might explain why it was hard to hear the recording and why the FBI had it enhanced. Wishful thinking but if Barry’s voice is heard and Suzanne screaming with sounds of a struggle that would prove 1st degree murder. But it sure seems like the defense thinks Barry did use a tranquilizer dart on Suzanne so that’s why I’m having trouble combining the two scenarios in a way that makes sense. Why would that needle sheath be in the dryer vent? It fell out of his shorts. Ok why was it in his pocket? He unsheathed a dart and stuck the cover in his pocket to throw away later and forgot about it. Why else would he use a tranquilizer dart during that timeframe? To knock out an elk and cut off its antlers? Maybe he loaded the dart and planned to use it on Suzanne but something happened that altered his original plan? Maybe Suzanne saw him aiming it at her and ran? Could Barry have chased Suzanne, subdued her and then taken out a tranquilizer dart and loaded it into the .22 in the bedroom and shot her in order knock her out and take her to another location to kill her without leaving any blood? Could he have pre-dug a grave somewhere?

Ok I’ve got myself so spun up with all of these awful scenarios that I’m blabbing too much and misspelling words. :mad: I’m going to step away for a bit during the rest of this break.

My daughter texted me a photo of the new Iced Apple Crisp Macchiato from Starbucks. I love apple flavored things (jelly bellies, sour straws, apple juice and even apple flavored Crown Royal) so I’m going to take my Daisy dog for a car ride to try one and maybe we will both stick our head out the window. Be back soon and will then attempt to Keep Calm & Carry On. Thanks for putting up with me. Love you guys! :D

I am half surprised that the defense did not try to say that the cap to the hypothermic needle was from Suzanne injected illegal drugs that she bought from CBD Tim

We have not seen the State's case. There is evidence and witnesses who have not even been alluded to. Have faith friends.
We need you to stick around and give us pep talks. I'm feeling a bit let down right now.

Antlers - IIRC wasn't there talk last year about a antler rack w/ flesh outside the home and many speculated BM was trying to attract wildlife to the home? (maybe he said it was roadkill pickup?) I thought maybe it was just a decoration in the beds around the house. IMO

Updated list of things is have to ignore to believe Barry is innocent.

What was going on in that marriage.

Barry deleting texts that reflected poorly in the state of that marriage (he claimed Suzanne had never asked for a divorce, yet deleted a text from her in which she discussed it).

Barry’s lies on the state of their marriage.

The fact that Suzanne said she was afraid of him.

The psychological abuse, and the threats of suicide.

The fact that Suzanne dropped off the grid when Barry arrived home that afternoon (not a text, not a sighting, not a message; nothing).

The cell phone data that showing Suzanne’s phone went dark before Barry claims to have left the house.

The syringe cap in the dryer, the package with one missing, and the materials he admitted to throwing away.

The car and cell phone data that puts him outside an hour before he claims to have woken up, and in the vicinity of the bike.

The left turn that put him right in the area of the helmet, when he should have turned right (he claimed he saw a herd of elk, which don’t travel in herds that time of year).

The 5 trash dumps, the costume changes, and the boots being thrown away.

Barry forgetting what he threw away.

The fact he left early for a job without the proper equipment, worked 11 minutes, and then lied to the FBI about it.

Barry encouraging his employees to keep working well after Suzanne disappeared, despite knowing full well they couldn’t do that job with what he left them, and materials that were never delivered.

The lie about where he claimed he was when he received the call.

The changing stories he gave to law enforcement over the entirety of the investigation.

The near confession (immunity), the missing journal, the one plate dinner, the book turned to May 9, and the very clothes he was wearing hours before being in the dryer.

The scratches on his arms (3 potential fingernail marks on his upper arm).

The hilarious excuse for possessing tranquilizing darts and chemicals (shooting deer and cutting their antlers off in fricken April, which is all sorts of illegal).

The missing towel Suzanne was photographed with in her last “proof of life.”

What I miss?
Not a miss, but for "The hilarious excuse" item, perhaps add the fact that no sawed/cut antlers found at house? In other words, he tranqs them, abuses them, and then tosses the antlers?

I watch too much television. That’s the problem. I wanted to go out with a bang, not a whimper. I wanted all the evidence to show that Barry killed Suzanne, beyond a reasonable doubt. I have read that the prosecution’s job is to show just enough to bind over for trial-not to present their entire case and give the defense the ammunition to find all of the flaws and prepare for every witness that is called during trial. I’m used the way that hearings are on tv shows, with aha moments and unrealistic expectations. Anything can happen, and we all know what Barry did. Does the Judge agree that the prosecution has presented probable cause? I am anxiously optimistic.
Many cases are like you describe what people sometimes call slam dunks. This case never ever was. If you strip out all the social media speculation and pseudo psychoanalysis there was very little known and some big surprises that no one speculated about. There was a reason the original DA did not press charges... very little of what prosecution had they had a very long time ago. The new DA is taking a risk. If it goes to trial and the state does not succeed Barry goes free. I will be alittle surprised if the judge sends this to trial with the entire laundry list of charges plus aggravation and Murder 1. But then there is a trial and a do-over for prosecution to button things up better.

What I hope that the prosecution will have at trial is a list of Barry's statements (lies) on one side and the proven fact on the other (noted with Exhibit Number) .

Barry has told so many lies and done so many nefarious things throughout Suzanne's disappearance that a concise list will be needed to point all of them out to the jury to put the puzzle together. If not, the defense will make sure that they do everything possible to obscure the facts/evidence.

Barry's activities continued after his wife's disappearance to get control of all assets. This goes to motive and everything that he sold and obtained should be brought out during his trial.

That was the defense excuse after the fact. People with nothing to hide do not ask for immunity.

I just love that because of the ban on taking pictures of the PH, they have to illustrate every article with a previously taken picture. Which happens to be BM in prison wear, no matter whatever suit he was wearing at that day of hearing.

Yeah, I like that too. And I liked that during lunch yesterday, BM decided he needed to shed the suit's jacket, take out his shirt tail and roll up his sleeves. When the Judge came back, apparently he at least tucked in the shirt.

This is a guy who has a lifelong habit, enabled by nearly everyone around him, of doing as he pleases and seeing himself as some kind of hero or maverick.

Was it from SO that we learn that BM held a gun to his own head when she mentioned leaving? Or was that from her grievance list. I cannot remember.

The original DA did not press charges, as the FBI didn’t determine they had enough evidence until the middle of April, when the case was finally presented.

Yes this is good! Especially first paragraph! Suzanne’s own words have yet to be shared. I wish they would have ended with some dramatic quote from Suzanne or her list of 50 reasons but this is not a tv show right? My expectations may have been unrealistic. The prosecution has presented more than enough IMO but this gives me hope for the trial. Thanks!

The D.A. didn't need to end with any dramatic quote from SM's 50 reasons. The Judge has already seen it. In the AA.
