LOL I didn’t know the initials list was still out there. Must be old. It’s way bigger now on my Apple Notes. Haha

Nielsen stands - We are urging the court to rule on the proof evident today....so that Mr. Morphew doesn't have to continue to sit in jail. Judge says he’d rather make the decision correctly rather than too quickly. Judge says to come back at 230.

That's pretty big. I do understand the Judge's dilemma. If BM is not properly charged with Murder 1, he should be permitted bail.

So I guess the Judge's first task is to decide whether he's going to hold Barry on Murder 1, or reduce the charge to Murder 2 and let him out.

People are not supposed to be held without bail unless the charges warrant it. It's my understanding that only M1 can prevent bail in CO.

It is a gorgeous home that resembles a lodge that sleeps seven without anyone on the floor just as an AirBnB might offer.

Those doors are stout. For Barry to kick through a hardwood door that cracks the hardwood molding, required brute force.

What puzzles me is her swimsuit being in the basket that's in her master closet. How could she take this off and place it properly in the swimsuit basket if she's injured by the impalement of the dart releasing meds?

One tweet said it requires 2-3 minutes to fall unconscious; another tweeted 8 min from time a dart enters the body. I suppose it's somewhere in between. Say Suzanne had 5 minutes in order to react before Barry caught up to her. That is, if he shot her from afar.

Why didn't Suzanne have time to also lock herself inside the master suite bathroom if the bedroom door is locked and she's running from a gun toting Barry?

How did the unspent .22 gun shell come to roll under the side of the bed that was considered Suzanne's?

Many unanswered questions still I remain horrified by this heinous murder.

I think it's possible he didn't get her with the dart until she was already inside the bedroom and had changed out of the bikini.

Also she may have only worn the bikini top, with shorts on the bottom, which makes it not weird at all (IMO) to return the top to the closet without washing.

WE ARE DONE WITH ALL WITNESSES - 20 hours of testimony 25 pages of notes from the judge. He won't make a decision today on the #BarryMorphew case. The judge says he's never seen so many witnesses. He says he is going to have a lot of work ahead to make a decision @CBSDenver
Maybe we have an overwhelmed, overworked judge. The AA was longer than any he's ever seen. The witnesses are more than he's ever seen in a prelim. I'm beginning to think this rural court is just not up to the task. How alarming.

I have confidence in the evidence presented given the totality of circumstances, especially in light of the digital evidence, the “trash” runs, the scratches, broken door frame, the unspent bullet, burned up journal and files in the fireplace, his own admissions placing himself at the scene of the bike dump and the helmet dump, etc…and BM’s own words-but this judge appears to give way too much leeway to the defense IMO, and is ultra-conservative in his rulings given the sealing of the AA and his actions (or lack thereof) during the PH. Yes some info that was presented in the AA is difficult to digest, but nothing I can see, given the previous cases I’ve followed, that warrants the delayed release (other than the enormous size).

He is what worries me in this case with regard to whether or not it will be bound over for trial.

Possibly lost in translation but personally, I don’t think the state has presented an airtight case.
I kept waiting but IMO it never happened.
Being a self centered, hot tempered and emotionally absent partner is not M1, nor is it illegal.
IMO that’s all they proved. He lies, he only cares about himself. Yes, all true.

Ugh I want to cry!
I know there's not a lot of direct physical evidence..
but so much of what we've heard is damning. So very clearly premeditated.

It makes me so uncomfortable that the judge actually needs time :(

Looks like difference between one and two, in Colorado, was whether it's directed at a specific person, or just a general disregard for life. Nothing about lack of evidence being a determining factor.

Lauren S is summarizing yesterday's PH, and says that testimony was given stating that Suzanne did not have an ATM card?? When asked how she got money, Barry told investigators that "I am the ATM, I dispense the money."

Wow.

Anyway - to those of you wondering why there's a PH, it's because the defendant gets to hear the over outline of the evidence against him, presented in public, at an actual court hearing, with lawyers present to have their one and only chance of asking questions of the investigators.

I've never seen one where the defense was given so much time, but this is an unusual case. I've also never seen such a short one, when there is apparently so much evidence. Paul Flores's PH in California is going into its 4th week (at least), with several continuances/breaks and no set time for it to be over...
He is the ATM? Not on my family! He is the controller. That’s what he meant. Ugh!
