Just maybe Judge thinks he will crack in the wait time...some say he was close before ....immunity

If the judge does let him out today, could he require him to wear an ankle bracelet?

Where is Barry supposed to live? Isn't that an issue? Would the defense have communicated privately with the judge about the willingness of certain individuals to house him?

I predict bail would be high and would not be arranged by end of business today in any case. I also predict Barry would be able to post his part of the bond and has friends/family who will put their property on the line to secure the bond.
BM can stay with his defense counsel of course.

Did the defense attorneys hand pick this judge? He could make a decision and write it up later.

WHAT? AA decision on 9/17 too?

That next hearing will be the close of the Preliminary Hearing. Judge said AA to be revealed 7 days after the end of the Prelim, which is now scheduled to continue on Sept 17.

So, sadly, we have until at least Sept 24 to see it.

Taking M1 off the table involves many considerations. I can see Murphy's need to research some case law here. I think he'll find that many defendants in CO have been bound over on M1 with similar amounts of evidence - and the Judge definitely has to look at the AA and evidence for himself. I hope he has good staff to help him, because it doesn't sound as if the evidence is well-indexed or that the AA mentioned all of it.

Didn't we just hear/read again at today's PH, an LEO say --- when LE told BM (in Nov 2020?) SM had an affair, that BM denied knowing of it, altho BM thought she might have been in an "emotional affair"?

"Barry learned his wife Suzanne had been having a two-year affair with one of her high school classmates, Jeff Libler (pictured), in the days before allegedly killing her." * bbm ubm

So is the ^ bolding just another bit of dramatic, literary license* by DM? I'm not challenging whether BM knew/did not know, but whether at PH, any witness said BM "learned" of affair before her death. my2ct

Ay, chihuahua. Not good at all. Judge has read the AA, listened to the defense for most of the PH, and still hasn't made up his mind? I can't see any way this could be good. What is going on underneath all this tomfoolery?
That's how I see it. The judge needs time to explain his decision. What?

Whoa. Okay.

That's pretty big. I do understand the Judge's dilemma. If BM is not properly charged with Murder 1, he should be permitted bail.

So I guess the Judge's first task is to decide whether he's going to hold Barry on Murder 1, or reduce the charge to Murder 2 and let him out.

People are not supposed to be held without bail unless the charges warrant it. It's my understanding that only M1 can prevent bail in CO.

The next hearing is scheduled for Sept. 17, when the judge will make his ruling. With that, the hearing is done.
Good!! He can sit there for over 3 more weeks!!

That would be something else. I suppose you are right. I've heard of it happening (rarely). Maybe there's a saloon in town where Barry can rent a room over the bar, like the Good Old Days. (early justice in CO was quite different from what we're seeing here).

Maybe he can stay with the Judge.

I’m guessing that in the end BM will go to trial...for something. If not, the judge would be totally inept. That said, there have been some weird rulings from judges in this country lately. :(

The same man who was arrogant enough to believe he could pull the wool over the eyes of three law enforcement agencies, granting them countless hours of interviews in which he told lie after lie, believed he would be walking out of court today.

He’ll expect the same result in a few weeks, and I hope he gets the same gut punch.

Then the knockout blow at trial.

Important note- The judge said today it would be hard to find a date that all parties involved would be available, you're looking at two large teams on both the prosecutions and defense sides who likely have other cases that already have dates set for hearings.

Judge Patrick Murphy was Deputy State Public Defender for 20 years before becoming judge.

I keep forgetting one important thing - we are only seeing the reporter's tweets - which can't possibly capture every detail of this testimony. I fully expect him to go to trial - the question I have is regarding bond. Will he get bond? If so, will it be cash or a combination?
IMO

I kinda hope it requires property for collateral since BM seemingly has no remaining property to offer.

I don't see how the judge can be ruling to not go to trial if he is waiting nearly 4 weeks to rule on this. If he was even leaning toward not having a trial, why hold an innocent man for 3 1/2 more weeks? I think it's more likely he is leaning way more toward trial and he needs time to write out the reasoning.

Your post, gives me some hope, that Judge would not add 4 weeks for BM to be locked up, if no trial, or if a bond would occur.:):):)

Another long wait for those dedicated followers here, and those involved in the case, and others.
Best of all, BM is so worried: that is the best medicine we have received today.:D
Hope the stress of this wait, really gets to the Creep.
