I am really thinking this search at the Berthoud Pass has to do with Suzanne. Are there any other cases involving the FBI a few hours near where she disappeared? For the FBI to just show up without local LE and start repelling down a cliff is pretty drastic if you ask my opinion. Boy do I hope they find what they went to look for.

So I know some think he talked and I can see why but could it also be possible they received more info from phone or auto gps that they had been waiting on?

Hi All, I hope all of you are doing well! I haven’t really been on in a few days and just wanted to let you know that I will be off Saturday - Tuesday and will definitely get the notes typed up. I overscheduled myself a bit this week and probably won’t get to it before this weekend, but will still try. I have also not been able to keep up with the threads :)() and probably missed some questions. I don't think that I will be able to read through all the recent threads, so if there is anything you have questions about, please re-post the question. I will try to keep up again starting now. :)
@NoSI take your time girlfriend. I have been drained just from posting and following Mon/Tues, I cannot imagine how tired and overwhelming it must have been being there in person.

There were 19 miles that were unaccounted for when #BarryMorphew went to Broomfield. Neilsen said this Salida Stove and Spa trip could account for 18 miles.

Does anyone know any more about these 19 unaccounted for miles when BM went to Broomfield? Neilsen’s explanation makes absolutely no sense to me. BM went to Broomfield early Sunday morning. The defense alleges that BM went to SS&S on Saturday afternoon between 4:00 and 5:30. (SS&S is actually closed at 2:00 pm on Saturdays. They either had the wrong day or the wrong time.)
Anyway, BM left his home between 4:30 and 5:00 am on Sunday to go to Broomfield. Is the defense trying to imply this is when he went to SS&S? Oh, guess not. They are closed on Sunday.
Just another hunk of spaghetti thrown against the wall by the defense to confuse people.

It was abolished there again in 2020 and the governor commuted the sentences of all those on death row at that time.

IIRC -While his sentence would most likely be commuted, BM could get the death penalty if convicted of first degree murder because his crime was committed May 9-10, 2020, before the official repeal date.

"The act repeals the death penalty in Colorado for offenses charged on or after July 1, 2020."

ETA: "It is still possible for someone to be sentenced to death for a capital crime committed before July 1, 2020." Per Wikipedia
I don’t believe it could ever be carried out though.

No arrows from me. There's obviously something sketchy in that AA.

I've followed dozens of Colorado criminal cases and I really can't recall one where the AA was released prior to the preliminary hearing. That's just the way it's done here.

IMO, if not for the unprecedented 130 page AA, together with the May 10, 2021, effective date for amended Rule 55.1, I doubt there would be such mystery surrounding the sealing of this particular AA!

I further believe the court referenced victim protection had to do with SM's alleged affair-- but it's over, the news has been revealed.

If anything is taken from this experience, I hope all will take note of future Colorado cases where again the AA sealed until the conclusion of the preliminary hearing, that pursuant to amended Rule 55.1, the difference will be that the court will assign an expiration date for the seal.

Not anymore, but I distinctly hearing the judge in this case mention that it would fall within the old guidelines.
Yes I just figure they aren’t going to kill him. It’s a liberal State now.

Grusing was asked about the 18-19 miles that were missing from #Barrymorphew odometer in his truck. Nielsen is talking about where Salida Stove and Spa is located and asked if it is a coincidence if the location to the spa is the same amount of missing miles, "No," Grusing said.

At 2:32 p.m. #BarryMorphew is seen in his truck on surveillance passing the Shell Gas Station which is east of Salida Spa and Stove. The truck wasn't seen again until 5:14 a.m. heading east.

What are the "unaccounted for" miles based on? Clearly the truck doesn't log it's every position, or they'd know exactly where it was at all times. It almost sounds like odometer readings compared to the actual mileage of where he said he drove, but then how do they know what the odometer was at any given time? Do we have the exact quotes(s) regarding the 18 miles?

Maybe she was close to home initially and then somehow Barry was able to move her undetected when he found out about Andy’s search last September? Trying not to get my hopes up but the FBI’s language is intriguing: They are not releasing information on the search because it could jeopardize the integrity of the investigation; there is no threat to the public; and more information will be released at a later time. Hmmm…

that is a distinct possibility that I had not considered. I’m kinda leaning toward the theory that BM used another vehicle w/o GPS to transport SM’s body somewhere far away.

I really believe that her remains will be found, if not today, then very soon. When that happens, I have a feeling we’re in for some bombshells.

I believe we learned early on that the pool was closed (from Lauren, I believe). It's in an earlier thread. However, that doesn't mean that they drained it. Restrictions were supposed to be easing soon (don't know if the pool ever opened). Indoor pools can be locked off to hotel residents without draining them.



Phone or truck GPS. Once reset, the truck began to record again. The phone never stopped using GPS, IMO.



No way are these two women doing this for free. Scott Reisch (Crimetalk) has mentioned several times how much he thinks is the minimum spent by Barry so far.

Barry probably gave a very large sum of money to his defense team. Under CO law, this cannot be grabbed by the State to pay off a legal judgment (should anyone sue Barry), and the defense can continue to bill against it all the way through appeal (unless Barry fires them). One lawyer here on WS opined that the hourly rate was probably around $600/hour.

I do not remember anything about the defense asking for more money. I do remember the Judge (in his order about the AA) saying that spending time on all the evidence right now (in order to redact the AA) was too expensive.



When I get my car serviced at the dealer, one of the techs opens the glove compartment, takes out my owner's manual and records the service in the back.

When I go to look at used cars, the salesman always points proudly to this record to prove that the car was properly maintained by a dealer (which gives the ability to buy a cheaper used car warrantee). When I ask a question about the precise HP or milage, the salesman opens the glove box and gets the owners' manual out.

If I give the mechanic I go to now the valet key to the car, he puts it into the glove box. Since this DNA match is partial (and a mix of several persons DNA - including the person at the factory who put the manual in there in the first place), it's worthless at pointing to any particular person. There's one case where manufacturer employee DNA in China confused local LE (made them think they were looking for an Asian perp) and it took a long time to explain and disentangle how this was not an appropriate read of the DNA.



This is an important question. DNA from people involved in manufacturing processes have been found on items up to 10 years later (and each year, there's more evidence that it can be longer). Over time, the DNA breaks up into little bits, which is why there's "mixed" DNA but actual DNA is pretty hard to destroy (even bleach won't do the job completely, there are better chemical).

Lots of study of how many times something can be washed before all the DNA is gone, too. 8 months in this study:

Naturally, it depends on the original amount. I'd love to know whether the DNA was on the outside or the inside of the glovebox (I predict outside) and whether the daughters ever used that particular RR. We do know from MM2's boyfriend's father that his son was up at the Morphew house quite a bit and I would presume he occasionally got a ride.

Anyway, all the different people who ever touched the glove box might leave DNA for quite a while. Further, some of the people in the mixture could be women. The presence of one Y chromosome (or two) in the sample would make defense attorneys say it was a man, but the rest of the broken up DNA that they are "matching" to men could come from women. That's why it's a very poor technique for finding an unknown subject. Any DNA expert could easily explain this to a jury. But as we know, it only takes one anti-science person to refuse to understand/listen to the explanation.



If they could find all of them who might have touched the car over the years (it's 6 years old now) and get a subpoena for their DNA. Which would be very very hard to do. Instead, they're using CODIS to run partial DNA through.

But the turnover among the techs at dealerships is fairly high (the guy who changes cabin air filters is probably a trainee, has moved on long ago).



There was no evidence of a nose bleed - that idea was introduced by a WSer on this very thread.



Wasn't it said that upon digital enhancement, some small part of the top could be seen? Also, there's a time and GPS stamp on it that cannot be altered without the FBI knowing.

I believe it was left their from Saturday and a good going-over by a lab might have been able to show that...

I wasn’t aware there was digital enhancement of her top. I guess they could analyze the cup but maybe their evidence is so strong they don’t need it. Of course I’m guessing. We sure didn’t hear it during the PH. Maybe I am too sure he will be convicted. I definitely think the jurors can see through the mud the defense is slinging. then again...think OJ or Casey Anthony. :eek:

Wait -- wasn't the 18 miles accounted for after BM admitted to chasing deer antlers on opposite US 50, turning around at the mine, and backtracking towards Broomfield via Buena Vista?
Idk I may be confused but Lauren Scharf said it was too short of a distance. She tweeted this:

This is why I think the unaccounted 18 miles are from the home to the dumpster or somewhere in Poncha Springs to chuck her phone. Jmo

You have the same questions I do. Wouldn’t they have to be after the truck reset on Saturday at 5:30 pm?
They were discussed by the defense in the PH. It was tweeted by LS and quoted by @Cindizzi. But I can find no clarification.
Perhaps when @NoSI gets a chance she can provide us with a little more insight.

I would love a first hand account of the demeanor of Suzanne’s daughters and of BM during the last day of testimony. It’s hard to believe the girls haven’t realized the truth by now.
