to be honest, i'm very confused about this matter. i did find the date was 8/6 status hearing. there were many tweets that day and i replied in similar fashion that day about defense stating they needed more money because of the enormous amount of discovery. my mistake was not quoting the post containing that tweet. i spent about 2 hours early this morning looking for that tweet , i did not find it on this forum or on twitter. but i learned a valuable lesson for going forward and that is any tweet i want to respond to, the post containing the tweet as well as the tweet itself needs to be copied and catalogued. i even looked to see if a transcript was available for that status hearing and could not find one. it's bothered me all day. thanks, Seattle1.
I remember this as well. My take at the time was the Defense Attys were complaining about the late dump of huge amount of discovery that they were going to have to spend overtime hours to get through and they wanted the state to pay for those OT hours. JMHO.

Mens Wearhouse opens at 11 on Sunday.

I think everything in regards to BM at the Men's Warehouse was that he spent about 40 minutes at or near a dumpster there. But from my understanding no video, and didn't go inside.

DM reporting BM was shopping.
I can't find the time line so don't know if that's possible.

I'm curious how they know he was there without video and why LE knows this? IIRC, he had no recall of that 'dump', is that right?

I believe authorities used BM's truck telematics (and perhaps his phone) to track BM's whereabouts. It seemed to me that the court was shown google earth photos of each location with a dumpster where no surveillance was available(?)-- I did not get the impression that the State had pictures of BM at every alleged dumpsite-- but I could be wrong.

LOL, did he have a premonition that he was going to need some new suits for court?! I think it's another Daily Fail, honestly.

I'm assuming his truck and phone GPS show him at those stops. Various tweets indicated that Barry admitted they were trash stops. Barry didn't know what LE had or didn't have (actual humans could have come forward and mentioned weird behavior they noticed in some guy that day). So he admits they were trash dumps.

The odd thing is that somehow, we have one tweeter and one youtuber (I believe on CrimeTalk) saying that he pressed down with his hands on the trash at McDonald's. That does sound as if an employee noticed strange behavior at the trash, just like in Salida and was interviewed by LE.

I don't think addresses of witnesses should be put on maps, even if they no longer live there. Pinpointing one address always helps internet sleuthers (and weirdos) to find the next address easily.

I would certainly ask a mod before doing it. I consider MG a victim in this, as well.
Agree. General locations should work for most theorizing.

I google searched the specific date of Aug 6 and found this:

Eytan asked Judge Patrick Murphy again for a bond for Morphew on Friday, but the judge did not grant it. She also asked for attorney fees to be paid for due to the extra work they’ve put in to comb through the discovery to find out what they do or don’t have.

I believe they had surveillance for the McDonald's dump -- direct evidence of BM pushing down the garbage and for how long.

Just where he said he drove vs. odometer.

Which means nothing unless he wrote down odometer reading right before he killed her, and gave that to the police. There has to be a more precise description.
MOO his phone and his truck odometer data align up to a certain point. 2:44pm
Sat 5/9/20.

That is the first odemeter reading point, then the odemeter reading when he arrives at the Bus loop in Broomfield at 8:10am.

Barry says:
1.
A RT trip to Spa Store (+18 miles)
2.
Following Elk in morning ( x forgot the miles)
3.
Driving to Broomfield.

These trips were added together, then the Spa Store trip was subtracted, that leaves 18 miles driven but not explained.

Do we know what day of PH this was discussed? From what I can find, Ford has multiple options for tracking, including a phone app and subscription service. Seems like really bad luck, on Barry's part, if his phone decided to store odometer reading at the beginning of the crime. And if phone was tracking everything, then it would have everything. Sorry if I'm beating a dead horse, but this 18 miles is still too vague.

Thanks, @gliving. Discovery violations -- just as I recall (i.e., sanctioned attorney fees).

I don’t know if users see the same ads at the bottom of the webpage here. Ironically, Men’s Warehouse ads have been at the bottom of my page for awhile now.

The onboard computer of the vehicle collects the odometer reading and location.

So the phone is locating, and the vehicle is locating.

1) If during their investigation, LE found BM was linked to crimes in other States, would that information be disclosed in the currently sealed AA during this case?

2) Would the discovery be treated seperately with its own set of charges?

Briefly:
Yes, virtually certain imo --- hypo only --- BM would be charged separately, and would be prosecuted in the other state(s) where crimes occured.

Not so briefly:
Assuming ^ post refers to --- hypo only --- BM causing (or otherwise participating as co-conspirator, aider, abettor) in the Delphi IN homicides of those two tween-ish girls (3-4-5 yrs ago?), and w no known evd of planning, preparation occuring outside IN, jurisdiction for prosecuting those crimes would be IN. Iow, CO district atty would not be able to prosecute crimes entirely outside CO.

Thank you so much. I pace around the house muttering about how I'd condense this case into about 4 main parts, in order not to confuse a jury. Most of us here have become confused or misremembering something - juries don't usually take copious notes (I was criticized by other jurors for doing so at the one and only trial jury I've sat on - but the judge had said we could use a notebook and pen/pencil).

I just hope that the DV section is emphasized early on (with experts on DV leading that charge).

Although I didn't see a tweet from the hearing confirming this, DM reported that BM was shopping at Men's Warehouse during the 45 minute period! I also don't recall if there's video evidence of BM at a dumpster here.

He had claimed to be tidying his truck.

Prosecution did not meet the deadline the judge set for delivery of discovery. Defense asked for sanctions as well as compensation for the overtime that would be needed to review the late delivered discovery because of losing work days with the late delivery and in order to meet the first day of preliminary. The judge decided to set aside the decision on sanctions.

thanks. i felt for sure i had drifted into the twilight zone. it's nice to hear that i was still in reality.
