Investigators were told to find three books that #SuzanneMorphew would have been together in the home. They found a bible, al anon book, but no journal. In the fireplace, investigators are describing pieces of material that could have been a journal burned.

That's a good question. Colorado Rules of Evidence are similar to the Federal Rules and I think it's going to be dependant on the strategy of the prosecutor. Do they intend to claim that BM murdered SM over infidelity with JL?

First, we have the defendant, BM, telling authorities that he had no knowledge about the affair until they brought it to his attention-- a year after SM disappeared. Second, you have the witness allegedly telling investigators he did not think BM was responsible for disappearing SM. Poses a bit of a problem....

Rules of Evidence provide there has to be the "proper foundation" for the witness, and JL has to bring "material fact" that BM murdered SM. To my knowledge, Investigators never stated during the PH that JL provided them any evidence that BM murdered SM. It doesn't sound like JL gave the FBI anything!

BM's character evidence is not allowed until the penalty phase but character evidence of a witness is admissible. I think JL as a witness brings evidence of a morally bankrupt individual. No value in that except for the defense to use it against SM's character.

In other words, I don't know that bringing JL to testify that he communicated with SM at 2:11 pm on May 9-- just to corroborate SM's own phone records and the last contact she had before going dark is worth it.

I think the evidence best supports that BM murdered SM because she told him she wanted a divorce and wanted to begin splitting up their assets starting with the Indiana contract payment from their former residence that was due in a matter of weeks. I think SM told BM that she wanted to move to Salida with Macy and BM couldn't handle that he could no longer control SM.

I'm making this post because I don't want to forget what I think are some very important facts about BM's behavior from day 1.

BM intentionally did not want any local or national media attention on the fact that his wife was missing! He also did not want to be identified by name, image, or voice.

And probably not until he felt forced to do so, he put out a video - on Facebook!

That dude just ain't right. We should all fear BM.

I’ve stopped asking the “why” of Suzanne’s affair. It’s counterproductive. I understand that we all want to like Suzanne and we want to justify her choice. Suzanne may not have been who we thought she was, or what drew us to this case. Barry cannot murder her because of her choices. When the defense highlights her behavior that includes lying and sneaking around, it is designed to deflect from the facts of what happened to Suzanne. Barry’s movements and Suzanne’s disappearance are absolutely connected and there is no alternative explanation. We can get lost in Suzanne’s choices and Barry can walk.

I think Barry might have accused/suspected SM of having an affair even before she was/if she hadn't actually been. In other words I don't think he actually knew or had evidence, but rather accused her just because that's the kind of paranoid and blamey guy he is.

And I also think he threw out the "maybe it's someone who knows her well" as part of that generalized accusation, not because he had actual knowledge of her affair.

I realize this contradicts all the speculation about him "catching" her online with JL, but I don't think we know that's how it played out, and I don't actually think that's what happened.

It's been reported in MSM that it isn't the same type paper as her journals. Could be real estate listings that Suzanne had been collecting, he wouldn't want them found, or could be her will or trust, things that were changed. Only takes a notary in Virginia, don't know about Colorado.

Also pendaflex file folder metal pieces; the spine and partial cover of a bound book (pages burned/missing). Burned remnants of papers. Unable to tell whether journal as no pages of the book remain. I'm guessing that if LE had a witness who had seen Suzanne's journal and its approximate size, they could help a jury decide whether this very journal-like artifact was, in their view as the jury, sufficiently similar to be Suzanne's journal.

We don't know if he contacted LE, whether with full disclosure or anonymously. He could've easily said that he's a friend she'd confided with about her situation at home and how their communication ended abruptly.
We didn't hear about/from his employees, friends or women he's been in contact with or even had affairs with for any number of personal reasons but I'll assume personal security to be high on the list.
There's also a distinct possibility that any of the above stated to LE that they WOULDN'T testify, or at least until and IF the case DID go to trial, out of fear of retribution.
Some witnesses flat out say they'll never testify out of fear - take what I info I've given you and do what you will with it - but leave me out of it. Obviously, this isn't the case with Jeff (as his affair was only found by LE months later, from what we understand) but he may have sent a 'tip' to LE, we just don't know yet.
He was probably in fear for not only his own life but that of his family's. His gut knew BM killed Suzanne but he had no way of knowing if BM even knew about him, IMO.
Who the hell knows what he was and is capable of.
Barry had an exit strategy and we also don't know if that included, say, a trip to IN and/or a visit to certain 'friends' who didn't comply with his wishes or stay by his side. He already could have been a fugitive if eventually charged in absentia so what would he have to lose? Or if he were never charged at all? What if he's not convicted?
The fact that the defense pulled out the distraction in the PH with Suzanne's infidelity (they don't have any other lame leg to stand on) shows it's pure smoke and mirrors and they know it.
Why some are still harping on it only confirms their assumption that human response to an affair trumps the facts and all the other evidence of a MURDER CASE.
This should be a nonissue unless and until he brings evidence to the case or not.
I realize this may sound like an admonishment but believe me I don't intend it to be taken that way.
This is about cold-blooded murder not infidelity and imo (certainly not on her part, Barry is alive), that's where the focus should stay.
You're all fabulous and I appreciate everyone's opinion but c'mon, Suzanne's cheating is only yet another reason for Barry's desire to kill her.
Also, IMO, he wanted her money - she was out of there - and that was his PRIMARY reason for doing so. His perceived betrayal to his ego only made it that much more palatable, imminently necessary and justified.

#1: Bus stop in Broomfield, same exit ramp as Holiday Inn, BM reportedly threw away “junk, wrappers, and cans”, no pic exists of BM throwing anything away.

#2: On Southside of Holiday Inn, no pic or video of BM throwing away trash, DN stated that BM “is type who doesn’t like to pay for things”, that is reportedly how BM described BM, they discussed that hotel cams caught BM walking in hallway with boots and some type of blue garment in his hands, DN theorizes if BM had anything to hide he would have packed these items in a backpack, BM reported that it was an old pair of boots that had holes, he reportedly threw away “other junk that was in the truck”.

#3: McDonalds, this is where we actually see BM throwing away trash for the first time, he reportedly just used trash cans and decided not to eat there, reportedly threw away “wrappers and bottles that had accumulated from the work week”, trash can was located next to F350.

#4: Carwash, “my truck is a mess and don’t want to pay for trash”, “had time as not as much work on wall as he had thought”, then Men’s Warehouse parking lot, BM denied that he threw anything away, again no video of throwing away trash.

#5: After BM went to worksite, video of BM throwing away “stuff”, “landscaping item” (plastic tree pot” from a nursery in Salida), junk from his truck, slowly walks across parking lot, parking lot with “ton of” visible surveillance cameras, DN asks “would a person that has something to hide do that? Coming from Salida, moving through non-urban corridor, to Broomfield to throw away stuff in daylight and under the eye of surveillance cameras? “

May 10, 2020:

12:43 pm – about 5 pm: BM not leaving room as per Prosecution, as per Cellebrite report and telematics, BM made calls at 11:18 am (to Morgan G.), 11:20 am (to SM), 12:06 PM (to MalM), 12:42 PM BM enters hotel.

1:45 PM & 2:19 PM – Calls to Cassidy C., went through BMs truck as per telematics.

5:45 PM – Call to Martin Ritter. Also went through BMs truck as per telematics.

è So BM in truck not room at 5:45 PM as per DN (implying Prosecution is incorrect).

è Grusing had to confirm that these calls were on the BERRLA, but that BERRLA doesn’t have GPS coordinates, and that BERRLA has gaps.

@mcdonalds – Extended arm to get item to bottom of trash can. More than one trip to trans can? Vial? Grusing states “Can’t tell”, BM also mentioned that he shoots deer with tranquilizer darts, does this either from garage or “breeze way” and he stated that this is where “evidence may be”.

“tranquilizer gun” – BM stated that it was last shot in “late April 2020”, BM shot deer “so I can get the horns (antlers)”, stated “they go to sleep and I cut the horns off”.

May 9, 2020 – BM confirmed that he shot his gun that day, he reported that he shot a chipmunk/chipmunks, BM was asked how SM reacted when he shot chipmunks, BM answered that he didn’t recall.

September 25, 2020 – Mrs. Neppl interviewed again, she confirmed that BM was in store the evening of May 9, 2020, did not buy anything.

“MalM’s room”: MalM is oldest daughter, her bedroom is on 2nd floor of Puma Path, master bedroom is on main floor, sheets found in dryer are sheets from MalM’s room, SM had To-Do list on fridge that included “Mal’s sheets”.

“Dryer”: Was searched etc. May 11, 2020 to May 15, 2020, no body cam footage, LE in house, on May 19, 2020 LE officer located plastic sheath, was not located in sheets.

“Tarts/syringe” – Multiple tarts located in safe in garage.

In one of the early threads of this case there was a link to Suzanne’s 2016 Twitter with pics of her and Barry. In moo those pics look like she was sending a signal to someone Barry could have been having an affair with- like she was saying this is my husband. She referred to Barry as “wild at heart” or something similar . Maybe he wasn’t working out at the gym so much back then but actually did flirt with or have an affair with someone. MOO

Yes, I think DA Jeff Lindsey said it best when he told the court that they may not have uncovered an affair but 'BM was looking' - citing dating websites in his search history. MOO

Defense is going to hammer on the idea that he's so stupid that he leaves bread crumb trails everywhere he goes, yet, in an age of constant tracking, perfectly disposes of a body? Is he The Joker or Elmer Fudd? A mythical "other dude" bridges that gap.

The unknown DNA wasn't a match. It could've been someone's distant cousin for all we and they know and from any time. Then again, if BM had help murdering his wife? It's a double edged, very dull sword.

IIRC Barry paid close attention to true crime on TV. Remembering how much LE hell Amber Frey rained down on Scott Peterson he didn't want his face all over the news.

0808 AM – BM brought in, hugging and padding back of his lawyers, mask over nose this time, wearing grey suit.

0812 AM – Judge Murphy enters.

“BM shoots chipmunks” as per interview dated 2/28/21 – BM says “when I am at home, I just walk around and shoot them”, DN asks Grusing if BM verbalized in “general terms” that he shot 85 chipmunks, Grusing responded “Yes”.

“trash runs” –

#1: Bus stop in Broomfield, same exit ramp as Holiday Inn, BM reportedly threw away “junk, wrappers, and cans”, no pic exists of BM throwing anything away.

#2: On Southside of Holiday Inn, no pic or video of BM throwing away trash, DN stated that BM “is type who doesn’t like to pay for things”, that is reportedly how BM described BM, they discussed that hotel cams caught BM walking in hallway with boots and some type of blue garment in his hands, DN theorizes if BM had anything to hide he would have packed these items in a backpack, BM reported that it was an old pair of boots that had holes, he reportedly threw away “other junk that was in the truck”.

#3: McDonalds, this is where we actually see BM throwing away trash for the first time, he reportedly just used trash cans and decided not to eat there, reportedly threw away “wrappers and bottles that had accumulated from the work week”, trash can was located next to F350.

#4: Carwash, “my truck is a mess and don’t want to pay for trash”, “had time as not as much work on wall as he had thought”, then Men’s Warehouse parking lot, BM denied that he threw anything away, again no video of throwing away trash.

#5: After BM went to worksite, video of BM throwing away “stuff”, “landscaping item” (plastic tree pot” from a nursery in Salida), junk from his truck, slowly walks across parking lot, parking lot with “ton of” visible surveillance cameras, DN asks “would a person that has something to hide do that? Coming from Salida, moving through non-urban corridor, to Broomfield to throw away stuff in daylight and under the eye of surveillance cameras? “

May 10, 2020:

12:43 pm – about 5 pm: BM not leaving room as per Prosecution, as per Cellebrite report and telematics, BM made calls at 11:18 am (to Morgan G.), 11:20 am (to SM), 12:06 PM (to MalM), 12:42 PM BM enters hotel.

1:45 PM & 2:19 PM – Calls to Cassidy C., went through BMs truck as per telematics.

5:45 PM – Call to Martin Ritter. Also went through BMs truck as per telematics.

è So BM in truck not room at 5:45 PM as per DN (implying Prosecution is incorrect).

è Grusing had to confirm that these calls were on the BERRLA, but that BERRLA doesn’t have GPS coordinates, and that BERRLA has gaps.

“tranquilizer dart/gun” – A tranquilizer dart is shot from a tranquilizer gun, no chemical/vial found at Puma Path, BM reportedly stated “I don’t recall having any left” and that it “could have been part of the trash run”, BM “no ideal” why cap in dryer, DNA mix of 2 individuals on cap with BM reportedly excluded, tranquilizer gun reportedly did not work, there is a body cam video in existence where a LE officer stated that the tranquilizer gun is not working. They was not played in the courtroom.

May 6, 2020 – SM with Jean Ritter from 9 AM until 11 AM at the Ritter’s house for coffee, SM appeared “energetic and excited” as per Jean Ritter.

Then talked about Salida Stove & Spa and that driving from Puma Path to Salida Stove & Spa would be 18 – 19 miles’ roundtrip. She asked “Is it just a coincidence that 19 miles are missing?”

May 9, 2020 – Defense brought up calls at 12:02 AM and 2:17 AM, Grusing confirms that these “calls” do not appear to be phone calls, reviewed page 12 on the CAST report, no calls/texts, “signaling calls?”, not showing up in SMs incoming or outgoing calls. The same goes for “calls” made in the early am of May 10, 2020. LAST REGISTERED CALL ON SMs PHONE ON MAY 9, 2020 LATE AFTERNOON. BMs phone in airplane mode May 9, 2020 10:17 PM until May 10, 2020 4:30 AM. Lindsey asks Grusing if this is enough time to get rid of a body and Grusing replies “yes” and then Lindsey or Grusing stated “Gave him 3-hour roundtrip to do what he needed to do”.

May 10, 2020 – BM at Broomfield hotel, 12:29 PM pulled back in, no evidence that F350 moved in afternoon, not at wall because not as much work as he anticipated, went back to hotel at 12:29 PM, “Went to wall and realized not much work was to be done”, 5 ½ hours at Holiday Inn, initially stated that he was at the wall when Jean Ritter called, after evidence was disclosed changed story that he was in hotel watching television.

“chipmunks” – EXHIBIT G – Diagram of porch activity (not shown), they asked BM “Were you looking for her? (when he got home)”, interview @ Poncha Springs residence in 2021 BM stated “I shoot chipmunks”, shoots them with a 22 caliber, tranquilizer gun found at Puma Path is a 22 caliber.

“trash runs” – BM never told investigators what he threw away,

@mcdonalds – Extended arm to get item to bottom of trash can. More than one trip to trans can? Vial? Grusing states “Can’t tell”, BM also mentioned that he shoots deer with tranquilizer darts, does this either from garage or “breeze way” and he stated that this is where “evidence may be”.

“tranquilizer gun” – BM stated that it was last shot in “late April 2020”, BM shot deer “so I can get the horns (antlers)”, stated “they go to sleep and I cut the horns off”.

May 9, 2020 – BM confirmed that he shot his gun that day, he reported that he shot a chipmunk/chipmunks, BM was asked how SM reacted when he shot chipmunks, BM answered that he didn’t recall.

“Men’s Warehouse trash run” – BM shared that he was cleaning out the truck and “getting crap out of truck”.

“I am done” text – Retrieved as a “swipe image” off BMS phone, not all deleted items were retrieved, it is possible that BM tracked SM.

“tranquilizer meds” – Active ingredient, “VAM”, needle sheath found in dryer, Grusing asked BM and BM answered “I have no idea how it got there”, “makes me look bad”, “it’s not right”, “no wonder people in Chaffee County will hate me”.

9:44 AM 4th witness Derick Graham, agent with CBI, for 2 years, prior to that Police Officer in Colorado Springs for 34 years, got involved on May 14, 2020, to assist.

Roundtrip mileage from Puma Path to Salida Stove and Spa 18 – 19 miles. Bottles of hottub cleaner in Ranger Rover half empty. September 25, 2020 – Mrs. Neppl interviewed again, she confirmed that BM was in store the evening of May 9, 2020, did not buy anything.

“MalM’s room”: MalM is oldest daughter, her bedroom is on 2nd floor of Puma Path, master bedroom is on main floor, sheets found in dryer are sheets from MalM’s room, SM had To-Do list on fridge that included “Mal’s sheets”.

“Dryer”: Was searched etc. May 11, 2020 to May 15, 2020, no body cam footage, LE in house, on May 19, 2020 LE officer located plastic sheath, was not located in sheets.

“Tarts/syringe” – Multiple tarts located in safe in garage.

An affair is an affair is an affair. by any other name, it’s still an affair. Without Suzanne here, we just have to go with what LE says.

An affair is almost always an ongoing sexual relationship. In a year and a half, Suzanne met with an old friend 5 or 6 times. IF they had sex, only one text (as far as I know) SUGGESTS they had a night of passion.
We'll learn more at the trial. Meanwhile, JL is not a suspect in anyone's mind as he has a solid alibi and couldn't have murdered Suzanne.
I don't understand why this is important, other than she may have confided in JL about abuse in the home.
