On Tuesday, Morphew appeared in a small Alamosa County courtroom wearing an orange-and-white striped jumpsuit. During the hearing, which lasted about 30 minutes, attorneys discussed several issues, including a possible conflict of interest between Morphew and the public defender's office.

His next court appearance was set for Sept. 2 at 1:30 p.m. after Morphew's defense counsel asked for 60 days to review the discovery in the case.

The latest grand jury indictment against Barry Morphew alleges new details that are surprising even to those who've been following the case since his wife Suzanne Morphew disappeared on Mother's Day 2020.

Suzanne Morphew's husband rearrested for her murder after her remains reveal presence of tranquilizer drugs

This story previously aired on July 1, 2023. It was updated on July 5, 2025.

Barry Morphew, a longtime suspect in his wife's Suzanne Morphew's disappearance, has been arrested a second time and charged with her murder after a toxicologist found a unique combination of tranquilizer drugs in her bone marrow, according to a grand jury indictment made public in June.

Morphew has in the past acknowledged using those tranquilizer drugs to knock out deer and cut off their antlers, authorities say.

The judge said that she wouldn't reduce the bail amount but did modify the terms of the bond. The bond was changed to a cash surety or property bond. That means that a bail bond company posts the bail on the defendant's behalf for a non-refundable fee, typically 10-15% of the total bail amount, which means that he could pay $300,000 for the bond.

The judge also added additional conditions to the bond terms for Barry Morphew:

  • He must surrender his passport
  • He may not leave Colorado for any reason
  • He will wear a GPS monitor
  • He cannot leave his home for any reason except to appear in court, meet with his attorneys, attend a doctor's appointment, or for a medical emergency.
  • He must use only his name of Barry Morphew
  • He must only drive vehicles registered to him
  • He may not possess or control any firearm.

“The factor that weighs perhaps the strongest against modification or reduction (of bond) is that Mr. Morphew does not have a single tie to this community that I’m aware of,” Hopkins said. “His family does not live here and he … says he does not have a single friend or business associate in the area at all.”

On Tuesday, Morphew sat quietly next to his attorneys, David Beller and Jane Fisher-Byrialsen, at the defense table for the approximately 45-minute hearing. He is being held at the jail in the small city of Alamosa, not far from where investigators found Suzanne Morphew’s skeletal remains along a dirt road in September 2023.

[..]

Morphew’s next court hearing is set for Nov. 3.
