That charge was dropped as part of the plea deal. JoCo is doing all the paperwork ATM not CaCo. I cannot see how he could be released with a hold on him from another state and the probable cause for the warrant plus this Discovery motion so I just don't know where he can be if he has to be held for this extradition process to play out. He was supposed to be in Clear Creek till the 24th Jan.

Yes his Failure to Register in El Paso County was a misdemenor which was settled with his plea deal. His Failure to Register in Johnson County, IN is a class 6 Felony however.

I think we need 48 hours minimun or maybe until Monday for his status to show as "Bonded Out" in Co before we jump in circles. JMO..

Maybe the FBI can set up a phony lottery win in Indiana and lure him there, :laughing:

Here you go Foxbluff. I would have thought he would look a little happier if he was being set free. Maybe there's a reason he's not smiling!!!!

I think, they're just using file photos.

Just to reiterate.... those elephant ears on his neck look nothing like BG's ears on his jaw..

Clear Creek Co would have to ignore the JoCo In warrant to release DN so I don't think that has happened. In fact that is possibly the reason for the Motion for Discovery Compliance so that they cannot ignore it IMO.

Unless I see a LE or MSM statement saying DN has been released then I will presume he is still in jail.

That link takes you to a post by Misty which contains a link showing the JoCo warrant for a Felony 6 FTR and also the Probable Cause for that warrant plus the Notice for Discovery compliance. Alternatively read back thru this thread and you will also find it (post 692). Area 52 just posted it again ↓↓↓↓ . Failing both of those you can pull up all the warrants on mycase.in just by entering DN's name too.

Thanks. That is a week old. Do they have an updated one?

I see 2 out of county holds but no out of state holds. We know he had one warrant issued while he was in jail waiting for his court date. I have no idea what the writs are about.

I did look at all his warrants. I'm guessing that a Notice of Discovery Compliance is not a Motion for Discovery Compliance. We don't even know if Discovery is a hold request.

I'll be interested to see what Indiana does. I would be willing to guess they will let him serve his term in Colorado before they decide to bring him back. The Indiana warrants stay good until he takes care to them.

Marion County had a warrant out for him in May but I don't know how states settle who gets first dibbs.

These 2 writs (warrants) were issued in Indiana after DN was incarcerated in Colorado. One is from Greenwood City and one is from Johnson County. These would have resulted in "holds" being placed on him pending his release from charges in Colorado . A third warrant is also issued out of Marion County on 5/25/17 that is still active.

I noticed I put Motion instead of Notice and already corrected it. I think there are 5 warrants altogether but only the one Felony warrant from JoCo so I would think that would take precedence over the misdemeanour warrants. DN didn't get "time" only probation in Co but I think he is looking at a custodial sentence if he does come back to JoCo.

Maybe we missed the extradition hearing in Colorado? No extradition hearing, no extradition from Colorado to Indiana because nobody wants him at the cost to collect him. Indiana LE cannot cross state lines and simpy arrest on a warrant in a different State. I think this legal article outlines the process quite clearly. Of course others may possibly disagree.

i think you misread the link I posted. And no, bounty hunters seek criminals when there is a reward offered for their capture.
