Could admitting to drug trafficking backfire?


She had reportedly struck a plea deal with prosecutors that would have seen her serve a six-year jail term and accept responsibility for drug trafficking.

When prompted by the court, Sainsbury said "it was my decision" to accept the deal.
But judgeSergio Leonsaid there was a lot of "complexity in the development of this plea bargain" with prosecutors and wanted more time to determine if it could "be legal or not".
Earlier in the hearing, Sainsbury told the court that she only took the packages containing cocaine because her family and partner had been threatened, but the prosecution questioned why she did not say that when she was arrested.
"We need to study the first declaration that Cassandra did [at the time of her arrest]," Mr Leon said.

Accused Australian drug mule Cassie Sainsbury will stand trial in Colombia on drug trafficking charges after a judge rejected a plea deal that would have seen her face a six-year term in a Columbian jail.
Sainsbury, 22, sobbed with her head down as she was escorted from court in Bogota this morning after hearing Judge Sergio Leon’s reject the deal for a reduced jail term that was struck with prosecutors in July in exchange for accepting responsibility for drug trafficking.
With the plea deal thrown out, she will now await a full trial at a later date in Colombia. Under Colombian law, she is facing a maximum sentence of between 20 and 30 years if found guilty.
