CS, 22, 1200 block of Via de Luna, Pensacola Beach, fraud ownership to a pawnbroker, dealing in stolen property.

So what was the purpose of that presser I only saw the very end but it seems as if all he talked about was the safe being found buried under rocks?

LPG, Jr is going to have a mental implosion pretty soon. He really thinks his piece of paper stops questioning? He really thinks the police have to follow HIS orders?

I thought that when you asked to involk (sp) your miranda (sp) rights and asked for a lawyer, then you are not to be questioned anymore without a lawyer present. Maybe if an attorney is on this board they can clarify.

He also said they aren't certain whether it was opened. HLN just said there are likely THREE more POI they are investigating.

They can ask him if he's changed his mind as many times as they want, right?

Underdog....I dont honestly know for sure....thats why I am asking. If everything is not done right and a suspects rights are violated, thats where appeals, sanctions and taking the DP off the table comes in.

I understand if someone is questioned, they can insert their 5th amendment right.but, when read miranda rights ( a "suspect" in a "criminal case" ) and then they ask for a lawyer to be present, can they then still be questioned without a lawyer representing them.

There are tons of players involved in this case, its easy enough for anyone to get confused.

Just FYI, Pensacola Beach is in Escambia County, Gulf Breeze is a peninsula and it is in Santa Rosa County and in between Pensacola and Pensacola Beach.

Just to make it more confusing, Pensacola Beach, that is in Escambia County, is a town on Santa Rosa Island :-)

They can ask as long as they do not use coercion .... he much apply his rights to remain silent on a question by question basis. :)

I was thinking the same as you, and am still not entirely sure. This is from the article, as stated by the judge.

“They can ask you as much as they want to, but as long as you keep invoking your Fifth Amendment rights, they can’t get any information from you,” Johnson said.

He also explained why LE initially withheld info about the contents of the safe - saying that they were trying to protect the integrity of the case. It almost sounds like he didn't want the information about the contents released, but since they were - he felt like he had to come out and verify the contents and explain why LE didn't release that info. That's what I got from the presser anyway.

The Judge gave his decision in court and told Gonzales to just "keep mum". In other words, his rights are not being violated because he can refuse to answer without fear of retribution.
