There was some activity filed on MT's cross claim (AC 47734) in the Appellate Court on January 16, 2025:

MT's new PD- Pamela Nagy, filed an unopposed Motion for Permission to File a Late Statement of Alternative Grounds.

The The trial court (Randolph, J.) vacated one of the convictions for conspiracy to commit tampering and the state filed this appeal on June 20, 2024 and the preliminary statement of issues on June 26, 2024. At the time, Attorney Jon Schoenhorn was counsel of record for the defendant. The due date for the defendant to file any statement of alternative grounds was July 16,when Attorney Schoenhorn was still counsel of record.

On July 17,2024, the Legal Services Unit entered its appearance in lieu of Attorney Schoenhorn, and counsel Nagy entered her appearance on December 18 in lieu of the Legal Services Unit.

The Motion argued there was good cause for the late filing because defendant was not represented by Nagy's office when the deadline occurred, and the Motion was granted by Order dated Jan 16, 2025

1/3/2025 - MT's PD Nagy filed a Second Motion to for Permission to Amend Defendant's Statement re. Transcript.

Nagy provided that after recently entering her her appearance on December 13, 2024 and beginning to read the transcripts, the parties referred to a proceeding that occurred on a date not reflected on the docket sheet and case entries ordered by her office. Upon further review, she found a total of 9 hearing dates/transcripts missing from the docket sheet.

1/14/2025 - Motion to Amend Transcript Order Granted (adding 9 hearings previously omitted, 956 estimated pages).

Given the estimated delivery date of the new transcripts not before 1/25/2025, I don't expect MT will be filing her appellate brief timely or by 2/10/2025 as extended. JMO

New Activity in the Appellate Court. AND it also appears somebody feels they were double crossed by the State -- drawing a line in the sand!

2/7/25 -- State of CT filed another Motion for Extension of Time from 2/10/25 to 5/9/25 to file the "Appellant's Brief"--adding the opposing counsel 'consented' the State's request.

The reason for which the extension was sought per the State included the following:

The instant appeal is a State's appeal related to the same proceedings at issue in the defendant's appeal in State v. Troconis, A. C. 47877. In the defendant's appeal, the defendant has requested an extension of time to file her appellant's brief until May 10, 2025. I am requesting the extension in the instant case so that the State's briefing in both the defendant's and the state's appeals may be completed in tandem.

*Drafting of the brief has not yet begun. Work will begin in earnest after the filing of the defendant's brief in A. C. 47877.*


The defense especially took offense to the *paragraph* above, and responded by filing a five page 'Motion for Review of Order Granting the State's Extension Motion for Extension of Time' on 2/10/25.

The jest of MT's Motion is they did not originally object to the state's motion being granted because the state represented that it wanted to keep the state's appeal in this case on track with MT's appeal in AC 47877, which defendant understood to mean that the state's appellate brief in its appeal would be filed at the same time as the defendant's appellate brief in her appeal (i.e., both appeals argued on the same day).

And
because it now appears that the state does not intend to assign an attorney to begin working on its appeal until defendant files her brief in the separate appeal, defendant asks this Court to modify or vacate the order of February 7, or else order that the state's appeal be dismissed should its brief not be filed by May 9, 2025.

In its motion filed on February 7, it stated "I am requesting the extension in the instant case so that the State's briefing in both the defendant's and the state's appeals may be completed in tandem." However, at the bottom of the motion it stated that drafting of the brief had not begun and would not begin until after the filing of defendant's brief in A. C. 4 7877. Upon seeing that language, undersigned counsel contacted Attorney Tim Costello, and he confirmed that is what he plans to do, so that the state files its brief in both cases at the same time.

Undersigned counsel would not have consented to the state's motion for extension of time had I realized that was what the state planned to do. Defendant strongly objects to the state waiting in its own appeal to not even begin working on it until after defendant's brief is filed in a totally separate appeal. Not only is this inefficient because defendant will not be able to respond to the state's brief in this case immediately upon filing her brief in A. C. 47877, but it will extend the briefing by several months, when there is no reason to do so. Such a delay prejudices defendant because she is incarcerated. Furthermore, the state has an obligation to prosecute its appeal with diligence, and in fact, is subject to having its appeal dismissed if it fails to do so. Conn. Prac. Book§ 85-1. For these reasons, defendant requests that this Court modify or vacate its order of February 7 granting the state an extension until May 9 to file its brief. Alternatively, she requests that if the state does not file its brief by May 9, that this Court dismiss the state's appeal for failing to prosecute it with due diligence.

@Seattle1, Sorry it took so long to get a response but I finally have something to pass on to you. It turns out it is a problem with the editor and copy/paste. When I say editor I am referring to the box where posts are entered. This is a 3rd party software and not written by xenforo. That said, neither xenforo nor myself have any control over this.

Currently Xenforo is working on a large rewrite of the software. This expected new version (3.0.0) is planned for release early next year, it will include a new editor.

Why is it that they are not moving forward with KM yet. Is it because of the pending appeal? Is there something the State doesn't want to get out there regarding KM's involvement? Wondering if there is something that would send the case back to another trial for MT? Not to sure how that works or if this can happen.

Having followed several multi-codefendant trials involving conspiracy to commit murder charges, I think the only thing responsible for delaying KM's trial is that the State is not confident their case against him as charged will end in a conviction. That and KM's either not been agreeable to a plea agreement, or the terms of any agreement have been delayed by the State for their convenience. [In the beginning, the State wanted MT to help Investigators take FD down, and perhaps doing so would have produced more on KM but MT was too arrogant to save herself -- let alone save Jennifer].

Clearly, JLS defense strategy was to blame everybody but MT for her part in the murder conspiracy of JFD! I believe KM agreed to be a witness for the State during MT's trial (see MSM linked below) but JLS made noise very early in her trial-- hinting he had every intention to try to impeach KM as a witness-- not any different than he tried throwing shade at PG or anybody who testified for the State.

The State already knew it was a risk to call KM as a State witness based on his conviction/plea agreement for DV charges against his former wife (some would go so far as to say the conspiracy to murder initially started with an alleged plan to hit KM's then-wife first, and JFD would be second).

Fortunately for the State, MT's police interviews were allowed as evidence at trial, and extremely powerful here where MT's own words out of her mouth were sufficient to convict her.

I'm forever grateful that MT did herself in! MT showed the world the truth -- and only her family remained blind to it. JMO

From KM's AA: Take note his initial Bond was set at $2M, and he'd no doubt still be in jail if he did not agree to cooperate with the State (and his bond was reduced to $246K).

9/16/24 Update: Troconis appeared briefly in court for her contempt case. Assistant State’s Attorney Liz Moran said both sides & Judge Hernandez had a conference this morning. She said no offer was put on the record but they are working towards a resolution. the prosecutor referred to motions Frost filed in July asking for more particulars on the contempt charge, as well as a request filed by the defense attorney to subpoena a Massachusetts videographer who operated a camera in the courtroom during the trial. In filings, Frost has asked a judge to order prosecutors to spell out the charges more precisely, and said he wants to ask the cameraman whether he meant to show Troconis' laptop screen on purpose. Next court date is 11/13/24 at 2pm at which time there may be a disposition or lawyers will be able to schedule a contempt hearing, Moran said.
11/13/24 Update: Troconis’ trial in the contempt case has been set for March 11, 2025. Troconis didn’t waive her right to a jury trial yet, but her attorney Robert Frost said it’s likely she will go with a bench trial. The judge granted Frost’s request to subpoena the videographer from the trial to testify. At this point, it’s undecided if it will be a bench or jury trial. The parties are due back in court on 2/19/25 for a check-in date.

In a document filed June 26, 2024, Supervisory State's Attorney Timothy Costello with the Office of the Chief State's Attorney listed the preliminary issues to be considered in the appeal as to whether Superior Court Judge Kevin Randolph erred in vacating the charge & whether Randolph erred in any of his procedural or evidentiary rulings. The notice of appeal was filed on June 20, court records show. A judge agreed to push back the date for the brief in the state's appeal to 2/10/25, court documents show. Prosecutors also need to file a separate brief on that day in her appeal of her conviction, documents said.

9/16/24 Update: Troconis appeared briefly in court for her contempt case. Assistant State’s Attorney Liz Moran said both sides & Judge Hernandez had a conference this morning. She said no offer was put on the record but they are working towards a resolution. the prosecutor referred to motions Frost filed in July asking for more particulars on the contempt charge, as well as a request filed by the defense attorney to subpoena a Massachusetts videographer who operated a camera in the courtroom during the trial. In filings, Frost has asked a judge to order prosecutors to spell out the charges more precisely, and said he wants to ask the cameraman whether he meant to show Troconis' laptop screen on purpose. Next court date is 11/13/24 at 2pm at which time there may be a disposition or lawyers will be able to schedule a contempt hearing, Moran said.
11/13/24 Update: Troconis’ trial in the contempt case has been set for March 11, 2025. Troconis didn’t waive her right to a jury trial yet, but her attorney Robert Frost said it’s likely she will go with a bench trial. The judge granted Frost’s request to subpoena the videographer from the trial to testify. At this point, it’s undecided if it will be a bench or jury trial. The parties are due back in court on 2/19/25 for a check-in date.
1/2/25 Update: Prosecutors appealing a judge's decision to vacate a conspiracy to commit tampering with evidence conviction in the sentencing of Troconis have until 2/10/25 to file their brief in the case. In a document filed June 26, 2024, Supervisory State's Attorney Timothy Costello with the Office of the Chief State's Attorney listed the preliminary issues to be considered in the appeal as to whether Superior Court Judge Kevin Randolph erred in vacating the charge & whether Randolph erred in any of his procedural or evidentiary rulings. The notice of appeal was filed on June 20, court records show. A judge agreed to push back the date for the brief in the state's appeal to 2/10/25, court documents show. Prosecutors also need to file a separate brief on that day in her appeal of her conviction, documents said.

Troconis is accused of displaying court-sealed child custody documents on her laptop during the trial on Feb. 15, 2024, making them available for the public and reporters to see. According to the warrant, the document detailed the custody battle between Farber Dulos and her estranged husband, Fotis Dulos. Troconis allegedly had a page from the report on her screen where it referenced a psychological evaluation and Farber Dulos’ name

Seriously, what possible defense does she have? Didn't know it was there? She did. Can't read English? Yes, she can. Writes it with ease. Didn't know she wasn't supposed to have it? She did. Didn't know she wasn't supposed to show it? She knew. MamaT knew. Love tap + lid snap proves they both knew exactly what they were doing. Blame it on her lawyers? Well, yes, they ought to be held to account too but she had free agency at that table and put that document on blast on purpose.

And it still didn't exonerate her. It only makes her look worse -- for how she actively conspired against JFd in a murder campaign and how she flagrantly bucked the court.

Don't be fooled. She's dangerous. Changing shape at will.

She wasn’t even supposed to have it, much less put it on that computer, or disseminate it in that way. I would bet real money that she isn’t even asked how and where she got it. That video plainly shows to everyone, that she was deliberately displaying it. For what purpose? Likely to allow the videographer to get it-and create a mistrial. Also, because she is a vicious and low-riding hag, she did it, knowing that someone who cared about Jennifer would see it and get very upset.
