Now we are in farce territory as to how interview would evolve based on how interview had actually played out so far and pure speculation.

  • #1,542
Now Fitzgerald is speculating about Bowman testimony today and JUDGE IS ALLOWING IT.

If I were Bowman I would be ENRAGED.

  • #1,543
Opinion on Bowmans goals for 2nd interview. Felt it was unrealistic and improbable set of goals.

  • #1,544
FINALLY admits its the clients decision to talk to police AND testimony at trial!

  • #1,545
Atty Fitzgerald is really close to accusing AB of gunning for the State. Cooperating with the State was in her best interest.

This is absurd.

Whine you can second guess anything from the position of hindsight, but you can't (any more than AB could) forecast how am alternate choice would have unfolded!

Fallacy!!!

If MT hadn't given a single interview, she may well have been charged and found guilty anyway.

If MT had information that would have been helpful in prosecuting FD and chose to keep it to herself, armchair quarterbacks would say she should have had an attorney who advised her to sing.

Really hitting hard on doing 3rd interview 8/13 as being grave error. Said its 'foolish' and 'wishful thinking'!

Objection - overruled based on perspective of defense counsel as to his characterization of police opinion of 3rd interview.

  • #1,547
Atty Fitzgerald seems to have forgotten that MT herself convinced AB before each of the three interviews that she intended to be honest.

Bottom line here, MT was problematic, not her attorney.

She should have listened to him.

Yes, making Bowman out to be a stooge and patsy for the State.

Fitzgerald now claiming he saw references to MT daughter in the videos. I thought this was clarified by Bowman in his testimony.

  • #1,549
Oh my. Now discussing 'coercion' of MT in the interviews.

Isn't this when she agreed to take them to the site where they'd previously hiked/biked, suggesting it was where they'd find JFd? That seems like great cooperation.

Too bad she was lying.

Now saying that it (the interviews) was all the reason she was convicted from Fitzgerald.

JUDGE FINALLY INTERVENES AND STRIKES after the objection was made.

SHAMEFUL. Fitzgerald should have been admonished.

  • #1,552
She got convicted because she's guilty.

I think so and iirc LE was super pissed about hours and hours wasted on a snipe hunt in the woods for iirc 2 days. She imo should have gotten another hindering charge for that entire charade. Took precious resources and wasted it on a lie.

Whoever was filming this testimony in direct disregard for the Court's instruction on decorum probably things this is winning T testimony, on account of all of the overruled objections, but this is all speculation with the benefit of hindsight. I don't see the judge ruling in MT's favor.

Fitzgerald says each of 3 interviews didn't meet professional standards.

Beginning CROSS.

Tuesday might be next trial date.

We will see if it shows up on the Troconis website.

40-50 hrs for supression prep - $600/hr discounted bill $8,000 $12,000 - total was $30,000 before discount. Bill was paid by Schoenhorn. Has no clue who paid the bill. Now saying it came from Troconis family.

  • #1,558
Judge Randolph excluded testimony of Fitzgerald at supression hearing.

Did you review decision of Judge Randolph as to why it denied Fitzgeralds testimony? Fitzgerald couldn't answer this completely and just said he reviewed part of the decision by Randolph.

  • #1,559
Establishing that Judge R called AB seasoned and competent
