As ever, what you guys write here makes me think. Today I tried to look at the case minus some thoughts I had had like a drum, etc. In this reframing, I thought about how it seems FD was trying to blame people in a neighborhood that perhaps he felt was more crime-ridden than his own. JD’s car also was left somewhere away from her house, at the park, again IMO trying to divert attention from association with FD. He wanted it to look like a stranger did it such as in a crime of opportunity. So now I feel like he wouldn’t have put her in water, which might be more readily linked to him. Where DO bodies get disposed of in that area more commonly? I’m thinking that park or near it even though I know it’s been searched. What places are between JD’s house and the park? He’s a math guy so maybe think straight line or triangulation. Extra bonus for places with no or poor cell reception. Just some thoughts. MOO.

It’s only my opinion but I would bet yes. They have the means for things like household help, taking the kids places, and while it certainly wouldn’t be what anyone wished, I think based on what they’ve said and done as a family since this began, this is a close-knit, tough family of strong women headed by GF, and they’ll do whatever they can to keep these kids safe aka away from FD. As someone noted above, I am sure JD did have those wishes in an updated will. MOO.

Is it on the route to somewhere else like surrounded by woods or a pathway or utility roads or utility-line access paths? I’m not from there so no idea.

DNA is direct proof of the fact that FD was in JD's home and left his DNA mixed with that of JD in the kitchen sink. FD's statement about not wanting any of his DNA inside JD's home (this statement was made to the GAL the evening prior to the murder) is direct evidence of his consciousness of guilt. Videos of FD's garbage/slash tag dump are direct evidence that, on the day of the murder, FD HIMSELF dumped bags containing evidence of JD's murder. Short of a confession, an eyewitness, or a video of the murder itself, all physical evidence requires the jury to make a connection between the evidence presented and the elements of the offense. Such as, if a murderer's DNA is found under a victim's fingernails, it is a reasonable conclusion (inference) that the victim had contact with the murderer in some fashion. In addition, FD own words and actions are direct evidence that he was physically inside JD's home, mixed his DNA with hers and subsequently undertook actions to dispose of evidence of her assault. It will be up to the jury to conclude that this evidence, in combination with other evidence, means FD committed first degree murder. FD's comments to the GAL, his girlfriend (assuming cooperation) and even FD's TV interviews will be used to establish guilt; I think his own words will come to haunt him.

Agree. I love circumstantial evidence and don't understand why it gets a bad rap.

It looks like there’s a barn there, a waste bin, some buildings that might not be used as much as before, a big house built by someone associated with IBM, and more.

Are there farms especially large-scale with hogs, cows, or chickens and manure lagoons around there? What types of wild animals or exotics live there?

While pondering the "innocent until proven guilty angle," I am concerned about CT's tough laws concerning custody. This is certainly a complex dilemma for the judge and attorneys.

Connecticut has numerous rulings and standards I found online. The following are from this source:

This is the initial ruling that was comforting to me:
“We have consistently held in matters involving child custody that while the rights, wishes and desires of the parents must be considered it is nevertheless the ultimate welfare of the child which must control the decision of the court.” In re Appeal of Kindis, 162 Conn. 239, 242, 294 A.2d 316 (1972).

However, this quote is concerning.
Nonparent: “In any dispute as to the custody of a minor child involving a parent and a nonparent, there shall be a presumption that it is in the best interest of the child to be in the custody of the parent, which presumption may be rebutted by showing that it would be detrimental to the child to permit the parent to have custody.” Conn. Gen. Stats. § 46b-56b (2017).

I have a vague memory of NP making an off-hand comment that FD has other concerns right now rather than the care of the children, BUT FD seems intent upon securing his parental rights. I wonder if bringing the niece to CT would make the 5 children living with him more palatable to the court. Then, on the other hand, the "family" home is for sale and he could be moving if it sells. NP says he wants FD at "his side to prepare FD's defense," so water skiing may not be an option this summer. FD seems to be cash strapped at the current time and it would seem the expenses inherent in hiring childcare, camps, and general kid stuff might be difficult without either MT or JD's funds helping him.

Surely, the court has to weigh all aspects of the children's care. I'm concerned that GF's age and health issues might be a concern for the court.

Then, I find myself thinking that nothing will change until after the pre-trial hearing in August. By then, however, the children should also be thinking about the next school year. Where would they be enrolled? Could they go to school in NYC or would the court mandate they stay in CT?

If FD is held over for trial in the tampering case, and no charges filed in the disappearance and presumed demise of JD, would the court grant him visitation? Would a new GAL be appointed for the children? So many maybes....This is real headache material....:(

I get that GF’s age and health could be issues but she has resources—; it’s not like she will have to physically pick them up and carry them around and she undoubtedly has excellent health care. I also bet she won’t be going to water-ski competitions all over the world for 10 days a month, and on and on... I think the health and well-being, physical and otherwise, of the kids will be at issue if they are allowed to be with FD. I say this based on what he himself has said and how he has acted including as noted in the court records of his behavior that made him have supervised visits. At the same time, almost anything can happen in this world but I hope not. Could any judge sleep at night having allowed that? Maybe they should do a SWOT (strength, weakness, opportunities, and threats) analysis of the benefits and potential issues to the kids on both sides. Let’s see...one, GF, may not live another 50 years (like anyone is guaranteed tomorrow) while the other, FD, may have ended the kids’ mom’s life at 50 years. MOO.

I guess right now I am banking on the Judge in the Divorce/Custody case deferring to the terms of the bail/bond. FoDu cannot have contact with the 5 kids or anyone from JDs family. Criminal court would supersede divorce/custody court. Now he would have to designate a “relative” like his niece or cousin or sister. As such I would think that the maternal grandmother would have the most parent like relationship to the children? But what do I know? I would think that the fact he took the 5th in his first court appearance in the custody matter (June 11th when he bonded out) would not work in his favor? I cannot imagine any judge giving custody to FoDu or his family members at this point? Maybe FoDu and NP/RR are hoping that LE will present information in the custody case as a reason to keep the custody arrangement as it is currently?
The Joshua Powell case weighs heavy on our minds. The kids are doing as well as can be expected right now and moving them into a different situation seems not only unnecessary but potentially dangerous or at the very least problematic. Any verified attorneys want to weigh in? I know this situation is already unusual bc you have a missing mom/presumed dead and the estranged spouse is out on bond/bail on criminal charges related to his estranged wife’s disappearance.

I know it can’t happen but if I were the grandmother, I’d be making arrangements to move those children out of the country, even if it landed me in jail.

Irwin Park has a trail that connects to all of these other areas and has wetlands and vernal pools as well.

The GreenLink was constructed in 2017 and 2018. The trail opened on Earth Day of 2018, and has since been one of the town’s most popular walking trails.

Recreation Opportunities: NCLT continues to maintain the portion of the GreenLink Trail that traverses its three properties. Visitors to the trail will enjoy the beautifully crafted walkways that traverse through unspoiled wetlands, as well as the woodland path that meanders alongside ponds and vernal pools.

The trail is also part of a larger 2.5-mile walking loop, accessible from downtown New Canaan. This loops connects Irwin Park to theNew Canaan Nature Center, thus enabling visitors to wander through the meadows of Irwin Park, enjoy the beauty of the wetlands protected by the Land Trust, and stop by the Visitor Center at the Nature Center, all without having to get into a car.

One more thought for the day...maybe we addressed it long ago but as athletic as FD was, wouldn’t you think he’d have a FitBit or an Apple Watch? MT, too. I don’t recall hearing about them.

I am mindful of the limbo the children are in.
It's only July but what about September?
Will they be able to return to school in NC?
What a quandary for GF.
Will their father be free and have some kind of custody?
Or will she prevail and have full custody?

If the civil court acts on FD's underhanded financial dealings, GF & the children will have their pick of the Fore Group houses & can sell the others.

(Except that it sure looks like at least one of those houses is a crime scene....)

Of course no info from LE as to why the park was searched twice. But, IMO the location of the park is a short distance from Welles and sadly again no cameras that I am aware of mean that a car or truck could be parked without notice (except overnight as I think LE would spot that) for long periods of time. A person could jog/run/bike to Welles from Irwin with no issue.

The park doesn't have as much foot traffic as Waveny but there is typically a steady stream of walkers/runner and dog walking people during the day. The front portion of the park is wide open but the back of the park is somewhat wooded but there are houses adjacent in the rear and on the Weed street side of the park.

I totally agree. IMO He wouldn’t stage her car to look like an abduction only to then hide the body on his property. In fact, I’d think it would behoove him and his $$ motives to have her body discovered. Could this be a case of hiding in plain sight?

Wouldn't that be an interesting twist in this sad case! But in all the photos we have seen of FD on FB and elsewhere there hasn't been a fitbit that has been visible. Has anyone seen one on FD? Very interesting question!
