Been waiting for NP to file another motion....Didn't expect this one so soon. The Hindering and Interference won't have merit, IMO, if there is no crime charged. NP, IMOO, is trying to force LE to act before they are ready......Dang it. I suppose the court docket etc. could delay action on this motion. Will this need to be heard before the August 2nd hearing or could that be the topic of the hearing?

I do not believe there is anything mandatory. I live in New Canaan and have never heard of this; in fact my own tank is probably overdue.

The State has many rules but hasn't YET reached the level of telling us when tanks have to be pumped!

But truthfully I don't believe people have much choice in the matter as anyone that has seen a septic system in distress knows its a very messy and smelly process and hugely expensive to fix. A house two roads away had a major septic issue a few years ago and the smell was unreal and the people in the house had to vacate while an entirely new system was installed which took a good bit of time too.

Exactly. Norm is chomping at the bit for a murder charge so he can request a speedy trial. Actually smart lawyering. Interesting to note that on 7/22/19 they gave him 20 some odd CD's from the Albany Ave. joy ride. MOO.

Good old No Case Norm!

He is holding true to his name and shouting there is no case! Gotta love him. Curious to see how the Judge responds to this brilliant piece of drafting spelling errors and all! I wish CT were a state where improperly drafted motions get kicked back by the Court Clerk. Unfortunately based on the prior Pattis motions filed CT is not one of those states.

I think we have over 60 days left on the warrant seal ruling so seems IMO that Pattis is just antsy with no/limited discovery and LE resources in evidence working very hard on the case.

Wonder if State's Atty has as yet returned Pattis's phone calls? Maybe this motion is a dramatic plea to answer his calls?

Wonder if FD is anxious to head back to Greece for an international water ski competition and he had a hissy fit with Pattis and that is what prompted this request?

Love the 26 CD dump....hope that they gave him 100 boxes of transcripts from the tip line to sift through too! That could result in over $100,000+ of billable hours for the as yet unseen player THE NEW PI who would have to fire up his SUV to traverse the State checking out all the information!

Yes, especially with the rainy weather and poor ground saturation now. Don't wait IMO! Still laughing to remember the scene with the house that had the damaged system. Neighbors were highly annoyed and the two closest neighbors actually left for a period of time until the site could be cleaned up. Gave new meaning to the phrase ' storm'!

Hilarious that we are chatting about septic systems and No Case Norms motion to dismiss on the same day and at the same exact time!

Would love to see some video of his client as the CCTV of FD getting his mail was totally riveting IMO! Have to say if the CD dump is the way the State is going to play this case then we might be in for a long one here.... But I do have to admire States Atty sense of humor if this is him throwing No Case Norm a bone to chew on!

Tell me about it! We moved into an old house that had a cesspool, not even a septic tank, which failed a year into our life here. My entire (sort of meager) pension from Hitachi went to bypass the failing cesspool, to create the new extra large septic tank and leaching fields. I’m sure the neighbors were glad. This is how I know that, at least in theory, the septic tank could be a place where FD might have disposed of JD. Good grief-where is she???

This motion is not impressive; it looks like NP pulled it from a criminal defense form book, inserted basic facts of the case, and added a few florid touches. It obviously avoids a discussion of what was contained in those videos, which tells me there is damning evidence in them.

Its logic is also flawed. If FD murdered his wife, he had to be aware that his actions would be the subject of a LE investigation. What NP is dancing around is the "serious physical assault" that was discovered in the garage. This assault caused FD's efforts to destroy evidence.

I think this motion is fishing expedition. NP is hoping the state will reveal its theory of the case in responding to it. He is trying to find out what evidence the state knows.

Great observation on what does seem to be ongoing coincidental timing! I wonder what might be going on behind the scenes that we're just not aware of.

Not sure how the water supply shapes up in NC but FD being a contractor building new houses on properties where the old dwelling was razed ... perhaps he had to dig new wells of the old ones weren’t sufficient enough to pump as many GPM as need for his McMansions ... so if there are abandoned wells on his properties he’d know where they were .

As in most states I know of, CT requires well drillers to get a permit before installing or abandoning water wells, and copies of the well logs have to be submitted as public records. Rules changed in 1970 so there are more on record now. Anyone can look as here for NC:

The state geological survey or department of natural resources probably have maps but I didn’t look.

I forgot he built new houses where others were razed. Very often in those cases although it’s not advisable for a large house especially due to settlement issues, contractors would fill in the former basements with construction debris and whatever and then place fill over it and grade it. I don’t anyone looks much at what gets covered at that point. I don’t think FD had a house being razed when JD disappeared but if anyone else did, it’s a thought.

While he may have put liquids through a septic system, it seems to me that anything solid would need to be quite small to avoid detection, the hose they use for pumping is only about 6".

If LE had any reason to think there was evidence in his septic tank, they probably wouldn't hesitate to excavate it.

Just as some septic systems have larger diameters than others do, some of the hoses are bigger. I’m not saying that FD’s houses had the larger types although there are public records.

FD was born in Turkey, grew up in Greece, but I have not found if he is a US citizen. He came to the US in 1986.

Why am I asking? I remember from other cases, when a person is convicted, they can be sent back to their home country, usually after time is served for the crime. I know FD is not tried yet, but I was interested.

Yes, FD is a US citizen and we learned this when he had to surrender his US passport in Family Court. Many at the time we learned this questioned why Family Court didn't demand surrender of all passports. We later learned that FD has passport from Greece and potentially one from Turkey although testimony on this point was unclear in Family Court. FD as you mentioned was born in Turkey and by all accounts immigrated to Greece along with his family as a child. We do not know if the family were political or religious refugees or how they qualified for Greek citizenship.

MT citizenship is a bit of a question and is unknown. The arrest warrant simply states Born in TN. But to get US citizenship the general view was that she would have had to file paperwork for citizenship in the US and its not clear this ever happened. It appears the family went back to Venezuela shortly after her birth and she received all her schooling in that country. If anyone has any confirmation on citizenship status please post to close out this question!
